EMERGENCY ORDINANCE NO. 146-A
IN THE MATTER OF SETTING THE MILL LEVY AND APPROPRIATION FOR THE
STATE BOARD OF EQUALIZATION ORDER
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD

That on November 13 , 1985 , the State Board of Equalization
-'v issued Weld County an Order of Reappraisal for certain classes
of agricultural property under Section 39-1-105 . 5 (1) (a) (II) ,
a CRS, 1973 , and

That the State Board of Equalization issued an Order on
voiw October 29 , 1986 , for the Board of County Commissioners of Weld
County to levy, in 1986 for collection in 1987 , property taxes
o to reimburse the State $97, 904.92 in accordance with Section
w 39-1-105 , CRS, 1973 , due to the reappraisal of agricultural

property in Weld County, and
o x That Section 39-1-105 , CRS , 1973 , states that if the State
a Board of Equalization orders such levy, the Board of County
'n a Commissioners shall levy such additional property tax in an
amount sufficient to reimburse the State.

w NOW, THEREFORE, BE IT ORDAINED by the Board of County
ticEli� Commissioners of Weld County, Colorado, that in compliance with
w the State Board of Equalization Order issued October 29 , 1986,
u w an additional . 108 mills is hereby levied on all taxable
co w property in the County to reimburse the State.
oz BE IT FURTHER ORDAINED that a STATE REIMBURSEMENT FUND be

created by the Treasurer and Finance Department.
aBE IT FURTHER ORDAINED that the amount of $97 ,904. 92 be
appropriated in the STATE REIMBURSEMENT FUND for the State

~~ BE IT FURTHER ORDAINED that the County Assessor and the
03w County Treasurer of Weld County , Colorado, be, and hereby are,
authorized and directed to make such entries upon their books,
at such time or times as will be necessary to make this mill
levy for the appropriation for the STATE REIMBURSEMENT FUND, for
the fiscal year 1987 , effective immediately.
BE IT FURTHER ORDAINED that an emergency exists inasmuch as
State law requires that the mill levy and appropriation
Ordinance of Weld County, Colorado, be enacted on or before the
31st day of December, 1986 , and , therefore, this Ordinance is
declared to be an Emergency Ordinance under the provisions of
Section 3-14 of the Weld County Home Rule Charter.
