RE: SET HEARING DATE FOR CONSIDERATION OF BEEBE DRAW FARMS
METROPOLITAN DISTRICT SERVICE PLAN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a Service Plan , supplemental documents , and a
processing fee have been filed relating to the proposed Beebe Draw
Farms Metropolitan District, Weld County, Colorado, and
WHEREAS , the law requires that a hearing be called and held
within thirty days concerning the adequacy of said Service Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that:
Section 1 . A hearing on the Service Plan, as filed, for the
proposed Beebe Draw Farms Metropolitan District, is called and the
same is hereby set for 2: 00 P.M. , in the Chambers of the Board, in
the Centennial Building, 915 10th Street, in Greeley, Colorado,
the regular meeting place of the Board of County Commissioners, on
Wednesday, the 14th day of May, 1986 , which date is not more than
thirty days after this meeting.
Section 2 . The Clerk to the Board is hereby directed to
cause a notice of the date, time , location, and purpose of the
hearing to be published in the Johnstown Breeze, the legal
newspaper of the County, once each week for a period of three
successive weeks, by three publications, the first of which shall
be at least twenty days prior to the date of the hearing.
Section 3. The Clerk is hereby further directed to provide
written notice of the date , time, and location of the hearing to
the petitioners , to the Division of Local Government, and to the
governing body of any existing municipality or special district
which has levied an ad valorem tax within the next preceding tax
year and which has boundaries within a radius of three miles of
the proposed district.

Section 4 . Said notice shall be in substantially the
following form:

PUBLIC NOTICE IS HEREBY GIVEN that there was filed with the County
Clerk and Recorder of Weld County, Colorado, a Service Plan and
related documents for the proposed Beebe Draw Farms Metropolitan
District. The Service Plan and related documents are now on file
in the office of the Clerk and Recorder and the Board of County
Commissioners and are available for public inspection.
NOTICE IS FURTHER GIVEN, that, by Order of the County
Commissioners of Weld County, Colorado, a public hearing on said
Service Plan and related documents will be held in the Chambers of
the Board, First Floor, Weld County Centennial Center, 915 10th
Street, Greeley, Colorado, at 2: 00 p.m. , on Wednesday, the 14th
day of May, 1986 .
The purpose of the hearing shall be to consider the adequacy of
the Service Plan of the proposed Beebe Draw Farms Metropolitan
District and form a basis for adopting a Resolution approving,
conditionally approving, or disapproving the Service Plan.
The proposed district is located entirely within the unincoporated
area of Weld County, Colorado. A general description of the land
contained within the boundaries of the proposed district is the
Rezoning Plat of Beebe Draw Farms and Equestrian Center, A Planned
Unit Development, according to the recorded plat thereof,
Reception No. R1992773 , with the County Clerk and Recorder of Weld
County, Colorado, located in Sections 3 , 4 , 5 , 8 , 9 and 10 ,
Township 3 North, Range 65 West of the 6th Principal Meridian,
Weld County, Colorado, as more specifically set forth in the
Service Plan and related documents which are on file with the
County Clerk and Recorder.

Notice is further given that any time after the filing of the
petition for the organization of the proposed district in the
District Court for the County of Weld, but no later than ten (10)
days before the hearing on the Petition, in accordance with the
provisions of the statute, the owner of any real property within
the proposed district may petition the District Court to exclude
his property and the District Court, not the Board of County
Commissioners, shall determine whether said property should be
excluded.
THIS NOTICE IS GIVEN BY ORDER of the Board of County Commissioners
of Weld County, Colorado, this 23rd day of April, 1986 .

Section 5. The Clerk is hereby further directed to deliver a
copy of the Service Plan to the County Planning Commission, with
the direction that the Commission shall study the Service Plan and
that a representative thereof shall present its recommendations to
the Board of County Commissioners at the hearing described in
Section 1 above.
Section 6. All Resolutions, or parts thereof, in conflict
with the provisions hereof, are hereby repealed to the extent of
such conflict only.
Section 7 . This Resolution, immediately upon its passage,
shall be authenticated by the signatures of the Board of County
Commissioners and the County Clerk and Recorder and sealed with
the corporated seal of the County.

The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 23rd day of
April, A.D. , 1986 .
