HomeMy WebLinkAbout890326.tiff RESOLUTION RE: GRANT MANUFACTURED HOME -ZONING PERMIT NO. 37 - EDWARD AND HELEN DAY WHEREAS, the -Board of County Commissioners of Weld County, Colorado, pursuant -to Colorado statute and the Weld _County Home Rule Charter, is vetted with the authority of adminiaterin-g the affairs of Weld County, Colorado, and WHE-REAS, on the 10th day of April , 1989 , -the -Board considered the request of Edward and Helen Day for a mobile tome to be useid as a principal dwelling, and WHE-REAS, after hearing the testimony and considering the evidence which was presented, the Board -deemed it appropriate to change the _designation of the request from a mobile home to a manufactured home, and WHEREAS, the Board changed this designation because the request by Edward and Hel-en Day meets the 1974 National Manufactured Housing Construction and Safety Standards Act, and WHEREAS , -said manufactured home is to be occupied in an A-agricultural Zone District on a parcel of land being more particularly described as follows : Block 11 , Dream Acres, Weld County, Colorado WHEREAS , the Board of County Commissioners , having heard the testimony, find-s that said request should be granted subject to the following conditions : 1) the applicant shall obtain a building permit for the manufactured home within thirty _lays from the date of approval by the Boar_d of County _Commissioners; 2) a septic permit shall be obtained prior to the issuance of the building permit for the -manufactured home; and 3) the manufactured home shall not be occupied until such time that the applicant has complied with the above mentioned conditions. NOW, THEREFORE, BF IT RESOrVED by the Board of -County Commissioners of Weld County, Colorado, that Edward and Helen Day he, and hereby are, granted MHZP #37 for the placement of a manufactured home to be used as a principal dwelling on the above described parcel of land, which was found to be in compliance with section 46 of the Weld County Zoning Ordinance , subject -to the hereinabove listed conditions . X Be compatible with the surrounding area. X Be in harmony with the character of the neighborhood. X Adversely affect the immediate area. X Be adequately served by water and sewage disposal facilities. X Adversely affect the general health, safety, and welfare of the inhabitants of the area and the County. COMMENTS: The applicants chose to have this case heard by the Board of County Commissioners instead of submitting a petition signed by 70% of the surrounding property owners. The Department of Planning Services has received 3 phone calls in opposition to this request. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1 . Box 758 Greeley, CO 80632 RE: CASE 1/ZPMH1531 Dear County Commissioners: At our recent meeting of the Tri-Area Planning Commission meeting, Vernon and Gail Widger, 5137 Weld County Road 16 3/4 and Ron and Linda Burch, 5221 Weld County Road 16 3/4 came before our Commission with a concern of theirs and others who live in the Dream Acres sub-division. This concern is regarding case #ZPMH1531, application from Ed and Helen Day for a zoning permit for a mobile home as principal dwelling in block 11 of the Dream Acres sub-division. The concern of these residents is the addition of a mobile home on block 11. In addition to the $50,000 mobile home Mr. Day plans to bring in, he also plans on renting the now existing mobile home on the east half of block 12. In looking through the County Ordinance book the following should warrant denial of the application. 1. The proposal is not consistent with efficient and orderly development. 2. If the already existing mobile is not to be moved this would warrant creating an additional lot for the new mobile home to be moved in. We then, would have concerns about the level of development and the potential for continued division occurring in this area. 3. The proposed zoning permit would not be compatible with the existing or future development of the area. 4. And due to the fact that Mr. Day could not get enough signatures from surrounding residents to get the zoning permit should also say something about the concern of the residents about the additional mobile home. 5. If in fact the application is approved, the residents feel they will be the minority with their $100,000.00 homes, amongst the majority, which is not the original intention of the Dream Acres sub-division. Would also like to point out that Planning Services personnel working on the Day application were rude and did not work with the concerned residents when inquiring about the application, which is why they came before us.
