HomeMy WebLinkAbout871441.tiff r --\ RESOLUTION RE: APPROVE REPLAT OF LOTS 3 AND 4 , BLOCK 18 , ARISTOCRAT RANCHETTES SUBDIVISION - MILTON TRUMBLE AND KENNETH SMITH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 16th day of November, 1987 , a public hearing was held before the Board of County Commissioners of Weld County, Colorado, to consider the application of Milton Trumble and Kenneth Smith for a replat of Lots 3 and 4 , Block 18 , Aristocrat Ranchettes Subdivision, Weld County, Colorado, and WHEREAS, said Lots are located on the following real estate, to-wit: Part of Section 27 , Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Board heard the testimony and statements of those present, studied the recommendation of the Weld County Planning Commission and, being fully informed, is satisfied that the proposed replat conforms in all respects to the requirements of the Weld County Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the replat of Lots 3 and 4 , Block 18 , Aristocrat Ranchettes Subdivision, requested by Milton Trumble and Kenneth Smith, be, and hereby is, approved subject to the following conditions: 1 . No building or electrical permits shall be issued on the property until the resubdivision plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 2. The Planning Commission's recommendation for approval is conditional upon the following: 1 . No building or electrical permits shall be issued on the property until the resubdivision plat has been delivered to the Department of Planning Services' office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 2. UPRC has leased the right to explore for and produce oil and gas to Amoco Production Company. I understand from a telephone conversation on October 9, 1987, with Keith A. Schuett, Planner for the Weld County Department of Planning Services, that the acreage which is the subject of the Replat Appli- cation includes only approximately two acres, that the proposal is a change only in the configuration of the plat, and that the section is currently zoned agricul- tural . In that the subject of the application in- cludes only approximately two acres of land, and that the owner of oil and gas in the area has the right to drill one well on approximately every 40 acres in accordance with current Colorado State Oil and Gas Conservation Commission rules and regulations, it appears that UPRC' s rights to develop the oil and gas will not be substantially effected by the Replat Application, and, therefore, UPRC does not object to 871441 Weld County Board of County Commissioners Weld County Planning Commission October 16, 1987 Page 2 it .
