Dear Chairman Johnson and Commissioners:
I am writing you regarding a problem created by the development
of the lands in Sections 19 and 30, Township 5 North, Range 65 West
of the 6th P.,., and Sections 24 and 25 in Township 5 North, Range 66
West of the 6th P.M., Weld County, Colorado. I purchased my property
in Township Five in 1980. Until two weeks ago, I did not know many
facts concerning the water from the House-McMurphy Seepage and Drain-
age System or I would have contacted you earlier. Over the past five
years I've had increasing problems regarding water, including exces-
sive water in winter, torrents of water from storms, raised water
table and not enough water to irrigate in summer. These problems have
caused me thousands of dollars in damages, repairs, and delayed oper-
ations.
Problems, I understand, began to arise with the development of
Terrace Park Trailer Court when the natural lay of the land was raised
and land was eliminated for holding some of the water. With continued
development and paving of the Greeley Mall and the Auto Park, etc.,
this water retention problem has intensified and must be addressed.
It does not make sense that my property is the dumping ground for
all of the drainage water during the wettest months of the year and
rain storms, yet I have no water in the driest months of the year.
The daily flow of seepage water is the dry months is collected and
pumped out by the owner of Terrace Park, who has the alternative of
purchasing water from the city. I have no such option to irrigate.
Recently, I discovered that ten years ago an engineers report
informed Weld County and the cities of Evans and Greeley that develop—
ment should cease in Township Five until water drainage was corrected.
Since that time all three entities have knowingly continued to grant
development permits which has resulted in damage to my property and
ranching operation.
I feel Weld County and the cities of Evans and Greeley must
share the liability for the problems of continued development and
flood damage they were forwarned about.
Please contact me so we can share some ideas on how to alleviate
these problems.
