RESOLUTION
RE: APPROVE SPECIAL REVIEW PERMIT FOR A PRIVATE RECREATIONAL
FACILITY IN THE A (AGRICULTURAL) AND R-1 (LOW DENSITY
RESIDENTIAL) ZONE DISTRICTS - ROCKY MOUNTAIN SKI CLUB
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 7th day of October, 1987 , at the hour of 2 : 00 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Rocky Mountain Ski Club, c/o Richard and Sandra
Kobel and Rona Miner, 727 East 27th Street, Greeley, Colorado
80631 , for a Special Review permit for a private recreational
facility in the A (Agricultural) and R-1 (Low Density Residential)
Zone Districts on the following described real estate, to-wit:
Part of the SW* of Section 15 and part of the
SEi of Section 16 , both in Township 5 North,
Range 65 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, said applicant was represented by Richard Kobel, and
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons :
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4 .2 of the Weld County Zoning Ordinance as follows:
a. The proposed Special Review site is located within
the urban growth boundary areas of the City of
Greeley, City of Evans, and the Town of Garden
City. The location of the Special Review site and
the attached Conditions and Development Standards

make the proposed use consistent with the Weld
County Comprehensive Plan ' s Urban Growth Boundary
Goals 1 , 2 , and 3 .
1) Urban Growth Boundary Goal 1 states that urban
development should be concentrated in or
adjacent to existing municipalities . The
proposed recreational use is an acceptable use
in an urban growth boundary area and is
located adjacent to the City of Greeley.
2) Urban Growth Boundary Goal 2 states that
land-use regulations in urban growth boundary
areas should be maintained to allow the County
and municipalities to coordinate plans ,
policies , and standards relating to land-use,
zoning regulations , street and highway
construction, public infrastructure systems ,
and other closely related matters affecting
the orderly development of urban growth
boundary areas . The Town of Garden City and
the City of Evans have responded that they
have no objections to this request. The City
of Greeley has concerns regarding on-site
parking and dust abatement. These concerns
have been addressed in the Special Review
permit Development Standards .
3) Urban Growth Boundary Goal 3 states that urban
growth boundary areas should be maintained to
provide an official definition between future
urban and agricultural land uses . This
recreational use will be compatible with
future urban-type uses in this area. The City
of Greeley is currently providing sewer
service to the site . The City of Greeley has
no plans to provide water service to this
parcel . in the immediate future . In addition,
the lake portion of the site is located in a
100 year flood plain . Weld County' s
Comprehensive Plan Open Space Section
encourages sites in a flood plain to be
maintained as open space areas .
b. The proposal is consistent with the intent of the
Agricultural and R-1 (Low Density Residential) Zone
Districts in which the use would be located. The
proposed use as a private recreational facility is

provided for as a Use by Special Review in both
zone districts .
c. The proposed use which would be permitted will be
compatible with the existing surrounding land uses.
To the north of the proposed site is farm ground
and to the east of the parcel is the South Platte
River. Highway 34 borders the property on the
south and the KOA Campground is west of this site.
d. The lake portion of this site is in the 100 year
flood plain. Special Review Development Standards
address this matter.
e. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a private recreational facility in the A
(Agricultural) and R-1 (Low Density Residential) Zone Districts on
the hereinabove described parcel of land be , and hereby is ,
granted subject to the following conditions :
1 . The attached Development Standards for the Special
Review permit be adopted and placed on the Special
Review plat prior to recording the plat.
2 . The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat has been
delivered to the Department of Planning Services Office
and the plat is ready to be recorded in the office of
the Weld County Clerk and Recorder.
3 . The Special Review permit plan map shall be amended to
show:
a. The exclusion of Parcel A from the Special Review
site.
b. Designated parking areas for recreational vehicles
and other vehicles.
c. The proposed 2 ,500 square foot tri-level dwelling.

4 . The applicant shall submit additional information to
clarify the proposed uses of the 2 ,500 square foot
tri-level dwelling.
5 . Within 30 days of occupancy of the 2 ,500 square foot
tri-level dwelling, the mobile home shall be removed
from the site.
6 . The existing access to the site shall be abandoned and
made inaccessible and the access to the site shall be
moved approximately 200 feet to the west where there is
currently a double gate in the fence. Only this access
point shall be used for access to the site and to the
City of Greeley Sanitary Lift Station.
7. The applicant shall apply for and obtain an access
permit from the State of Colorado, Division of Highways ,
for the new access onto the site from U.S. Highway 34 .
8 . The applicant shall convey a 20 foot right-of-way to the
City of Greeley connecting the new access to the
existing 20 foot right-of-way owned by the City of
Greeley through the applicant' s property.
9 . The applicant shall submit evidence to the Department of
Planning Services that a legal source of water for the
commercial uses is available and will be used. Use of
lake water or domestic well water will not be allowed by
the Division of Water Resources . The applicant shall
supplement the application materials to show a source of
potable water for the showers.
10 . The existing sewage disposal vault shall be reviewed for
compliance by the Weld County Health Department and
shall be permitted as required by the Weld County
Individual Sewage Disposal System Regulations .
11 . Within 45 days of approval by the Board of County
Commissioners , the applicant shall submit a dust
abatement program approved by the Weld County Health
Department to the Department of Planning Services.

DEVELOPMENT STANDARDS

1 . The Special Review permit is for a private recreational
facility as submitted in the application materials on file in
the Department of Planning Services and subject to the
Development Standards stated herein.
2 . Water quality in the lake shall be monitored monthly during
the months of use to ensure compliance with Section 4 . 6 of
the State of Colorado, Regulations and Standards Governing
Swimming Pools, Swimming Areas. The results of such tests
shall be submitted to the Weld County Health Department by
the 30th of each month for their review.
3 . A sewage disposal vault approved by the Weld County Health
Department shall be used as the sewage disposal system for
the cement building by the lake . Portable toilets shall not
be allowed on the site.
4 . Any water used for showers shall be potable.
5 . A dust abatement program approved by the Weld County Health
Department shall be utilized by the owner/operator.
6 . On-site parking areas shall accommodate all visitors to the
facility. No parking shall be allowed on the frontage road
or at any point not on the Special Review site .
7 . Visitors and members visiting the site shall approach the
lake area of the site using the gravel road running east from
the new access point. The gravel road on the north edge of
the property running parallel to the ditch shall not be used
by visitors or members.
8 . The proposed 2 ,500 square foot tri-level dwelling shall be
used as a single-family dwelling only and shall not be used
for the commercial housing of guests.
9 . Removal of water from the lake for any sanitary or commercial
purposes is prohibited.
10 . A Flood Hazard Development Permit shall be approved by the
Department of Planning Services staff prior to the
construction of any new structures or the substantial
improvement of any existing structures in the flood plain.

11 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
12 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
13 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 of the
Weld County Zoning Ordinance.
14 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations .
15 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations . Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning, Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.
16 . The property owner or operator shall be responsible for
complying with all of the foregoing Standards. Noncompliance
with any of the foregoing Standards may be reason for
revocation of the Permit by the Board of County
Commissioners .

The following business was transacted:
I hereby certify that pursuant to a notice dated September 9, 1987, and
duly published September 24, 1987, in the Johnstown Breeze, a public
hearing was conducted to consider the application of Rocky Mountain Ski
Club for a Special Review permit for a private recreational facility in
the A (Agricultural) and R-1 (Low Density Residential) Zone Districts.
Chairman Lacy advised the representatives of the applicant that, only
four members of the Board being present, should this hearing result in
a tie vote, the absent member would review the record and listen to the
tape before casting the deciding vote. Lee Morrison, Assistant County
Attorney, made this matter of record. Brian Bingle, representing the
Planning Department, asked that the Planning Commission recommendation
concerning this matter be incorporated into the record of this hearing.
Richard Kobel came forward to represent the applicant. He stated for
the record that the proposed 2,500 square foot residence will not be
used for commercial purposes. He also stated that he saw no problem
with the 11 Conditions or the 16 Development Standards proposed by the
Planning Commission. No public testimony was offered concerning this
matter. Commissioner Brantner moved to approve this request for a
Special Review permit, based upon the Planning Commission's
recommendation and subject to the Conditions and Development Standards
contained therein. The motion was seconded by Commissioner Kirby and
carried unanimously.
This Certification was approved on the 12th day of October, 1987.

Dear Ms. Swanson:
We have reviewed the -above referenced proposal to use a 53.346-acre tract
for water skiing activities and -a grounds keeper' s house. There is an
existing house, mobile home, and well (permit no. 119124) on the property at
this time. The mobile home is to be replaced by the new grounds keeper' s
home. ,The well presently serves three single-family residences--the existing
house, motile home, and a house on an adjacent 1 .3 acres. The well permit was
issued as the only well on the 54.7 acres and amended to serve up to three
single-family dwellings.
The 'proposal states that up to 75 guests will be accommodated on the
property. At the present time, we have been told that water from the lake is
being pumped to be used in showers and toilets for the guests. It is unclear
where the legal source of water supply for this commercial use of water is.
Neither the domestic well nor the lake can be used without an augmentation
plan to serve the additional domestic water needs of these guests. We cannot
recommend approval of this proposal until the applicants obtain -a valid, legal
water supply for these proposed uses and the applicant can provide us with
additional information to show that it is adequate to meet the needs of guests
who will use this property.

Richard Kobel, partner, explained this project and the reasons they are
applying for a Special Review permit. This lake is an old gravel pit
project of which they had no interest. They are reclaiming this lake as a
Trivate recreation area for water skiing events.

The Chairman asked Mr. Kobel if he had reviewed the recommendations,
conditions, and Development Standards as presented by the Department of
Planning Services staff. He stated he has and is taking exception to the
recommendation concerning entry into the property.
Brian Bingle explained this is the direct result of a recommendation by the
Colorado Department of Highways.
Richard Kobel stated he will take this issue up with the Colorado Department
of Highways to see if their differences can be resolved.
Mr. Kobel also took exception to the recommendations of the Weld County
Health Department regarding testing of the lake water, not being able to use
portable toilets, removal of water from the lake for the showers and
toilets, and using potable water for the showers which are open air shows to
rinse of mud and sand.
Wes Potter of the Weld County Health Department, Environmental Health, was
called and asked to testify on these issues.
The Chairman called a break at 3:00 p.m. The meeting was reconvened at 3:05
p.m.
Wes Potter explained the reasons for these recommendations and the State
Statutes that governed others.
AMENDMENT:
Paulette Weaver moved Development Standard //2 be amended to read as follows:
2. Water quality in the lake shall be monitored monthly during
the months of use to ensure compliance with Section 4 .6 of
the State of Colorado, Regulations and Standards Governing
Swimming Pools, Swimming Areas. The results of such tests
shall be submitted to the Weld County Health Department by
the 30th of each month for their review.

- The proposed Special Review site is located within the
urban growth boundary areas of the City of Greeley, City
of Evans, and the Town of Garden City. The location of
the Special Review site and the attached conditions and
development standards make the proposed use consistent
with the Weld County Comprehensive Plan's Urban Growth
Boundary Goals 1, 2, and 3.
a. Urban Growth Boundary Goal 1 states that urban
development should be concentrated in or adjacent
to existing municipalities. The proposed

regulations in urban growth boundary areas should
be maintained to allow the County and
municipalities to coordinate plans, policies, and

infrastructure systems, and other closely related
matters affecting the orderly development of urban
growth boundary areas. The Town of Garden City and
the City of Evans have responded that they have no
objections to this request. The City of Greeley
has concerns regarding on-site parking and dust
abatement. These concerns have been addressed in
the Special Review permit development standards.
c. Urban Growth Boundary Goal 3 states that urban
growth boundary areas should be maintained to
provide an official definition between future urban
and agricultural land uses. This recreational use
will be compatible with future urban—type uses in
this area. The City of Greeley is currently
providing sewer service to the site. The City of
Greeley has no plans to provide water service to
this parcel in the immediate future. In addition,
the lake portion of the site is located in a 100
year flood plain. Weld County's Comprehensive Plan
Open Space Section encourages sites in a flood
plain to be maintained as open space areas.
- The proposal is consistent with the intent of the
Agricultural and R-1 (Low Density Residential) zone
districts in which the use would be located. The
proposed use as a private recreational facility is
provided for as a Use by Special Review in both zone
districts.
- The proposed use which would be permitted will be
compatible with the existing surrounding land uses . To
the north of the proposed site is farmground and to the
east of the parcel is the South Platte River. Highway
34 borders the property on the south and the KOA
Campground is west of this site.
- The lake portion of this site is in the 100 year flood
plain. Special Review Development Standards address
this matter.

- Special Review Development Standards will provide
adequate protection of the health, safety and welfare of
the neighborhood and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1 . The attached Development Standards for the Special Review permit
be adopted and placed on the Special Review plat prior to
recording the plat.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat has been delivered to the Department of Planning
Services' office and the plat is ready to be recorded in the
office of the Weld County Clerk and Recorder.
3. The Special Review permit plan map shall be amended to show:
- The exclusion of Parcel A from the Special Review site.
- Designated parking areas for recreational vehicles and
other vehicles.
- The proposed 2,500 square foot tri-level dwelling.
4 . Prior to being heard by the Board of County Commissioners, the
applicant shall submit additional information to clarify the
proposed uses of the 2,500 square foot tri-level dwelling.
5. Within 30 days of occupancy of the 2,500 square foot tri-level
dwelling, the mobile home shall be removed from the site.
6. The existing access to the site shall be abandoned and made
inaccessible and the access to the site shall be moved
approximately 200 feet to the west where there is currently a
double gate in the fence. Only this access point shall be used
for access to the site and to the City of Greeley Sanitary Lift
Station.
7. The applicant shall apply for and obtain an access permit from the
State of Colorado, Division of Highways, for the new access onto
the site from U.S. Highway 34.

1. The Special Review permit is for a private recreational facility as
submitted in the application materials on file in the Department of
Planning Services and subject to the Development Standards stated
hereon.
2. Water quality in the lake -shall be monitored monthly to ensure
compliance with Section 4 .6 of the State of Colorado,
-Regulations and Standards Governing Swimming Pools, Swimming Areas.
The results of such tests shall be submitted to the Weld County Health
Department by the 30th of -each month for their review.
3. A sewage 'disposal vault approved by the Weld County Health Department
-shall be used as the sewage disposal system for the cement building by
the lake. Portable toilets shall not be allowed on the site.
4. -Any water used for showers shall be potable.
5. A dust abatement program approved by the Weld County Health Department
shall be utilized by the owner/operator.
6. On-site parking areas shall accommodate all visitors to the facility.
No parking -shall be allowed on the frontage road or at any point not on
the _Special -Review site.
7. Visitors and -members visiting the site shall -approach the lake area of
the site using the gravel road sunning east from the new access point.
The gravel road on the north edge of the property running parallel to
the ditch shall not be used by visitors or members.
8. The proposed 2,500 square foot tri-level dwelling shall be used as a
single-family dwelling only and shall not be used for the commercial
housing of guests.
9. Removal of water from the lake for any sanitary or commercialpurposes
is prohibited.
10. A Flood Hazard Development Permit shall be approved by the Department
of planning Services' staff prior to the -construction of any new
structures or the substantial improvement of any existing structures in
the flood plain.
11. All Construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.

12. The property -owner or operator shall be issponsible for complying with
the Design Standards of -Section 24.5 of the Weld County Zoning
Ordinance.
13. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
14. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any seasonable time in order to ensure the activities
carried out on the property comply with the Development Standards
stated hereon and all applicable Meld County Regulations.
15. The Special Review area shall be limited to the plans shown hereon and
{governed by the foregoing Standards and -all applicable Weld County
Regulations. Any material deviations from the plans or Standards as
-shown or stated shall require the approval of an amendment of the
Permit by the Weld _County Planning Commission and the Board of County
'Commissioners ±efore such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
16. The property owner or operator shall to responsible for -complying with
all of the foregoing Standards . Noncompliance with any of the
foregoing Standards may be reason for revocation of the Permit by the
Board of County Commissioners.

Dear Ms. Swanson:
We have reviewed the Kobel/Miner application for a Use by Special Review
for a recreational water skiing and guest dwelling facility. We have the
following comments on the application for this recreational use, which are
understand is already in operation.
Access to this facility and a City of Greeley pumping station is provided
by a gravel road which connects to the State Highway 34 Bypass frontage road.
This access was authorized on a temporary basis according to the -enclosed
copy of a March 16, 1981 letter from Dave Fraser, District 4 Maintenance
Superintendent. Access to this pumping station was also allowed by an April
13, 1978 letter from Albert Chotvacs, who at that time was the Assistant
District Engineer. The access location -addressed in Mr. Chotvac's letter
is the one which -exists ass double gate in the fence line and is located
approximately 200 Feet west of the one authorized in Mr. Fraser's letter.
In view of the aboveapprovals for two separate access points and the applica-
tion for this Use by Special Review, access to both interests needs to be
re-evaluated.
The access location approved in 1981 crosses the highway right of way
at a point which has deeded access-control. There is no designated access
opening at this location, and the "End of -Access" (E.D.A. ) control point
is -only about 150 feet west of this access. We understand that there have
been some problems with keeping the gate for this access locked, as required
by Mr. Eraser's letter.
In order to resolve the above concerns regarding the access control
line and use of this access, we propose the following:
1. The original access location approved in 1978 to the west of
the E.O.A. point should be used to serve the recreational facility
and the Greeley right of way which leads to the pumping station.
The existing sate in the fence directly north of the road connect-
ing to S.H. 34 Bypass could be used for this purpose.

2. An access easement should be provided by the property
owner to the City to connect the new acces-s to the right of
way leading to the pumping station.
3. An Access Permit should be obtained by the property owner for
the above shared access. The old -access would be closed, and
the connecting road within the highway right of way should
be eliminated. We would not require a gate for the new access.
4. The Access Permit would include the condition that when a public
street is opened northerly _from the proposed future interchange
on 3.H. 34, the access easement will connect to the street
and not directly to S.H. 34.
In our judgement, the above proposal would adequately serve the needs
of the recreational facility and the City of Greeley. This plan would result
in a single access at a location beyond our deeded access-control line where
there is an existing access, with a double gate, which is approximately shown
on the Rocky Mountain Ski Club Plot Plan.
In addition to the above access concerns, we also bring to your attention
that there is a discrepancy between the right of way line shown on the +lot
Plan and the one on our right of way plan map attached to Mr. Fraser's letter.
Proceeding eastward from the Kobel/Miner west property line, there is a difference
in the line in the vicinity of the City right of way extending to the north.
This discrepancy should be resolved prior to final action on this application.

Richard P. Kobel, Sandra N, Kobel and Rona L. Miner are the oweners
of a 55 acre parcel of land. This parcel consists of 30 acres of irragated
farm land and a 25 acre lake. The iragated portion of the property is being
farmed, The -lake is being used as a water sking pretice and tournment site.
A Use by Special Review for the -water sking activities and the
construction of a single family dwelling for the use of a grounds keeper
and guests is being applied for.
One 2500 sq. ft. Tri—Level home is being purposed to be constructed.
This will replace a mobile home which is on the site at this time. This
is the current resident for the grounds keeper. This new dweeling will
fetter serve the needs of the owners and improve the property value.
The water sking activities are the most pracitcal use of the lake area.
The surrounding properties are to the north irragated farm land.
To the east is the South Platte River. To the south is Highway 34 and
south or the highway is another lake. To the west is irragated farm land
and a overnight camping fussiness park.
Resdential structures are not within 3/3 of one mile in any direction
of this property.
The lake is being used by a group consisting of a membership of
11 members. _During the months of June, July and August their are water
sking tournments held on 5 weekend. The tournments are private and
have between 50 to 75 guest that -attend,
One resident groundkeeper's family is living full time on the
property,

The propertyhas an existing domestic water well.
Access is from the west end of the property via the frontage
road which is parallel to Highway 34.
Vehicular traffic will be passanger car, light trucks and RV type
vehicals. The majority of the time the frequency will be that of the
normalddaily traffic of a single family. During the time of a water eking
veent the traffine will be lighty moderate. The guests of the eking
event generally drive in and staythe weekend and leave at the end of
the event.
The new structure will use the existing City of Greeley sewer tap
which the mobil home is now using. Portabul toilets are used during the
fling events.
The property is protected by Western Hills Fire Dis..
No animals in this requst.
No waste, stockpiling or stroage needs in this requst.
No storm water facilities needed in thks requst.
The normal removel of trash related to a single family dwelling
by a standard dumpster. During water eking events serveral trash
dumpsters are provided. Removal is by weekly commerical trash service.

The Weld County Comprehensive Plan is being met under this requst.
The use of the existing 1?ke for the water sking is upgrading a gravel
pit to a productive purpose. The lake is the by-product of the mining
of road building material for Highway 34 bypass.
The guest house is simply replacing a mobil home with a permanent
dwelling.
The district in which the requst as located is not being changed
by our requst.
The property is -comPlety fenced on all sides. The access entrance have
sighs informing about this being private property and a private lake.
Their is no health or welfare issue.
The exicting surroundings are river bottom land to the east, -south
and north. To the west is irragated farm land. The surrounding area 1s
lighty populated. As stated before we are using a existing lake and
simply making the area usable, organized, safe and increasing the value
of the property.
Future development of the surrounding area don-es not ap)ly to
this requst.
This requst does not exist in the Airport -overlay district area.
