WHEREAS , the Board has been presented with a Road Maintenance o
Agreement between Weld County and the City of Evans, and z w

WHEREAS, said Agreement provides that Weld County will m m
maintain certain portions of the dedicated public street and c --c
right-of-way known as Brantner Road, with the terms and conditions m

being as stated in the Agreement, and to ,--

WHEREAS, after review, the Board deems it advisable to H o
approve said Agreement, a copy of which is attached hereto and z
incorporated herein by reference. r w

NOW, THEREFORE, BE IT RESOLVED by the Board of County xi-

ROAD MAINTENANCE AGREEMENT
THIS AGREEMENT, made and entered into this 19th day of r
April , A.D. , 1988 , by and between THE CITY OF EVANS,
COLORADO, by and through its City Council, hereinafter referred to w vw,
as "City, " and the COUNTY OF WELD, by and through the Board of °0 ''

WHEREAS, on January 27, 1988, Ms. Jackie Moore , the owner of • -4
Lot 1 , Block 3 , and Tract "B, " Evans Industrial Park, City of y
Evans, Weld County, Colorado, dedicated approximately 3 ,109 . 07
square feet of said Lot 1 , and .174 acres of said Tract "B" to the H
City as a public street and right-of-way designated as "Brantner z

WHEREAS, a copy of said street dedication is attached hereto, x

WHEREAS, on March 1 , 1988 , City approved and accepted said
dedication by Ms . Moore of the public street and right-of-way for 0 -Ea
Brantner Road by Ordinance No. 696-88 , and m o

WHEREAS , County is currently in the process of constructing d
Brantner Road, including said dedicated portions , and

WHEREAS, County intends to maintain in the future all of n

Brantner Road, including said portions dedicated by Ms . Moore.
NOW, THEREFORE, in consideration of the mutual convenants and
promises contained herein, the parties hereto agree as follows:
1 . County agrees to maintain the dedicated public street
and right-of-way known as "Brantner Road" over those portions of
Lot 1 , Block 3 , and Tract "B, " Evans Industrial Park, City of
Evans, Weld County, Colorado, which were dedicated by Jackie Moore

Ordinance No. 696-88 .

ORDINANCE NO. 698-88
AN ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE
CITY OF EVANS AND THE COUNTY OF WELD, REGARDING ROAD MAINTENANCE
FOR BRANTNER ROAD
WHEREAS, Weld County is currently in the process of
constructing Brantner Road, including certain portions dedicated
to the City of Evans; and,
WHEREAS, Weld County intends to maintain in the future all
of Brantner Road including those aforementioned sections
dedicated to the City of Evans at no cost to the City.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EVANS, COLORADO
1 . The recitals above set forth are incorporated herein by
reference for all purposes as though set forth in full .
2 . The Intergovernmental Agreement attached hereto
concerning the future road maintenance of Brantner Road by Weld
County is approved, and the Mayor and City Clerk are authorized
and directed to execute such Agreement .
