HomeMy WebLinkAbout850592.tiff RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN AGRICULTURAL RECREATIONAL FACILITY - JAMES AND NORMA CHITTENDEN WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 17th day of April, 1985 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of James and Norma Chittenden, 25469 Weld County Road 50 , Kersey, Colorado 80644 , for a Use by Special Review for an agricultural recreational facility on the following described real estate, to-wit: Part of the SE4, Section 32 , Township 5 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4.2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interest of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. f; � _ PL0945 / : J% /, .! Operation Standards prepared by staff provide compatibility with the existing surrounding land uses as well as with the future development of the surrounding area. d. No overlay districts affect the site. e. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for James and Norma Chittenden on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . No building or electrical permits shall be issued for the Use by Special Review Permit area until the Standards for the Use by Special Review have been placed on the Use by Special Review plat and the plat has been delivered to the Department of Planning Services office. 3 . Within thirty days from the date of approval by the Board of County Commissioners the applicants shall improve the common access from Weld County Road 50 to the applicants residence. Improvements shall consist of laying a gravel base a minimum of two inches in thickness. The gravel base shall be a Class VI aggregate base course. 4 . Within thirty days from the date of approval by the Board of County Commissioners the applicants shall submit evidence stating that they have received approval from the Weld County Board of Health for the sewage disposal system associated with the recreational facilities. 5 . The applicant shall supply the Department of Planning Services with written information on how persons living in the proposed home will be engaged in the operation of the Use by Special Review activities. A three component hand sink with hot and cold running water and an easily cleanable surface counter shall be installed at the Use by Special Review subject site within thirty days from the date of approval by the Board of County Commissioners. The uses permitted shall be an Agricultural Recreational Facility as described in the application materials on file in the office of the Department of Planning Services and subject to the Operation Standards below. 2 . The maximum number of people allowed on the subject site at any one time shall be two hundred (200) . 3 . A three component sink with hot and cold running water and an easily cleanable surface counter shall be installed at the subject Use by Special Review site. 4 . Licensed security personnel shall be retained for dances, birthday parties, family reunions , weddings , hayrides, indoor or outdoor parties for all occasions , where the number of people is in excess of 25 and where alcohol or beer is present. In no instance shall the uses herein listed be open to the general public. The operator shall require a written agreement with the sponsor of each of the hereinabove listed uses. 5 . Hours of operation shall be limited to 8 :00 a.m. to 10 :00 p.m. Sundays through Thursdays and 8 : 00 a.m. to 12 :00 midnight Fridays and Saturdays. 6 . An identification sign shall be placed at the entrance to the subject site. The sign shall be made of wood. It shall not exceed sixteen (16) square feet in area. The sign shall clearly identify the route to the subject Use by Special Review site. A light shall be placed above or below the sign so as to sufficiently illuminate the sign. 7 . The applicant shall maintain the gravel easement from Weld County Road 50 to the applicants ' residence. The gravel base shall be a minimum of two inches in thickness. The gravel base shall be a Class VI aggregate base course. 8 . The applicant shall maintain a dust abatement program on the access road from Weld County Road 50 to the applicants ' residence . Asphaltic emulsion, waste oil or commercially available chemicals may be used to control dust. The applicant is responsible for using materials and methods not inconsistent with any federal, state or local law, rules or regulations pertaining to hazardous materials , health or environmental protection. 9 . All activities shall be be limited to the subject property, the access easement and public highways. 10. The Use by Special Review Permit shall not be transferable to any successors in interest to the described property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. 11 . All litter shall be contained on the Use by Special Review subject site. All litter associated with the Use by Special Review shall be picked up daily. 12 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. 13. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 et seq. , of the Weld County Zoning Ordinance. 14 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 15 . The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET NO. 85-13 RE: USE BY SPECIAL REVIEW FOR AGRICULTURAL RECREATIONAL FACILITY - JAMES AND NORMA CHITTENDEN A public hearing was conducted on April 17, 1985, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gene Brantner, Pro-Tem Commissioner C.W. Kirby Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated March 13, 1985, and duly published March 14, 1985, in the La Salle Leader, a public hearing was conducted to consider the request of James and Norma Chittenden for a Use by Special Review for an Agricultural Recreational Facility. Lee Morrison, Assistant County Attorney, made this matter of record and noted that this hearing had been continued from March 27, 1985, for further review of the Operation Standards. At this point, Chairman Johnson reminded the audience that the testimony heard at the previous hearing is a matter of record and any further testimony given must pertain to the Operation Standards as presented today. She said each Operation Standard which is considered today will be reviewed separately. Rod Allison, Planning Department representative, read the Operation Standards and the proposed alternatives into the record. The Board discussed and acted on the Operation Standards as follows: Standard #2 - Commissioner Lacy moved that Operation Standard #2 shall read, "The maximum number of people allowed on the subject site at any one time shall be two hundred." Commissioner Kirby seconded the motion which carried unanimously. Standard #3 - Commissioner Lacy moved that Operation Standard #3 shall read, "A three component sink with hot and cold running water and an easily cleanable surface counter shall be installed at the subject Use by Special Review site." The motion was seconded by Commissioner Kirby, and on a roll call vote, it carried unanimously. Standard #4 - Commissioner Lacy moved that Operation Standard #4 read, "Licensed security personnel shall be retained for dances, birthday parties, family reunions, weddings, hayrides, indoor or outdoor parties for all occasions, where the number of people is in excess of 25 and where alcohol or beer is present. Commissioner Kirby seconded the motion. Commissioner Brantner said he felt 25 people is too low a number for the requirement of security personnel. Following a roll call vote, the motion carried by a four to one vote, with Commissioner Brantner voting nay. Standard #5 - Commissioner Lacy moved that Operation Standard #5 shall read, "Hours of operation shall be limited to 8:00 a.m. to 10:00 p.m. Sundays through Thursdays and 8:00 a.m. to 12:00 midnight Fridays and Saturdays." Commissioner Brantner seconded the motion and it carried unanimously. Standard #7 - Commissioner Lacy moved that Operation Standard #7 is to read, "The applicant shall maintain the gravel easement from Weld County Road 50 to the applicants residence. The gravel base shall be a minimum of two inches in thickness." Commissioner Brantner seconded the motion. Commissioner Kirby requested that the motion be amended to include the words, "The gravel base shall be a Class VI aggregate base course." Commissioners Lacy Page 2 RE: CERTIFICATION FOR USR - CHITTENDEN and Brantner were agreeable to the amendment. The amended motion carried unanimously. Standard #9 - Commissioner Kirby moved that Operation Standard #9 shall read, "All activities shall be limited to the subject property, the access easement and public highways." The motion was seconded by Commissioner Lacy and carried unanimously. Following the actions concerning the Operation Standards, the Board considered changes to the following conditions. Condition #3 - The Board agreed that Condition #3, concerning the maintenance of Weld County Road 50, shall be in accordance with Operation Standard #7. Condition #6 - Commissioner Lacy moved that Condition #6 shall read, "A three component hand sink with hot and cold running water and an easily cleanable surface counter shall be installed at the Use by Special Review subject site within 30 days from the date of approval by the Board of County Commissioners." Commissioner Brantner seconded the motion and it carried unanimously. The other conditions and Operation Standards are to remain the same. During this hearing, the following people who were opposed to this request came forward to make comments: Ken Spooner, Robert Boren and his attorney, Jim Gustafson, Ron Miller, Alfred Barber and Judy Stewart. James and Norma Chittenden, the applicants, and their attorney, Ron Lambden, also made comments. Robin Blair came forward to speak in favor of the request. Chairman Johnson briefly stated which conditions and Operation Standards were considered and adopted at this hearing. Commissioner Lacy moved to approve Use by Special Review for an Agricultural Recreational Facility for James and Norma Chittenden with six conditions and sixteen Operation Standards. Commissioner Brantner seconded the motion. The motion carried on a roll call vote with a vote of four ayes and Commissioner Yamaguchi voting nay. Dear Members of Planning Commission: The Horse-Around Stables is located approximately 1 /2 mile from the residence my husband , four children and I oc- cuppied from 10/16/76 until 11 /21/84. The address of that location is 24783 Weld Co. Road 53, Kersey, Colorado 80644. Thus. during our time at this residence we observed the founding and growth of Horse-Around Stables. We have been at the Chittendens on many occasions and have observed clean facilities, well managed and cared for horses and a safe wholesome atmosphere. During the time we were Chittenden 's neighbors we were not aware of any problems associated with Horse-Around Stables. We were never bothered by dust , noise or their horses, as evidenced by: 1 . My daughter and I often took walks where their horses had been and were not aware of any unusual amount of dust or horse manure. We spent much time out-of-doors and from the west of our property we viewed Chittendens and never noted a noise or dust problem. 3. Two to three times I remember other neighbors ' horses being loose in the field west of our prop- erty; such as late winter of 1984 when Robin Chit- tenden helped roundup more than three horses be- longing to the neighbor three houses south of ours. Chittenden 's horses were not a problem. As for the Chittenden 's integrity---we were blessed by them bringing food to us during times of illness, help- with transportation when we had a car problem, being guests at their home and recreation facilities for church and per- sonal visits and our children have been there for church youth activities. It is a First Class type operation run by people of high moral values. The large land area permits riders to enjoy horses in a safe area rather than along the county roads as we so frequently find people doing in other areas. Having the ability to rent a horse to ride permits many young people to enjoy a horse without having to buy a horse and keep it in an area of greater population density. Horses in high population areas are sometimes objectionable because of fly problems at nearby homes. Many church groups and other organized and/or unorganized groups of people have hay rides, barbecues , and parties away from the cities of the county. The laughter and joy of such groups surely would not be greater than that of a ball game at a City Park. They have spent considerable time, effort, and money to bring the property up to its present standards. They now provide outstanding facilities for pure, wholesome entertainment for people of all age groups and from all walks of life. They have been particularly cooperative in accomodating groups of "exceptional" children and handicapped individuals. The enjoyment these groups have received from barbeques, riding horses, hay rack rides, and even just watching the various animals has been heartwarming to observe. I have personally witnessed this on numerous occassions. In view of the area service and community services that Jim and Norma Chittenden are providing, I strongly recommend you consider a favorable decision on their behalf. I feel that it is a shame that anyone would want to see the Horse Around Stables closed. It is one of the very few places around that a family can go to have fun altogether. I have always found the atmosphere to be friendly, clean, neat, and above all safe. Being a horse lover, I have rented horses to ride out there several times. Even though I go there often and know of the rules, they are considerate enough of their neighbors to each and every time stress the importance of staying off mthers property. I, and I know of others who go there, under- stand that this is Jim and Norma's home and neighbors. With that respect we are careful not to disrupt that. Jim and Norma Chittenden not only run a family stable, but they also con- tribute a great deal to the community. Such as fund raising, Cub Scotts, ect. I don't know of too many people who would open up their home for the purpose of helping others. But to Jim and Norma it is only giving back to the community they very much care about. I hope you realize that it would be a great injustice to close such a nice and respectable place as the Horse Around Stables. And it would be a great dissappointment to see one of the last places, a family can go to have fun together, close. Box 86 Greeley, CO 80632 Dear Milt: I have reviewed the Weld Co. referral for an application from James and Norma Chittenden for a Use by Special Review Permit for Agricultural Recreation Facilities to be located in part of the SEk of Section 37, T5N, R64W of the 6th P.M. , Weld County, Colorado; 2.5 miles southwest of Kersy, north of WCR 50 and east of WCR 51 . The request is for approval of an application to have a business related to horse rides, hayrides and barn parties. Not mentioned in the application state- ments but shown on the vacinity map is a proposed building site. The request area is made up of two soil types. One is map unit 38-Nelson fine sandy loam, 3-9% slopes and map unit 73-Vona loamy sand, 3-5% slopes. Both soils are compatible for planned recreational use except for the Vona soil having a moderate rating for camp areas, play grounds, path and trails due to being sandy and dusty. For septic tank absorption fields, the Nelson soil has a severe rat- ing because of depth to rock, in this case sandstone. Soft sandstone may be found at 28 inches below surface. I recommend that an on site percolation test be made at potential septic tank leach field locations to determine if it will function properly. Moderate to severe rating is given to dwellings without base- ments and dwellings with basements respectively due to sandstone influence. Usually, the sandstone is soft enough it can be dug with adequate machinery but may increase the cost of construction. No mention was made as to the type of dwelling being considered. The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2. No building or electrical permits shall be issued for the Use by Special Review Permit area until the Standards for the Use by Special Review have been placed on the Use by Special Review plat and the plat has been delivered to the Department of Planning Services office. 3. Within thirty (30) days from the date of approval by the Board of County Commissioners the applicants shall improve the common access from Weld County Road 50 to the applicants residence. Improvements shall consist of laying a gravel base a minimum of two inches (211) in thickness. 4. Within thirty (30) days from the date of approval by the Board of County Commissioners the applicants shall submit evidence stating that they have received approval from the Weld County Board of Health for the sewage disposal system associated with the recreational facilities. 5. Prior to scheduling the case before the Board of County Commissioners the applicant shall supply the Department of Planning Services with written information on how persons living in the proposed home will be engaged in the operation of the Use by Special Review activities. 6. a. A hand sink as recommended by the Weld County Health Department in a memorandum dated March 20, 1985 shall be installed at the Use by Special Review subject site within 30 days from the date of approval by the Board of County Commissioners. 6. b. The uses permitted shall be an Agricultural Recreational Facility as described in the application materials on file in the office of the Department of Planning Services and subject to the Operation Standards below. 2. a. The maximum number of people allowed on the subject site at any one time shall be four hundred (400) . b. The maximum number of people allowed on the subject site at any one time shall be two hundred (200) . c. The maximum number of people allowed on the subject site at any one time shall be one hundred (100) . 3. a. A license shall be obtained from the Weld county Health Department if food preparation, handling or storage is conducted on the subject site in conjunction with the Use by S ecial Review Activity. b. AAhand sink with hot and cold running water and an easily cleanable surface counter shall be installed at the subject use by special review site. c. A license shall be obtained from the Weld County Health Department if the applicant or authorized personnel prepare, handle or store food on the subject site in conjunction with the Use by Special Review acitivity. 4. a. No alcohol or beer shall be distributed on the subject site in conjunction with the Use by Special Review activities without obtaining the proper beer or liquor licenses. b. No alcohol or beer shall be distributed on the subject site in conjunction with the Use by Special Review activities. c. Licensed security personal shall be retained for any event involving alcohol on the subject site in conjunction with the Use by Special Review activities. d. Licensed security personnel shall he retained for any and all Use by Special Review activities when alcohol is distributed on the subject site and there are more than 75 people on the site. Hours of operation shall be limited to 8:00 a.m. to 10:00 p.m. Sundays through Thursdays and 8:00 a.m. to 12:00 midnight Fridays and Saturdays. b. Hours of the operation shall be limited to 8:00 a.m. to 8:00 p.m. Sunday through Thursdays and 8:00 a.m. to 12:00 midnight Fridays and Saturdays. c. Pours of operation shall be limited to 8:00 a.m. to 8:00 p.m. Sundays through Thursdays and 8:00 a.m. to 10:00 p.m. Friday and Saturdays. d. Hours of operation shall be limited to 8:00 a.m. to 10:00 p.m. 2Sunarough Thursdays, unless applicant provides a+4 ound neighboring properties. In such case, the hour of operation shall be increased to 8:00 a.m. to 12:00 midnight Sundays through Thursdays. The hours of operation on Fridays and Saturdays shall be 8:00 a.m. to 12:00 midnight. 6. An identification sign shall be placed at the entrance to the subject site. The sign shall be made of wood. It shall not exceed sixteen (16) square feet in area. The sign shall clearly identify the route to the subject Use by Special Review site. A light shall be place above or below the sign so as to sufficiently illuminate the sign. 7. a. The applicant shall maintain the gravel easement from Weld County Road 50 to the applicants residence. The gravel base shall be a minimum of two inches (2") in thickness. b. The applicant shall maintain the gravel easement from Weld County Road 50 to the applicants residence. The gravel base shall be a minimum of four inches (4") in thickness. c. The applicant shall maintain the easement access road with a blade and review with the neighbors other possible methods of stabilizing the roadway. 8. The applicant shall maintain a dust abatement program on the access road from Weld County Road 50 to the applicant's residence. Asphaltic emulsion, waste oil or commercially available chemicals may be used to control dust. The applicant is responsible for using materials and methods not inconsistent with any federal, state or local law, rules or regulations pertaining to hazardous materials, health or environmental protection. All activities after daylight hours (including hay rides and buggy rides) associated with the subject Use by Special Review request shall he confined to the subject site. b. All activities after daylight shall be be limited to the subject property, the access easement and public highways. c. The applicant shall comply with the lighting requirements of the Colorado Motor Vehicle Law for any horse drawn vehicle driven on a public road. 10. The Use by Special Review Permit shall not be transferable to any successors in interest to the described property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. 11. All litter shall be contained on the Use by Special Review subject site. All litter associated with the Use by Special Review shall be picked up daily. 12. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 13. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 14. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 15. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. COL ,. It is with great reluctance that we must oppose the Use by Special Review - Agricultural Recreational Facility for James and Norma Chittenden as it is now written. We are their closest neighbors. as our home is 50 feet from their property line, and approximately 250-300 feet from the barn and livestock area where most of the activity is held. Our driveway/lane is approximately 2000 feet long. 500-600 feet is shared by Robert & Mildred Boren, Jim & Norma Chitten- den, Keith & Pearl Delventhall, Ken & Belva Spooner, and us. The remaining 1,400 to 1,500 feet is shared by the Chittenden's and us alone. Yes, their business has caused some problems for us. The driveway/lane has increased traffic from vehicles, not only cus- tomers, but support vehicles as well ; and the horseback riders who go up and down it chop up the surface. The riders almost never ride on the sides, but generally down the middle, or on the roadbed surface. On some occasions party groups have assumed our place is the stable and have pulled en masse into our yard. When told they needed to go next door, they've backed up or turned around any place they felt like it, over our native grass, which is our lawn, and then proceeded on. The main thing we object to is the "Party Barn Atmosphere. " We do not want 200 unknown persons that close to our property drinking , carrying on, and driving up and our shared driveway. It is a dangerous situation, and as observed by us and other neighbors , sometimes the persons coming and going will do so at fairly high rates of speed, with little or no thought to anyone else's use of the road. We have not spoken out before , because we hated to be picky neighbors. We were hopeful that the Chittendens would see the existing problems and realize that it was something unacceptable to their neighbors. It was very hurtful at the last Planning Commission Hearing to be told we were all liars. As a neighborhood group we did have a meeting with the Chittendens consent and participation at the Platte Valley High School, February 21, 1985. Jim Chit- tenden stated the concerns were totally different at that meet- ing than the ones he was hearing at the Planning Commission F -2- Hearing March 5th. He also stated that he wished the tape which we made of that same February 21st meeting could be heard. He would be greatly surprised, because the concerns were exactly the same--the main ones being : alcohol , road problems , lighting for the hay wagon, trespassing, and noise. The tape is available for anyone to listen to at any time. It was also stated at both our meeting and the Hearing that it would cost $7 ,000 to gravel the road and that it would have to be done three times a year. We have since received bids from local Gravel Pit Companies in Greeley to gravel or surface the driveway/ lane from Weld County Road 50 to the Chittendens doorway. These bids were from $4,000 to $4,500. They were for pit run material (which is recommended for the site condition) at a 4 inch thick- ness (twice that suggested by tre Planning and Engineering Office) and would have to be done only once a year, perhaps two years , de- pending on conditions , to establish a strong roadbed. Copies of the bids are with this letter. Sgt. Kenneth W. Shiflet with the Colorado State Patrol has also been contacted and he advised us on the correct lighting for the hay wagon rides , if they must be out on the road. He stated being on the road at night was something they didn't recommend, and felt it was inadvisable to do so. He also said he would be glad to dis- cuss this matter with anyone who is interested. A copy of the reg- ulations is enclosed . We do hear the music-it vibrates our home , especially when they have live bands. People have trespassed on our property, not only in vehicles , but also on foot or horseback. People tend to think because our two places are so close together, they are one in the same . We know Jim and Norma feel like we are attacking them. We have been friends with and observed them for eight years, and they are good , hard working, caring people. They are Church members, and do many community service activities. School groups, church groups, Educationally Handicapped groups , Families, reunions , wedding recep- tions , etc . have used their facilities , and am sure there are other like groups that we don't know about. They all have come out and enjoyed horseback riding , hay rides, and a day in the country. We are not objecting to this type of use , within reason. But we are objecting to extremely large drinking groups--when their main purpose is to come out and drink and "let their hair down. " There is no immediate source of law enforcement and this poses a problem for all of us, as well as anyone else who comes in contact with the participants. We want to convey that we were not opposed to their business as long as they did not have the public dances and the drinking parties. However, since the Planning Commission Hearing , we are opposed to the whole aspect , as the Chittendens expressed a very negative attitude in wanting to work with the neighbors. They seem to feel that they have bent over backwards for all of us , but by actul count , those of us closely involved do not feel that way. We have been the last to know and the first ones to suffer from their business enlargements. Thank you for the opportunity to express our views. (2) Whenever a vehicle is parked or stopped upon a roadway or shoulder adjacent thereto, whether attended or unattended, during the hours between sunset and sunrise and•there is not sufficient light to reveal any person or object within a distance of one thousand feet upon such highway, such vehi- cle so parked or stopped shall be equipped with one or more operating lamps • meeting the following requirements: At least one lamp shall display a white or amber light visible from a distance of five hundred feet to the front of the vehicle, and the same lamp or at least one other lamp shall display a red light visible from a distance of five hundred feet to the rear of the vehicle, and the location of said lamp or lamps shall always be such that at least one lamp or combination of lamps meeting the requirements of this section is installed as near as practicable to the side of the vehicle which is closest to passing traffic. The foregoing provisions shall not apply to a motor-driven cycle. (3) Any lighted head lamps upon a parked vehicle shall be depressed or dimmed. (5) (a) Every combination of farm tractor and towed farm equipment or towed implement of husbandry equipped with an electric lighting system shall at all times mentioned in section 42-4-203 be equipped with lamps as follows: (1) The farm tractor element of every such combination shall be equipped as required in subsection (4)of this section. • (11) The towed unit of farm equipment or implement of husbandry ele- ment of such combination shall be equipped with two red lamps visible from a distance of not less than five hundred feet to the rear or, as an alternative, two red reflectors visible from all distances within six hundred feet to the rear when directly in front of lawful upper beams of head lamps. (b) Said combinations shall also be equipped with a lamp displaying a white or amber light, or any shade of color between white and amber, visible from a distance of not less than five hundred feet to the front and a lamp displaying a red light visible when lighted from a distance of not less than • five hundred feet to the rear. (6) The lamps and reflectors required in this section shall be so positioned as to show from front and rear as nearly as practicable the extreme projection . 42-4-211 Vehicles and Traffic 194 of the vehicle carrying them on the side of the roadway used in passing such vehicle. The hay rack rides usually take place at night and safety precautions are taken for the participants and the animals. They have ridden on the ditch company right-of-way. They were not aware the ditch company was not in favor of this and since they have discovered this they have stopped using it. The horses are ridden on the road when they are rented out. There are no regularly scheduled events. Hay rack rides, dances, etc. , are scheduled only when somebody calls and schedules them. Weld County Road 50 is used for the hay rack rides and horse back riding. F Summary of the Weld County Planning Commission Meeting March 5, 1985 Page 2 The Chairman asked Mr. Chittenden if he had reviewed the recommendations, conditions, and operation standards, as outlined by the Department of Planning Services staff. He stated he had and he is in opposition to keeping two inches of gravel on the road and the ten o'clock curfew on week nights. The parties are always promply shut-off at midnight. The building in which the bands play has a dirt floor and is fully insulated to cut-down the sound. They do not handle food. If food is served it is either catered or brought in "potluck style" by the people who rent the facilities. There is no liquor served by the applicants, nor has there been any fights or trouble at any of their parties. Tape 194 - Side 2 The Chairman called for discussion from the audience. Dan Rula, surrounding property owner, reported that while he can sometimes hear the music, he really has no objections to this operation. Jim Gustafson, Attorney, represented Mr. and Mrs. Robert Boren, adjacent property owners. He stated the easement between the Borens and the Chittendens was created by an agreement with a previous owner. His clients have no opposition to the right-of-way as created, but they do not want the use expanded to this extent. Because of the dust problem created by the traffic they do agree that a gravel base should be laid. There is also a problem with the traffic from the horses and wagons and the possibility of a serious accident. There have been reports about liquor and beer being served at the parties as well as keg parties taking place and beer being served to minors. Ken Spooner, surrounding property owner, reported he can hear the music and he cannot see the wagons after dark. Therefore, he worries about running into the wagons, horses, or participants of these parties. He is concerned about the environment, neighborhood, and safety of the area residents. The road base is very fragile and he agrees there should be a gravel base to cut-down on dust to slow down the traffic. Lee Morrison reviewed traffic regulations regarding traffic lights and one-half inch reflective tape. Also, a gathering of less than five hundred does not require a permit. The Chairman asked James Mayerl to read the recommendations, conditions, and operation standards as outlined by the Department of Planning Services staff into the record. Summary of the Weld County Planning Commission March 5, 1985 Page 3 Operation Standard #4 was amended by the staff to read as follows: "No alcohol or beer shall be distributed on the subject site in conjunction with the Use by Special Review activities without obtaining the proper beer or liquor licenses." Tape 195 - Side - 1 Wes Potter, Weld County Health Department, reported the septic permit has been applied for. This is an application for an existing system as the septic system was put in without a permit. An engineer will have to check this system and either approve or deny it. When the Chittendens applied for the septic permit they indicated there would be a maximum of two hundred people present at any one gathering. At today's hearing he hears four hundred is the maximum and they have been advertising that they are capable of handling parties of four hundred. Therefore, before the permit can be issued it must be changed to correspond with the maximum number of participants that might be present at any one gathering. As far as the food goes, they are in a gray area. If it is a one time thing, i.e. , a club or church dinner, luncheon, etc. , then they do not need a permit, but if there is any food being prepared for participants of the parties, then they may be required to have a permit and handwashing facilities, etc. There are also electrical devices to check noise levels, but in the agricultural areas there are no state regulations regarding this. Virginia Stradley, surrounding property owner, reported they get most of the dust from the traffic and the noise. They have lived on their property since 1947 and since the Chittendens have begun the Horse Around Stables the traffic has increased considerably. After a party, the traffic is especially heavy after midnight and they are afraid. Also, the Farmer's Reservoir and Irrigation Company has posted signs many times, but these usually disappear in a few days. Mrs. Stradley displayed the sign the ditch company has posted. Lee Morrison asked that a note be made in the minutes the sign states: "No Trespassing by Order of Farmer's Reservoir and Irrigation Company." The sign has red printing on a white background. The sign was not kept for evidence. His brother does work on the recycling projects year around. They do keep the individual parts in groups and one of the operation standards recommended by the Department of Planning Services staff does say the parts must be kept out of sight, and they agree. They are asking that this business be put on a four acre site which includes the house and outbuildings. This should also take care of traffic parking on the road right-of-way.
