RE: APPROVE REQUEST OF FRANK CURTIS FOR RE-HEARING OF USE BY
SPECIAL REVIEW APPLICATION
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on March 31 , 1986 , the Board considered the
application of Frank Curtis for a Use by Special Review for
expansion of an existing poultry operation, and
WHEREAS, after due consideration, the Board denied said
request, and
WHEREAS, Thomas Hellerich, attorney representing Frank
Curtis , has submitted a request that the Board of County
Commissioners consider re-hearing the application for a Use by
Special Review, explaining the changes which have been made to the
original application, and
WHEREAS, after review, the Board determined that substantial
changes have been made to the original application and, therefore,
deems it appropriate to grant the request for re-hearing of said
Use by Special Review application, and that this application be
referred to the Planning Commission for its re-consideration.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that, because of the
substantial changes to the original application, the request to
re-hear the Use by Special Review application of Frank Curtis be,
and hereby is , granted.
BE IT FURTHER RESOLVED by the Board that this matter shall be
referred back to the Planning Commission for its re-consideration.

Dear Ms. Johnson:
As you are -aware, our office represents Mr. Frank Curtis concerning his
application for Use by Special Review for expansion of an existing
poultry operation. Mr. Curtis' application consisted of Tour different
phases: Phase 1 being the approval of s 1,400 square loot addition to
an existing building, which addition has previously been constructed;
Phase II being the construction of a feed mill; Phase III being the
construction of a building for -handling and processing of manure; and
Phase IV being the construction of a building for housing of an
additional 6,000 chicks. At the time of the most recent hearing on
March 31, 1986, Mr. Curtis withdrew Phase III from the application. As
you are aware, the Board of County -Commissioners then denied the balance
of Mr. Curtis' application.
In reviewing this matter with Mr. Curtis, he has -requested that I
contact the Board and request a re-hearing pursuant to the Weld County
Administrative Manual, under Section "General Administration," -page 2,
which provides for a request for re-hearing. Mr. Curtis desires a
re-hearing on Phases I and _II only, and would be withdrawing Phase IV
from the Use by Special Review application. Thus, Mr. Curtis would be
requesting approval for the addition of 1,400 square feet, and for the
approval of construction of a feed mill. Phase IV would likewise be
deleted. We believe this would constitute a substantial change in the
facts and circumstances of this application.
On behalf of Mr. Curtis, I would appreciate your -processing this letter
at the next appropriate meeting of the Board of County Commissioners, as

a request for re-hearing on Phases I and II only. I would appreciate
the County notifying our office of the Board's decision at the earliest
possible date. Your attention to this matter is appreciated.
