RE: APPROVE DISMISSAL OF SHOW CAUSE HEARING - JAMES McDONALD
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was conducted before the Board of
County Commissioners on the 3rd day of April, 1985 , at the hour of
2 : 00 p.m. in the Chambers of the Board for the purpose of
considering the revocation of Special Use Permit #443 , which was
amended by Use by Special Review Permit #537 , granted to James
McDonald, on the following described parcel of land, to-wit:
The Eh W1 SA of Section 25 , Township 2 North,
Range 68 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, at said hearing, the Department of Planning Services
advised the Board that, pursuant to the Resolution of February 27 ,
1985 , James McDonald submitted an application for an amended Use
by Special Review and also paid all of the applicable fees , and
WHEREAS, the Department of Planning Services recommended that
the Show Cause Hearing to consider the revocation of the
hereinabove mentioned Special Use Permit #443 , which was amended
by Use by Special Review Permit #537 , be dismissed, and
WHEREAS, after considering said recommendation from the
Department of Planning Services, the Board deems it appropriate to
dismiss the Show Cause Hearing without prejudice.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Show Cause
Hearing to consider the revocation of Special Use Permit #443 ,
which was amended by Use by Special Review Permit #537 , be, and
hereby is, dismissed without prejudice.

The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 3rd day of
April, A.D. , 1985 .

RE: SHOW CAUSE HEARING FOR JAMES McDONALD
A public hearing was conducted on April 3, 1985, at 2:00 P.M. , with the
following present:
Commissioner Jacqueline Johnson, Chairman
Commissioner Gene Brantner, Pro-Tem - Excused
Commissioner C.W. Kirby - Excused
Commissioner Gordon E. Lacy
Commissioner Frank Yamaguchi
Also present:
Acting Clerk to the Board, Tommie Antuna
Assistant County Attorney, Lee D. Morrison
Director of Planning Services, Chuck Cunliffe
The following business was transacted:
I hereby certify that pursuant to a Notice of Continuation of Hearing
dated February 11, 1985, and duly published February 14, 1985, in the
La Salle Leader, a public hearing was conducted to consider the
revocation of Special Use Permit #443, amended with Use by Special
Review Permit #537. Lee Morrison, Assistant County Attorney, made this
matter of record. Chuck Cunliffe, Director of Planning Services,
advised the Board that James McDonald had submitted the required
application for an amended Use by Special Review and paid the
applicable fees. Mr. Cunliffe recommended that this matter be
continued to consider the submitted application. Mr. Morrison advised
the Board that this matter need not be continued and the application
submitted by Mr. McDonald should be processed in the customary manner.
Mr. McDonald was not present nor represented. Commissioner Lacy moved
to dismiss the Show Cause Hearing without prejudice. Commissioner
Yamaguchi seconded the motion and it carried unanimously.
