HomeMy WebLinkAbout860522 RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 877 - ALLEN M. AND BERNICE A. WALSO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land , to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 877 , does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 877 was submitted by Allen M. and Bernice A. Walso for property which is located in part of the N1 NWa , Section 36 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 13 acres and 2 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is , exempt from the definition of the terms , "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. Walso. The parcel of land on which this request is being made is described as part of the Ni NWI; of Section 36, T5N, R65W of the 6th P.M. , Weld County, Colorado. The property is located approximately 3.25 miles southwest of Kersey on Weld County Road 47. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 12.674 acres and 2 acres, more or less. The applicants wish to retain the larger parcel and maintain its present use and sell the smaller parcel for residential use. Both proposed lots will have access and adequate frontage from Weld County Road 47. The existing parcel is dryland pasture. Two dwellings are located on the 14.67 acres. This property is part of an 80 acre parcel which was split by the Walsos using the recorded exemption procedure. RE-489 was approved in February, 1981, allowing the applicants to divide and sell 64.8 acres of farmland from the subject site. The two residences were existing on the 14.674 acre lot in 1981; therefore, the granting of RE-489 created the potential for an additional building site on 64.8 acre parcel. A new building site is now being requested by the applicant at this location. An old dairy barn occupies the 2 acres in question, and the land is idle. According to the applicants, a family member wishes to build a residence on the proposed 2 acre lot. The Walsos presently occupy one dwelling on the site, and the existing second dwelling would be used as a rental. - 86O522 Board of County Commissioners May 28, 1986 -Page 2 The County Health Department reviewed the application materials and has no objection to the request. The Department of Planning Services staff reviewed the Walsos' proposal on May 20, 1986, and has concerns for approving a request to resubdivide the original 80 acre parcel. A 2 acre residential site would be created by the Exemption in a location not designated within a future town growth area. Further, the applicant has not adequately addressed in the submitted application materials that the proposed land use will be consistent with the intent of the Agricultural Zone district and consistent with efficient and orderly development. The staff requests that the Board of County Commissioners consider this recorded exemption application and determine if the standards of Section 9-2 E. (1) (a) through (m) have been met.
