Dunn The following lusiness was transacted: I hereby certify that pursuant to a notice dated December F6, 1985, and duly published December 19, 1985, in the Johnstown Breeze, a public hearing-was _conducted to consider the application of Allan -W. Smith for a Change of Zone from R-1 (Low Density Residential) to A (Agricultural) . Lee D. Morrison, Assistant County -Attorney, made this matter of record. Gloria -Dunn, Planning Department representative, read the favorable recommendation of the Planning Commission Into the record. 8'haron Marsden, realtor _representing the applicant, _came for-ward to answer questions of the Board. F.V. Straight and Jahn Duell, adjacent property owners, came forward in favor of this application. After discussion, Commissioner Brantner, moved to approve this request for a Change of Zone, lased upon -the recommendation of the Planning Commission and subject to the condition as recommended. Seconded by Commissioner Kirby, the motion _carried unanimously. The request of -Allan W. Smith for the Resubdiviaion of Part of Lots 1, 2 and 8, Union Colony Subdivision in the SE} SEA , Section 10, Township 5 North, Range 65 l4est was considered at this time. Ms. _Dunn read the favorable recommendation of the Planning -Commission into the record. She said three Conditions were recommended in conjunction with this request, and the first Condition has been satisfied. Mr. Morrison asked about the potential vacation of the -road right—of-way to the south mf the proposed Lot 4. Mr. Straight came forward and made comments regarding this right-of-way. Wes Potter, Health Department representative, spoke about the problems encountered with -septic systems on smaller lots like those -proposed. He stated that the Health Department's currant policy is that two lots may not -share one system. Following discussion, Commissioner Kirby moved to approve the Resubdiviaion as requested by Allan W. Smith, based upon the recommendation of the Planning _Commission. The building on the property was intended to be used for a hatchery-nursery, but the species with which one is working would have a lot to do with how the building is used.
