HomeMy WebLinkAbout861433.tiff HEARING CERTIFICATION DOCKET NO. 86-70 RE: SERVICE PLAN - PINE LAKE SANITATION DISTRICT A public hearing was conducted on November 12, 1986, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Cordon E. Lacy, Pro-Tem Commissioner Gene Brantner Commissioner C.W. Kirby Commissiorcn Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney. Lee D. Morrison Planning Department representative, Debbie de Besche The following business was transacted: I hereby certify that pursuant to a notice dated October 20, 1986, and duly published October 23 and 30, and November 6, 1986, in the Johnstown Breeze, a public hearing was conducted to consider the Service Plan submitted by the proposed Pine Lake Sanitation District. Lee Morrison, Assistant County Attorney, made this matter of record. Debbie de Besche, Planning Department representative, read the Planning Commission recommendation to the Colorado Board of Health for denial of this application. Thomas Hellerich, Attorney for the proposed Pine Lake Sanitation District, came forward to make his presentation. He called to the board's attention the fact that the Planning, staff recommendation was for approval of the Service Plan. He reviewed the history of the property involved and the application materials, along with the criteria to be considered. \ern Nelson. Engineer for this project, also made a presentation. He said that this proposed district is unique in that the owners intend to pay the cost into the district and will be reimbursed as development is completed, making a debt-free district. (Tape Change #86-75) Donald Carlscn, an owner of the property, stated that the value of the land is greater than the coat of the treatment facility, thus securing the debt. Commissioner Kirby asked about the level of financial security with a one-owner district. Don Warden, Director of Finance and Administration, spoke about the problems of a one-owner district. Mr. Warden said he has presented the Board with a letter outlining his concerns about the financial Leasibility of this proposed district. Considerable discussion sae held, revolving around the financing for this project. During the discussion, Pat Carlson, co-owner of the property involved, stated that she was unaware of a request for financial statements or an appraisal of the property, ana presented an appraisal document, with the request that the information contained therein be treated in a confidential manner. Commissioner Lacy moved to continue this matter to Monday December 1 , 1986, at 10:00 a.m. , to allow the Carlsons to submit financial documents to the Board prior to that bearing date . The caution was seconded by Commissioner Kirby. It vas stated that the documents to he submitted include a financial statement from thew Carlsons, prepared by a C.P.A, with a loan commitment from a lend:Lnt institution being desirable . Hal Walston„ general partner with the Carlsons, stated that he has no objections to presenting a financla: statement.
