RE: APPROVAL OF RECORDED EXEMPTION NO. 1068 - WILBUR AND SHIRLEY
HURT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 1068, does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1068 was
submitted by Wilbur and Shirley Hurt for property which is located
in part of the Ni of the SW* , Section 22 , Township 3 North, Range
68 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 55 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following: 1) The applicant submitting a
mylar plat to the Department of Planning Services to be recorded
in the office of the Weld County Clerk and Recorder. The plat
shall be drawn in accordance with the requirements of Section
9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty days from the date of approval by
the Board of County Commissioners; 2) A Weld County Septic Permit
is required for the proposed home septic system and shall be
installed according to the Weld County Individual Sewage Disposal
Regulations; and 3) An ISDS Evaluation on all existing septic
systems will be necessary prior to issuing the required septic
permit on the existing system.

Re: Recorded Exemption #1068
Dear Commissioners:
The request for a recorded exemption is submitted by Wilbur and Shirley
Hurt. The parcel of land on which this request is being made is described
as part of the 10 of the SW} of Section 22, T3N, R68W of the 6th P.M., Weld
County, Colorado. The property is located approximately 1.5 miles south of
the Town of Mead on Weld County Road 7. The parcel under consideration is
the total contiguous land holdings of the applicant. The request is to
divide the property into two parcels of 55 acres and 5 acres, more or less.
There is an existing residence and other improvements on the proposed 55
acre parcel.
The Town of Mead and the Highland Ditch Company have reviewed the
application materials and have no objections to the request. Both the Weld
County Health Department and the Engineering Department have reviewed the
request and have recommended approval with conditions.
The staff has concerns whether the proposed division will be consistent with
efficient and orderly development. At this time, there are three recorded
exemptions and one subdivision in Section 22. The section consists of
thirteen parcels of land each ranging in size from 111 acres to 1.36 acres.
The average acre size is equal to 37.71 acres, more or less.
The staff recommends that the Board of County Commissioners consider this
request and determine if the standards of Section 9-2 E. (1) (a) through (m)
of the Weld County Subdivision Regulations have been met.

CONDITIONS OF APPROVAL

Wilbur and Shirley Hurt
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be prepared in accordance with the requirements of Section
9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be
submitted within sixty (60) days from the date of approval by the Department
of Planning Services.
Weld County Septic Permit is required for the proposed home septic system
and shall be installed according to the Weld County Individual Sewage
Disposal Regulations.

TO WHOM IT MAY CONCERN:
This is a request to divide a farm into 2 ( two) parcels .
I am retired and no longer able to farm this acreage prop-
erly and wish to divide a small parcel from the main acreage
and- build a smaller home to remain in this community.
This is net a sub-division but only a home on a small acreage
divided from the larger parcel. The land will continue to be
used for agriculture , which we feel is in compliance with
the Weld County Comprehensive Plan.
The total acreage was purchased December 20, 1971 from
Frank and Elizabeth Weingardt and no Recorded' Exemption
has ever been submitted by us.
A domestic water tap is available through the Longs Peak
Water Association. ( Copy of letter included )
Subject property is not located in a geologic hazard and/or
Weld County Airport Overlay District and complies with any
Overlay District Regulation as outlined in the Weld County
A Zoning ordinance.
