RESOLUTION
RE: APPROVE CONTINUANCE OF HEARING TO SHOW CAUSE FOR REVOCATION
OF AMENDED SPECIAL USE PERMIT #345 - MS CORPORATION
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on June 24 , 1987 , a hearing was held to show cause
for revocation of Amended Special Use Permit #345, issued to MS
Corporation, and
WHEREAS, after hearing the testimony and reviewing the
evidence presented, the Board deemed it advisable to continue said
hearing to September 23, 1987 , at 9 : 00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to show
cause for revocation of Amended Special Use Permit #345 , issued to
MS Corporation, be, and hereby is, continued to September 23,
1987 , at 9: 00 a .m.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
June, A.D. , 1987.

RE: HEARING TO SHOW CAUSE FOR REVOCATION OF AMENDED SPECIAL USE PERMIT
#345 - MS CORPORATION
A public hearing was conducted on June 24, 1987, at 9:00 A.M., with the
following present:
Commissioner Gordon E. Lacy, Chairman
Commissioner C.W. Kirby, Pro-Tem
Commissioner Gene Brantner
Commissioner Jacqueline Johnson
Commissioner Frank Yamaguchi - Excused
Also present:

Planning Department representative, Keith Schuett
The following business was transacted:
I hereby certify that pursuant to a notice dated September 3, 1986, and
duly published September 25, 1986, in the Johnstown Breeze, a public
hearing was conducted to consider revocation of Amended Special Use
Permit #345 issued to MS Corporation. Keith Schuett, Planning
Department representative, said this property was reinspected by a
member of the Planning staff and Ray Mahaffie of the State Forest
Service. He said the inspection was made to determine the areas of the
green belt that are not suitable for planting due to ground water. Mr.
Schuett identified the three areas which they determined were not
suitable. Mike Miller, president of MS Corporation, came forward to
make comments and answer questions of the Board. Discussion followed
concerning planting of the trees. Mr. Miller said he will plant some
trees at this time, but if they do not survive, he will have to wait
until next year before he replants. After further discussion,
Commissioner Kirby moved that this hearing be continued to September
23, 1987, at 9:00 a.m. The motion was seconded by Commissioner
Brantner and carried unanimously.
This Certification was approved on the 29th day of June, 1987.

Re: MS Corp greenbelt SUP 345
Dear sirs,
I have planted the najority of the trees in the greenbelt described on the
plan submitted to your office. The section behind the Anderson property has not
been planted yet due to ongoing reclamation. The trees are on site and will be
planted as soon as reclamation of the swamp is completed this summer.
I would like to request a change in the placement of the greenbelt east
of the McNamara property. Jack McNamara farms the field where the greenbelt
is shown on the map. He cuts hay within 5 feet of the fence which would not
leave room for trees. I propose to plant trees along the north edge of the
field. This would accomplish the same effect as the other plan. If approve° I
could have these trees planted by 6-5-87. I have purchased enough trees to
provide for planting according to eitner plan but feel that the proposed change
would be a much simpler solution without consuming valuable field space.

ADDENDUM TO PLAN FOR PLANTING AND MAINTAINENCE OF GREENBELT
To: Weld County Commissioners From: MS Corp
Re: SUP 345
1 . Reclamation of phase 10: The south boundry of phase 10
will be filled and covered with topsoil in preparation for
planting by November 31 , 1987
2. Planting of remaining trees: The trees necessary for
completion of the greenbelt in Phases 9, 10, 12 will be
planted by June 1 , 1988
3. Maintainence of greenbelt: MS Corp has purchased a water
tank for the purpose of providing water to the new trees and
greenbelt area. MS Corp will till the greenbelt area in the
spring of 1988 and plant native grasses in the area with the
intent of controlling the weeds. MS Corp has located a
tractor and tools small enough to maintain the greenbelt
without damaging the trees. The grass will be planted by June
1 , 1988. MS Corp will purchase 100 extra trees for the
purpose of replacement of trees that die after planting and
replace dead trees as necessary during the summer.
4. Maintainence of signs: MS Corp has ordered 100 new No
Trespassing signs. A man will be assigned to check the
placement of the signs weekly and replace the signs as
necessary. The new signs will be placed on the inside of the
fence. This assignment will begin with the arrival of the new
signs on November 31 , 1987.
5. MS Corp will notify a representative of the planning
department of the completion of each phase of this plan and
request that they verify the completion of each proposed
phase. This notification will come prior to or on the day of
completion as stated above.
6. MS Corp understands the importance of completing this
final stage of permit requirements and hereby states its
commitment to completing this plan as outlined above.

INSPECTOR'S REPORT
NAME: Amended Special Use Permit f345 - MS Corporation
DATE: June 16, 1987 TIME: 10:00 a.m.
CASE NUMBER: ZCH-25:86:5
The property was reinspected with the aide of Mr. Ray Mahaffie of the
Colorado Forest Service. The purpose of this inspection was to determine
the areas of the green belt that are not suitable for planting due to ground
water.
Three areas were identified as not being suitable for planting. The first
area is approximately 30' wide, just west of the primary access road and
directly north of the CMP used for runoff from the south side.of the road.
Additionally the area just east of this location to the gate is only
suitable for the planting of one row of trees. -
The second area is located on the southern boundary of Phase X. This area
will be suitable for planting when the reclamation of the area is completed.
The third area is a 20' strip located in the center of the southern boundary
of Phase IX. This area will only support one row of trees.
