WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board has been presented with an Agreement for paving a certain portion of Weld County Road 21 with Thomas J. Coughlin, and Frontier Materials , Inc. , and WHEREAS, after study and review, the Board deems it advisable to approve said Agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for paving a certain portion of Weld County Road 21 with Thomas J. Coughlin and Frontier Materials, Inc. , be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said Agreement. AGREEMENT FOR PAVING OF WELD COUNTY ROAD 21 • THIS AGREEMENT, made and entered into this 23rd day of November , 19 88 , by and between WELD COUNTY, COLORADO, by and through the Board of County Commissioners of Weld County, Colorado, 915 Tenth Street, Greeley, Colorado 80631 , and hereinafter referred to as "County, " THOMAS J. COUGHLIN, 2995 Weld County Road 21, Fort Lupton, Colorado 80621, hereinafter referred to as "Coughlin, " and FRONTIER MATERIALS, INC. , 3600 Highway 52, Erie, Colorado 80516 , hereinafter referred to as "Frontier. " WITNESSETH: WHEREAS, Coughlin desires to pave Weld County Road 21, from its intersection with Weld County Road 8 south approximately one-quarter of a mile, and WHEREAS, County has no objection to Coughlin' s paving said portion of WCR 21 , as long as said paving complies with all County' s standards and specifications for asphalt pavement, and WHEREAS, Coughlin has contracted with Frontier to pave said portion of Weld County Road 21. NOW THEREFORE,- in consideration of the mutual promises and covenants contained herein, the parties hereto agree as follows: 1 . Coughlin agrees to pay all costs incurred by Frontier in the paving of Weld County Road 21 , from its intersection with Weld County Road 8 south approximately one-quarter of a mile. 2 . County agrees to prepare base course for said paving and to allow Frontier' s paving of said portion of Weld County Road 21. 3 . Frontier agrees to pave said portion of Weld County Road 21 with two (2) inches of asphalt, twenty-four (24) feet in width, as per the standards and specifications set forth by the Weld County Engineering Department. 4 . Frontier agrees to guarantee that said paving is free from all defects in workmanship and materials . Frontier agrees to r 881118 Page 1 of 3 Pages Us promptly replace the materials or re-execute said paving in accordance with the specifications as set forth by the Weld County Engineering Department and without expense to County if said paving becomes defective within one (1) year after its date of completion. 5 . Frontier agrees to provide all signing, barricading, and flag persons , in accordance with the Manual on Uniform Traffic Control Devices. 6 . Frontier shall obtain such insurance policies that will protect Coughlin, Frontier, and County from damages and/or injuries resulting from any accident which may occur in connection with the paving as contemplated herein. Said. insurance policies must be evidenced by Certificates of Insurance in the amounts set forth below: a. Statutory Workmen ' s Compensation. b. Contractor' s Public Liability and Property Damage: Bodily Injury: Each Person $150 ,000 .00 Each Accident $400 ,000 .00 Property Damage: Each Accident $150 ,000 .00 Aggregate $400 , 000 . 00 c. Coughlin of Fort Lupton for permission (to pave Weld County Roads 8 and 21 ; and for the installation of traffic control devices at the intersection of Weld County Roads 8 and 21 , and WHEREAS , the Board deems it advisable to refer said request to the Engineering Deparment for its recommendation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Thomas J. Coughlin for permission to pave Weld County Roads 8 and 21 ; and • for the installation of traffic control devices at the - intersection of Weld County Roads 8 and 21 , be and hereby is, referred to the Engineering Department for its recommendation.
