Item 4. In 1987 we acquired the total farm through foreclosure. Due to recent
Colorado Senate Bill 1284 and the Chapter 12 Agriculture Bankruptcy Act,
the previous owner was able to retain 7.25 acres together with the
buildings and improvements that are situated upon the acreage. We
acquired the remainder of the farm with one residential dwelling.
It is not our intent to keep any farmland, and we have listed the
property for sale, as we have all our other acquired properties.
We were able to obtain a written contract to purchase the farm,
which we have accepted. However, it is subject to obtaining an
exemption on the existing dwelling that remains.
The Buyers have no interest in retaining the existing dwelling as
they are interested in the land only. Much of the previous interest
in the farm has been only if the residential dwelling could be exempt.
Item 5. . This proposal is consistent with the policies of the Weld County
Comprehensive Plan because (1) It is an Agricultural District and
the contiguous ownership is more than twice the minimum lot size.
(2) The exemption shall have access from Weld Co. Rd. 51 which is
a black top county road.
Item 6. This proposal is consistent with the intent of the Zone District
which is Agriculture.
Item 7. The use of the property will be for irrigated farming and a rural
residence, as it has been used in the past.
Item 8. The property is surrounded by irrigated farmland and small acreage
residential dwellings. This property would be very compatible
with the existing surrounding: land uses.
Item 9. This proposal is not inconsistent with efficient and orderly development,
and there is no further development contemplated.
Item.10. Domestic water will be furnished to the property by North Weld Water
as per the attached letter. The septic system method is used for
sewage disposal.
Item 11. To the best of our knowledge, the property under consideration is not
located in a flood plain, geologic hazard, and/or Weld Co. Airport
overlay district.
