Home My WebLink About870108.tiff 7-\ RESOLUTION RE: ACCEPT RESULT OF BALLOTS CONCERNING ADDITION TO LIST OF CERTAIN PESTS TO BE CONTROLLED WITHIN THE ST. VRAIN PEST CONTROL DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on December 15, 1986, pursuant to Section 35-5-104 (8) , CRS, the Board approved the request to include Hoary Cress (Whitetop) (Cardaria draba) , Musk Thistle (Carduus nutans) and Bull Thistle (Cirsium vulgare) on the list of pests to be controlled within the St. Vrain Pest Control District, and directed that ballots be prepared and mailed for a vote of landowners and lessees within said District, and WHEREAS, the Weld County Extension Service prepared ballots which were mailed to landowners and lessees, as defined in Section 35-5-101 , CRS, located within the District to determine whether said pests should be added to the list, and WHEREAS, one hundred thirty-seven (137) of the ballots were returned to Clerk to the Board, and WHEREAS, the Weld County Assessor, the Weld County Treasurer, and Ron Broda, Weld County Pest Inspector, counted the ballots and found that more than fifty-one percent (51%) of the landowners who mailed in their ballots were in favor of the addition of the hereinabove mentioned pests to the list of pests to be controlled within the District, with one hundred twenty-one (121) landowners being in favor and sixteen (16) landowners being opposed, and WHEREAS, the Board believes it to be in the best interests of the County to accept the result of the ballots and add the above mentioned pests to the list in the St. Vrain Pest Control District. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that pursuant to Section 35-5-104 (8) , CRS, the Board does hereby accept the result of the ballots and appprove the addition of Hoary Cress (Whitetop) (Cardaria draba) , Musk Thistle (Carduus nutans) and Bull Thistle (Cirsium vulgare) to said list in the St. Vrain Pest Control District and directs the Clerk to the Board to inform the District Advisory Committee of the St. Vrain Pest Control District of same. VRAIN PEST CONTROL DISTRICT ._ _WHEREAS., xthe_.Board of County Commissioners of Weld County, Colorado, pursuant to Colbradi '`statute and. .t"he 'We'ld County 'Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the St. Vrain Pest Control District Advisory Board has submitted a written .request to the Board, pursuant to §35-5-104 (8) , CRS, asking that certain weeds be added to the list of weeds to be controlled in this district, and WHEREAS, a copy of said letter of request is attached hereto and incorporated herein by reference, and WHEREAS, the Board has been informed that each of the weeds in the request comes within the definition of "pest" pursuant to §35-5-101 (10), CRS, and, therefore, may be added pursuant to §35-5-104 (8) , CRS, and WHEREAS, the Board deems it appropriate to grant the request of the St. Vrain Pest Control District to add such weeds to the list of pests to be controlled in the district. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Hoary Cress (Whitetop) (Cardaria draba) , Musk Thistle (Carduus nutans) and Bull Thistle (Cirsium vulgare) be added to the list of pests to be controlled in the St. Vrain Pest Control District.
