RE: APPROVE CONTINUANCE OF HEARING CONCERNING USE BY SPECIAL
REVIEW - ELK EXPLORATION, INC.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on April 23 , 1986 , a hearing was conducted to
consider the request of Elk Exploration, Inc. for a Use by Special
Review for oil and gas production facilities in an R-1 (Low
Density Residential) Zone District, and
WHEREAS, the applicant was not represented at said hearing,
and
WHEREAS, the Board deems it advisable to continue said
hearing to May 7 , 1986 , at 2: 00 p.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to
consider the request of Elk Exploration, Inc. for a Use by Special
Review for oil and gas production facilities in an R-1 (Low
Density Residential) Zone District be, and hereby is, continued to
May 7, 1986 , at 2: 00 p.m.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
April, A.D. , 1986 .

R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICT - ELK EXPLORATION,
INC.
A public hearing was conducted on April 23, 1986, at 2:00 P.M. , with
the following present:
Commissioner Jacqueline Johnson, Chairman — Excused
Commissioner Gordon E. Lacy, Pro—Tem
Commissioner Gene Brantner
Commissioner C.W. Kirby
Commissioner Frank Yamaguchi
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Planning Department representative, Debbie de Besche
The following business was transacted:
I hereby certify that pursuant to a notice dated February 19, 1986, and
duly published February 27, 1986, in the Johnstown -Breeze, a public
hearing was conducted to consider the request of Elk Exploration, inc.
for a Use by Special Review for oil and gas production facilities in an
R-1 (Low Density Residential) Zone District. Lee Morrison, Assistant
County Attorney, made this matter of record, and stated that this
matter was continued from March 12, 1986, and April 19, 1986, when only
three Commissioners had been present. No one was present to represent
the applicant. Mr. Morrison advised the Board that the burden o₹ proof
lies with the applicant, making it necessary for the applicant to be
represented. Commissioner Kirby moved to continue this matter to May
7, 1986, at 2:00 p.m. The motion, seconded by Commissioner -Brantner,
carried unanimously.
This Certification vas approved on the 28th day of April, 1986.
