RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY IN THE
A (AGRICULTURAL) ZONE DISTRICT - WINDSOR GAS PROCESSING
(OILCOM CORPORATION)
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 19th day of December, 1988 , at the hour of 9 : 30
a.m. in the Chambers of the Board for the purpose of hearing the
application of Windsor Gas Processing (Oilcom Corporation) , 1600
West First Street, Loveland, Colorado 80537 , for a Site Specific
Development Plan and Special Review Permit for an oil and gas
support and service facility in the A (Agricultural) Zone District
on the following described real estate, to-wit:
Part of the SW* NW* , Section 32 , Township 4
North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was represented by Ralph Nelms,
operations manager, and
WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 .7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposed Special Review Permit is consistent
with the Weld County Comprehensive Plan ' s Urban
Growth Boundary Area Goals and Policies , and is
located within the urban growth boundary area of

the towns of Platteville and Gilcrest. The
Gilcrest Town Council and the Platteville Planning
Commission reviewed this request and find no
conflict with their interests. The proposed
Special Review Permit is in an area that will not
interfere with urban development.
b. The proposed Special Review Permit is consistent
with the intent of the Agricultural Zone District
and is provided for as a Special Review Permit.
c. The proposed Special Review Permit is compatible
with the existing surrounding land uses which
include State Highway 60 , one residence, and farm
production. The Special Review Permit Conditions
of approval and Development Standards will mitigate
concerns about compatibility with surrounding land
uses.
d. No overlay districts affect the site.
e. The applicant has demonstrated a diligent effort in
conserving productive agricultural land in the
locational decision for the proposed Special Review
Permit.
f. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for an
oil and gas support and service facility in the A (Agricultural)
Zone District on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:
1 . The attached Development Standards for the Special
Review Permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners .

2 . The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.
3 . Prior to the issuance of building permits , a copy of the
following shall be submitted to the Department of
Planning Services:
a. A soil erosion control plan approved by the Platte
Valley Soil Conservation Service.
b. An air emissions permit from the Air Pollution
Control Division, Colorado Department of Health for
fugitive dust and odors .
4 . Prior to recording the plat, the plat shall be amended
to show the noise abatement program.
5 . Prior to issuance of the building permit, the applicant
shall submit a letter to the Department of Planning
Services staff withdrawing Special Review Permits 857 ,
858 , and 866 submitted by Windsor Gas.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 19th day of
December, A.D. , 1988 .

Windsor Gas Processing (Oilcom Corporation)

1 . The Special Review Permit and Site Specific Development Plan
is for an oil and gas support and service facility in the A
(Agricultural) Zone District as submitted in the application
materials on file in the Department of Planning Services and
subject to the Development Standards stated herein.
2 . Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 , C.R.S. , as amended.
3 . All liquid and solid wastes shall be stored and removed for
final disposal in a manner that protects against surface and
groundwater contamination.
4 . The property shall be maintained in compliance at all times
with the Air Emissions Permit approved by the Colorado
Department of Health, Air Pollution Control Division.
5. No permanent disposal of wastes shall be permitted at this
site.
6 . The septic systems for the proposed office shall be designed
by a Colorado Registered Professional Engineer according to
the Weld County Individual Sewage Disposal Regulations.
7. Maximum permissible noise level shall not exceed the
residential limit of 50 dB (A) , as measured according to
25-12-102 , Colorado Revised Statues .
8 . No buildings or structures shall be built within Panhandle
Eastern' s fifty foot pipeline right-of-way.
9 . Two business days prior to the start of construction, the
Utility Notification Center of Colorado shall be notified of
the intent to start construction. This is to allow
sufficient time for utility companies to locate and mark
utility lines to eliminate accidents.
10 . The 300-barrel condensate tank and 100-barrel water tank
shall be located no closer than 100 feet to all propane
storage tanks.

11 . A current map of the location of the gas supply shutoff
valves shall be maintained with the Platteville Fire
Protection District.
12 . Smoking shall not be permitted at any time on the Special
Review Permit site. "NO SMOKING" signs shall be placed and
maintained on the subject site .
13 . All vessels containing flammable or dangerous materials shall
be identified in accordance with the National Fire Protection
Association, #704M identification system.
14 . No less than one 40A 240BC rated fire extinguisher shall be
located and maintained on the Special Review Permit site at
all times.
15 . All liquid storage tanks shall be bermed to contain the
greatest amount of liquid possible that can be released from
the largest storage tank in the event of spillage.
16 . The soil erosion plan approved by the Platte Valley Soil
Conservation Service shall be maintained at all times.
17 . The appearance of the facility shall be maintained in a neat
and orderly condition through periodic painting and
maintenance.
18 . All land within twenty-five (25) feet of any oil or gas tank
containing flammable or combustible materials, or other
appurtenant production equipment shall be kept free of dry
weeds, grass, or rubbish.
19. A six foot chain link fence, topped with three strands of
barbed wire, shall enclose the Special Review Permit area.
20 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
21 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
22 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance.
23 . Personnel from the Weld County Health Department, Platteville
Fire Protection District, and Weld County Department of
Planning Services shall be granted access onto the property

at any reasonable time in order to ensure the activities
carried out on the property comply with the Development
Standards stated herein and all applicable Weld County
'Regulations.
24 . The Special Review Permit area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated -shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.
25 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.

A publi-c hearing was conducted on December 19, 1988, at 9:30 A.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 21, 1988, and
duly -published November 30, 1988, in the Platteville Herald, a public
hearing was conducted to consider the request of Windsor Gas Processing
(Oilcom Corporation) for a Site Specific Development Plan and Special
Review Permit for an oil and gas support and service facility -in the A
(Agricultural) Zone -District. Bruce Barker, Assistant County Attorney,
made this matter of record and stated that this hearing was continued
from December 14. Keith Schuett, Planning Department representative,
reviewed the recommendation of the Planning Commission -which was
entered into the record on December 14. Ralph Nelms, operations
manager of Windsor Gas Processing, came forward to represent the
applicant. Mr. Nelms showed slides of this site and the present
facility in the Windsor area. He said this facility will be almost
identical to the existing facility. Mr. Nelms reviewed this request
and explained the methods which will be used to control the sound.
(Tape Change #88-62) Edward Wolf, a neighbor, and Richard Wolf, owner
of neighboring land, both spoke in opposition to the request, with
noise and the danger of explosion being their major objections. Sam
Frank, present owner of the site, spoke in favor of the request. Mr.
Nelms explained the difference between the accident potential at a well
and at a plant. He also stated that he would have no objection to
Development Standard #7 calling for compliance with the residential
noise level. Mr. Schuett said the Planning staff would recommend
addition of a Development Standard calling for the withdrawal of
Windsor Gas Processing's other Special Review Permits prior to the
issuance of a building permit, and that the plat should be amended to
show the additional noise abatement features. Commissioner -Lacy moved
to deny this request. Commissioner Brantner seconded the motion.
Following discussion, the motion failed, with Commissioners Lacy and
Brantner voting aye, Commissioners Kirby and 3ohnson voting nay, and
Commissioner Yamaguchi abstaining. After further discussion,
Commissioner Johnson moved to approve the request, subject to the
Conditions and Development Standards contained in the Planning staff's
recommendation, with Development Standard #7 amended to refer to the
residential noise limit of 70 dB(A) , and the addition of Conditions
requiring withdrawal of the other Special Review Permits prior to
issuance of a building permit and that the plat shall be amended to
show the noise abatement program. The motion was seconded by
Commissioner Kirby. Commissioner Lacy stated that he will vote against

the motion. On a roll can vote, the -motion carried 3-1, with
Commissioner Lacy voting nay and -C-ommissioner Yamaguchi abstaining.

Request for Reversal of Denial of Use by Special
Review Permit for Site for Gas Proceesing Plant
Background:
Windsor Gas Processing filed a Use for Special Review
permit for a natural gas processing plant on a Parcel
of land in the SW/4 NW/4 of Section 32 , T4N, R68W
the first week of September 19-88. The first Planning
Commission hearing was held October 1B , 198B. No decision was
made at the October 18, 1988 meeting by the Planning
Commission because the commissioners wished to visit the
plant in person prior to -making a final recommendation.
At the _November 1, P988 Planning Commission meeting,
two of the adjacent land owners protested the permit for the
gas plant site due to concerns about noise levels .
The Planning Commission passed an unfavorable recommendation
for the permit because : ( See Exhibit A )
"the use would be Incompatible with the uses currently
in existence , and an aacisting residence would be
too close to the proposed gas plant operation. "
Windsor Gas Processing filed a request for a hearing before the
Weld County -Board of Commissioners on the unfavorable recommendation
by the Planning Commission November lb , 1'98-8.
Introduction:
Windsor Gas Processing -will present evidence in this report that
the gas plant would be compatible with the USES currently in
existance and that noise levels can be controlled as to not
cause any negative impacts upon the immediately adjacent
properties .
Discussion:
Findings of the Weld County Planning Services Department
Attached to this report is a copy of the recommedations
of the Weld County Planning Services Department in regards to
USR-856 . ( See Exhibit B )

The recommendation of the Planning Services Department was
to approve the Use by Special Use permit because :
" The proposed use by special review is consistent with the
Weld County Comprehensive Plan' s Urban Growth Boundry
Area Goals and Policies . "
and
" The proposed use by special review is compatible with the
existing surrounding land uses - which include State Highway
60 , one residence, and farm production. The special review
conditions of approval and development standards will mitigate
concerns about compatibility with surrounding land uses . "
25 development standards were required by the Planning
Services Department to insure a -minimal impact of the gas
plant on the surrounding properties. All 23 development
standards are acceptable to Windsor Gas Processing.
It is apparent by reviewing the statements made in the
Weld County Planning Services recommendation for approval
of the Use by Special -Review permit , that the gas plant can be
operated in such a manner as to be compatible with the uses
currently in -existance and that significant negative impact
on the one residence would -not occur.
Compatibility of the site with uses currently in existance,
Currently the land is being used for Agricultural purposes .
The area is also developed for oil and gas usage . About
25 wells exist within a 2 1/2 mile radius of the plant site.
A major 6" natural gas transmission line owned by Panhandle
Eastern Pipeli-n-e company runs directly between the proposed
site and Colorado State Highway b0 with a control valve
station adjacent to the property.
Colorado State Highway 60 is paved and carries a consistently
moderate amount of car, semi-truck, agricultural equipment ,
and agricultural truck traffic directly adjacent to the proposed
plant site.
Existing residence close to proposed gas plant site .
The residence located on the West side,of Colorado Highway
60 at Weld County Road S8 1/2 is owner by Mr. Richard Wolf
of Route 1, Box 74 W, Ault , Colorado 80610. The house is
currently rented. The house is located about 60' from
the black top of Colorado Highway 60. Therefore existing
traffic already bas a direct impa-ct on noise levels at the
home. ( See -Exhibit C )

Conversations with Windsor Gas -Processing personnel and
the residents of the rental home indicate that they do not
have any objection to the gas plant location because the
existing noise levels , due to traffic , are already an impact
on the home.
Any additional traffic created by the plant would be
insignificant compared to existing traffic loads on State
Highway 60. No significant health or safety concerns
are related to the plant. -the distance from the home to
the plant site must be far enough to -meet Weld County
Zoning ordinances or the Planning Commission would not have
given the site their approval.
Therefore,it is Windsor Gas Pros.essi-cg 's position that
the home is in fact far enough away from the plant as to not
create any negative impact.
Noise Levels
Windsor Gas Processing took an exact measurement from the
proposed location of the compressor building to both .
Mr. Richards Wolf's rental house and Mr. Ed Wolfe' s
farm hous-e. Using a wheel measuring device, it is
544' from the compressor building to the rental house and
1114' to Mr. Rd Wolfe's home on Weld County Road 38 1/2 .
A noise level report was attached to the original use by
special review permit . This survey was conducted by
Mr. Ralph L. Nelms and -Mr. Tom Haerich utilizing a Model
#1933 Precision Sound Level Meter and Analyzer an the
Weighted A scale. Measurements were taken at the existing
plant which has only one compressor and mathematically
extrapolated to the noise levels for three compressors using
standard sound engineering equations . A worst case
scenario was assumed by keeping the large door on the compressor
building open and taking -measurements directly infront of the
door while moving away from the building at measured distances .
Closing the large door on the building reduced all measurements
by 4 decibels . ( See -Exhibit D )
At a distance of 544' from the compessor building , the
maximum sound level projected for three compressors would be
58 decibels less 4 decibels if the door was closed or about
54 decibels . At a distance of 1114' the reading for the
three compressors would be 52 decibels less 4 decibels or
48 decibels .

Part of the Sound Survey taken for the Use by Speical Use
Permit was to measure the sound levels at different locations ,
in the Gilcrest area, so that a comparison could be made
to the sound level measurements -at the gas plant site.
As can be seen on Exhibit D, a base reading at the intersection
of WCR 38 1/2 and Colorado -Highway 60 with no traffic was 39 DBA.
Cars and tractors passing by _read 65 to 70 DBA at a distance of
40 ' from the black top highway. Semi truck traffic and
agricultural truck traffic read 80 DBA at a distance of 40 ' .
Measurements were also taken at 5th and Elm Street in Dilcrest ,
Colorado and in front of the Gilcrest Town Hall . Base
sound levels at both locations were about 52 DBA. When
cars or trucks passed on Highway B5 , sound levels increased
to 60 or 70 DBA.
Noise Abatement as the Gas Plant Site
State of Colorado Noise Statutes
Exhibit E lists the noise abatement statutes in the State of
Colorado. Windsor Gas Processing will be limited to a noise
level not to exceep 70 DBA at a distance of 25 ' from the
plant site boundry based upon a state regulation for
"Light Industrial " zoning.
Note that the penalties for violation of this state noise
code is between $100 and $2000 per day.
Also note that for Residential zoning the maximum permissible
sound levels are 5D DBA. Windsor Gas Processing will take
certain specific steps in the construction of the plant to
insure that all state of Colorado Noise Abatement standards
are meet .
Specific Noise Abatement plans for Gas Plant Site.
Even taking no action to abate noise levels from the plant ,
Windsor Gas Processing could maintain noise levels at the
property of Mr. Richard Wolf and Mr. Edward Wolfe near
state requirments for Residential zoning.
Additional action will be taken to reduce noise levels
below the SO DBA range by installing sound walls and
by orienting the two 30, 000 gallon propane storage tanks
to act as a sound wall .
As shown on Exhibit C, the two 30, 000 gallon propane tanks
will be oriented in a NW to St direction in a perpendicular
line between the compressor building and the rental house
owned thy Mr. Richard Wolf. These tanks will act to reflect
sound away from the rental house.

A sound wall will be build, as per the specific instructions
of the Weld County Health Department, in the Northeast
corner of the plant to absorb sound energy and reflect it
away from Mr. Edward Wolfe' s home. If necessary, a
third sound wall Mill be built in the Southeastern corner
of the plant site to further reduce the sound levels
at the Wolf rental house.
Information obtained from the Weld County Department of Health
Services , See Exhibit F, shows- that a sound wall constructed
of plywood, will reduce sound levels by 20 to 25 DBA.
Recommended construction fox the sound wall , from the
Weld County Department of Health, was 2" X 4" studs spaced
16" apart, with 3/4" plywood on both sides and fiberglass
insulation between the 3/4" plywood siding.
If necessary Windsor Gas Processing will also modify the
insulation inside the building to absorb additional sound
energy.
Conclusion
By installing sound walls and reorienting the two
30,000 gallon propane storage tanks , Windsox Gas Processing
will reduce sound levels at the two closest homes to the plant
sites to between 44 and 48 DBA. This level of sound should
not have any significant impact on the two residences and
will be well below state requirements in Residential Zoning
area.
Based upon the large number of wells in the area of the
proposed plant , and the existence of a major pipeline and
highway adjacent to the plant site, the gas plant will be
compatible with current land usage .
Windsor Gas Processing will continue to work with any
state , local , or county regulatory agencies in any manner
necessary to insure minimal impact on surrounding property
owners . /

Special Review Development Standards will provide adequate
protection of the health, safety and welfare of the neighborhood
and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the
request, and the responses of the referral entities which have reviewed this
request.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1 . The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning -Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the
Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the _office of the Weld

INTRODUCTION -
The Noise Survey -was conducted on September -9 , 1988, by
Mr. _Ralph Nelms and Mr. Tom Ha-erich of Windsor Gas Processing.
The study was conducted specifically to address the problem of
possible noise 'disturbance to surrounding farm residences in
the _Gilcrest area.
Windsor Gas Processing is completing a Use by Special -Review
Permit to move its -existing plant from Windsor, Colorado to the
Gilcrest area. This -Noise -Report will be filed as part of the
U-se by Special -Review Permit.
The instrument used for the survey was a Model #1933 , Precision
Sound Level Meter and Analyzer -mannfactu-red by General Radio
Corporation. The instrument - was rented from Engineering
Dynamics Corporation of 3925 _South Kalamath Street, Lnglewood,
Colorado. Telephone Number (303) 7-61-4367 .
A series of -measurements were taken utilizing the weighted "A"
band of the instrument, which is standard for such tests. The
weighted "a" band combines both high and low frequency sound
bands.
The test was conducted at the following locations:
1 . At the Windsor Gas -Processing Plant site at Windsor ,
Colorado.
2. At WCR 381 and Colorado State Highway 60-.
3 . On Highway 85 on the fronta-ge road across from the
Conoco Filling Station/Convenience -Store in Gilcre-st,
Color ado.
4 . -At Fifth and Elm Street in Gilcrest, Colorado.
5 . At the parki-ng lot of the Gilcrest Town Hall in
Gilcrest, Colorado.

The Windsor Gas Processing Plant now operates with only one
engine and compressor. The proposed plant would have a total
of three -engines and _compressors of equivalent size to the one
tested.
To calculate the total -noise level from the two additional
machines, the standard equation for -sound energy was used as
follows:

At each appropriate radius in feet from the sound
source.
X = Sound Energy Parameter
A -worst case scenario was assumed at the ga-s plant site -by
leaving the doo-r on the end of the building wide open during
the test - to represent summer operating conditions.
Sound measurements were taken directly in -front of the door at
various distances.
The current -Windsor Gas Processing Slant has been in
operation for almost 4 years. The plant is locates] 2 miles
south of -Severence, and 1 miles -west of - Windsor, Colorado.
Also, there i-s a subdivision located about 1/3xa mils SE of the
plant. No complaints from noise have been brought to our
attention since the plant wa-s built in 1984 .

A regular meeting of the Weld County Planning Commission was held on October
18, 1988, in the County Commissioners' Hearing Room, First Floor (#101) ,
Weld County Centennial Building, 915 Tenth Street, Greeley, Colorado. The
meeting was called to order by the chairman, Bud Halldorson, at 1 :40 p.m.

LEGAL DESCRIPTION: Part of the SW} NW} of Section 32, T4N, R66W of the 6th
P.M. , Weld County, Colorado
LOCATION: North and adjacent to Weld County Road 38-1/2, and east and
adjacent to State Highway 60
APPEARANCE:
Ralph Nelms, Operations Manager, Windsor Gas Processing, represented the
applicant. This is for a small gas processing plant. They have a request
for two special review permits on today' s agenda. They do not intend to
install two gas plants, the two permits are for a primary and an alternate
site. Only one of the two sites will be used. This location is for the
primary site. The gas plant would encompass five acres, and have a six foot
chain link fence around the perimeter. There will be storage tanks, a
mobile home for the operator to live in, and several sheds on the site.
There will be no flaring or burning. The compressors are to be located
inside a building so the noise level will be very low. There will be one to
two trucks and three to four vehicles entering the site each day.

The Chairman called for discussion from the members of the audi-erce.
Edward Wolfe, surrounding property owner, spoke in opposition to this
request because of the noise and the closeness to his existing farm
buildings.
Richard Wolfe, surrounding property owner, is opposed to this request
because of the noise.
Sam Frank, property owner of the requested use by special review, spoke in
favor of this request.
Tom Herrick, operator of the Windsor Gas Plant at the Severance site,
explained the plant's safety features and the minimal amount of noise from
the operation.

The Chairman asked Keith Echuett to tsad the recommendation, conditions, and
Development Standards as presented by the Department of Planning Services'
staff into the record.
The Chairman asked Mr. Nelms if he had any questions pertaining to these
items? Mr. Nelms stated they would have no problem working within these
guidelines.
MOTION:
LeAnn-Reid moved Case Number USR-856 for Windsor Gas Processing for a Site
Specific Development Plan and a Special Reivew permit for an Oil and Gas
Support Facility in the Agricultural zone district be continued until the
-regularly scheduled meeting of the Planning Commission on Tuesday, November
1, 1988, at 1:30 p.m. , to enable the members of the Planning Commission to
-individually visit the existing Windsor Gas Processing Plant located near
Severance and review the amount of noise emitted.

Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. LeAnn -Reid - yes; Ivan Cosnell - yes; -Ann

October 20 and 21 from 8:00 a.m. until 5:00 p.m. He gave directions to the
site. Arrangements will be made for someone to be avail-able to allow
admittance and explain the operation.
Le-e Morrison instructed the Planning -Commission -members on procedures to he
followed at the site.

LEGAL DESCRIPTION: Part of the SE} SE} of Section 35, T4N, R66W of the 6th
P.M. , Weld County, Colorado
LOCATION: youth of Weld County Road 40 and east and adjacent to Weld County
Road 35
APPEARANCE:
Ralph Nelms, Operations Manager, Windsor Las Processing, represented the
applicant. This is their alternate site. There are no homes located close
to this site, but the initial -installation and cost of operation would be
much higher than -at the primary site. The equipment and traffic for this
operation would be identical to the first request.
The Chairman _called for discussion from the members of the audience.
Oliver Lorenz, property owner of the proposed use by special review site
indicated this site is dryland. He has considered irrigating this land, but
it would le more expensive to irrigate than anything they could get off of
it.
The Chairman asked Mr. Nelms if he had reviewed the recommendation,
conditions, -and d-evelopment standards as presented by the -Department of
Planning Services' staff?
Keith Schuett reported the recommendation, conditions, and development
standards are identical to the first request. Mr. Nelms stated if these are
identical to the recommendation on the primary request they can work within
these guidelines.

- Special Review Development Standards will provide adequate
protection of the health, safety and welfare of the neighborhood
and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the
request, and the responses of the referral entities which have reviewed this
request.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1 . The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special "Review plat prior -to
recording the plat. 'The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the
Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Prior to the issuance of building permits, a copy of the following
shall be submitted to the Department of Planning Services:
- A soil erosion control plan approved by the -Platte
Valley Soil Conservation Service.
- An air emissions permit from the Air Pollution Control
Division, Colorado Department of Health for fugitive
dust and odors.

our pipelines 16-10-075-207-6" and 16-10-075-194-4" , located in
the Southwest Quarter of the Northwest Quarter of Section 32,
Township 4 North, Range 66 West, Weld County, Colorado.
We maintain a 50-foot wi-de right-of-way on all pipelines and will
not allow any building within that easement area. The owner or
developer shall have the right to construct and maintain utility
lines, streets, sidewalks, and driveways, which may be installed
at approximate right angles to the pipeline herein authorized,
provided , however, that all utilities cross under our pipeline
and maintain lB inches clearance from our pipeline. No paved or
traveled portion of any street, sidewalk, driveway, road, parking
area, alley or curbing will be placed substantially parallel to
and within fifteen ( 15' ) of the pipeline_.
In the event of a proposed crossing with a road or utility,
please contact Utility Notification Center of Colorado (UNCC) at
534-67O0 (Local & Metro Denver ) , or 1-800-922-1967 (Outside the
Metro area) , with two (2) business days notice, and at no cost to
you, we will locate and mark our lines to eliminate accidents
that can occur from foreign forces.
Panhandle Eastern will be more than happy to work with you on
this project ; however, if for any reason our lines must be
moved, it will be at the expense of the developer or the person

Gentlemen:
The Platteville Fire Distict has reveiwed the application by Windsor
gas processing for proposed processing plants at WCR 384 and State Hwy 60
and for a plant at WCR 35 and WCR 38 and have the following recommendations
to make.
•
1. We would like to see the 300 barrel condensate tank and the 100 BBL
water tank moved further away from the propane storage at least 100 feet.
Our reason for this request is that should a incident occur at the
propane tank or the condensate tank by having increased seperation we
will be better able to contain the problem one or the other without
having both facilities to deal with.
2. Based on past experence with fighting a fire at this type of plant we
know that the only way to extinguish a fire supported by natural gas
is to turn off the supply of gas. If this is not _Immediately possible
our position will be to evcuate all persons to a safe distance and allow
the fire to burn
3. Also based on past experence we have found the most effective way to
extinguish a fire involving a compessor is once the gas is off to
use extinguishers rather than foam or water. for this reason -we ask
for at least one extinguisher on each site with _a rating of at least
a 40A 240 BC rating. This extinguisher should be in addition to those
otherwise required.

due to potential frost action . This so i I is droughty and
arty pond or irrigation ditch is likely to seep. Will the
proposed irrigation ditch be l I reed with concrete?
The app I i cation states that all roads and work areas will be
3raveiled . We feel that any area that is not gavelled
should be seeded to adapted grass , such as Fairway
Wheat3rass , at the rate of 6 pounds per acre of pure live
seed . The seeding should be done in a -firm weedfree
seedbed . It should be seeped about 1/2 inch deep and it
should be seeded between November 1st and Apr i l 30th , but
not on frozen so I l . The area that ' s seeded needs to be
protected urlt I l the grass is established . Weeds should be
controlled at all times .
One statement should be added to the Reclamation Flan .
Before the area is returned to cropland the area should be

THREE SHIFTS PER DAY. THE PLANT WILL BE OPERATED AND
MANNED ON -A 24 HOUR/DAY BASIS.

WATER SOURCE WILL BE FROM CENTRAL WELD COUNTY
WATER DISTRICT. ONLY WATER FOR ONE MOBILE HOME
AND ONE SMALL OFFICE BUILDING WILL BE REQUIRED.

ALL TRAFFIC WILL ACCESS THE LOCATION FROM HIGHWAY 85
VIA STATE HIGHWAY 60 , WHICH IS PAVED. NO TRUCK
TRAFFIC ON COUNTY DIRT ROADS WILL BE REQUIRED, EXCEPT
FOR APPROXIMATELY 300 ' OF WELD COUNTY ROAD 381.
Explain type, size, weight and frequency of
vehicular traffic associated with the proposed
use.
CAR AND PICKUP TRAFFIC WILL ACCESS THE LOCATION 3-4
TIMES EACH DAY AS THE THREE EMPLOYEES COME AND GO TO
WORK. ONE SEMI TRUCK WILL ACCESS THE PLANT EACH DAY
TO TRANSPORT NATURAL GAS LIQUIDS FROM THE PLANT IN THE SUMMER
AND TWO IN THE WINTER MONTHS .
- The type of sewage facilities for the proposed
site.
A 1250 GALLON SEPTIC TANK WITH A LEACH FIELD WILL BE
INSTALLED FOR THE MOBILE HOME AND THE SMALL OFFICE
BUILDING. SEPTIC TANK AND LEACH FIELD TO CONFORM
WITH COUNTY BUILDING CODES.
- A description of the proposed fire protection
measures associated with the proposed use.
THE PLANT WILL BE CONSTRUCTED WITH SEVERAL TYPES OF
TEMPERATURE AND PRESSURE SHUT DOWN SAFETY DEVICES TO
SHUT OFF THE NATURAL GAS FLOW TO AND FROM THE PLANT
IN CASE OF A FIRE. THE PLANT WILL BE CONSTRUCTED
WITH ADEQUATE SPACING BETWEEN STORAGE TANKS AND
PROCESSING EQUIPMENT TO MEET STATE SAFETY
REQUIREMENTS. INDUSTRIAL FIRE EXTINGUISHERS WILL BE
USED AT THE SITE. WINDSOR GAS PROCESSING WILL WORK
CLOSELY WITH LOCAL FIRE PROTECTION AGENCIES TO ENSURE
COMPLIANCE WILL ALL FIRE SAFETY CODES.
The types and maximum number of animals to be
concentrated on the Use by Special Review area
at any one time.
NO ANIMALS WILL BE KEPT ON THE FACILITY EXCEPT FAMILY
PETS, SUCH AS A DOG OR CAT, AT THE MOBILE HOME.
Type of storm water retention facilities
associated with the proposed use.
NO STORM WATER RETENTION FACILITIES WILL BE INSTALLED
AT THE SITE.
- The time schedule and method of removal and
disposal of debris, junk, and other wastes
associated with the proposed use.
TRASH REMOVAL WILL BE CONTRACTED TO A COMMERCIAL
TRASH REMOVAL COMPANY, AND WILL BE HAULED OFF ONCE A
WEEK. WASTE OIL WILL BE HAULED OFF ONCE EVERY TWO
MONTHS OR AS NEEDED.

- Explain proposed landscaping plans and erosion
control measures associated with the proposed
use.
ACCESS ROAD WILL BE GRAVELED. ALL WORK AREAS WILL
BE GRAVELED. WEED CONTROL VIA MOWING OR SPRAYING
WILL BE CONDUCTED TO MAINTAIN A CLEAN AND NEAT
APPEARANCE AT THE PLANT. SOME TREES OR BUSHES WILL
BE PLANTED AT THE MOBILE HOME SITE.
- Reclamation procedures to be employed upon
cessation of the Use by Special Review activity-
UPON ABANDONMENT OF THE PLANT, ALL BUILDINGS,
FOUNDATIONS, EQUIPMENT, FENCES, ETC. WILL BE REMOVER.
ALL GRAVEL WILL BE REMOVED OR PLOWED UNDER. SITE
WILL BE RETURNED TO CROP LAND, IN AS CLOSE TO THE
ORIGINAL CONDITION AS POSSIBLE. ALL SEWAGE LINES AND
POWER LINES WILL BE REMOVED. SITE WILL BE CONTOURED
TO ORIGINAL CONDITION.
- A time table showing the periods of time
required for construction and start-up of the
proposed use.
IT WILL TAKE ONE WEEK TO FENCE THE LOCATION AND
GRAVEL THE ROADS. ONE MONTH TO LAY THE FOUNDATIONS,
MOVE IN THE EQUIPMENT, INSTALL THE BUILDINGS, AND
INSTALL THE SEPTIC SYSTEM, ELECTRICITY, PHONES, ETC.
TOTAL TIME OF O_NE MONTH TO COMPLETE THE PROJECT.
3 . The following written materials and supporting documents
shall be submitted as a part of the application:
- A statement explaining how the proposal is
consistent with the Weld County Comprehensive
Plan.
THE AREA IS CURRENTLY DEVELOPED FOR BOTH AGRICULTURAL
AND OIL & GAS USE. THERE ARE CURRENTLY ABOUT 25

WITH NO COMPLAINTS OR PROBLEMS.

ADDITIONAL TITLE COMMENT AND REQUIREMENT
My supplemental division order title opinion of February 4 ,
195 required that you be assured that Amoco has the authority
to create a 16D-acre unit. I have not been advised in this
regard. However, if such a unit is created the new lease from
the ditch company should be included by an appropriate declaration
of pooling recorded in Weld County. The ownership tabulation is
based on the assumption that this will be done.

INTRODUCTION -
The Noise Survey was conducted on September 9 , 1988, by
Mr. Ralph Nelms and Mr. Tom Haerich of Windsor Gas Processing.
The study was conducted specifically to address the problem of
possible noise disturbance to surrounding farm residences in
the Gilcrest area.
Windsor Gas Processing is completing a Use by Special Review
Permit to move its existing plant from Windsor, Colorado to the
Gilcrest area. This -Noise Report will be filed as part of the
Use by Special Review Permit.
The instrument used for the survey was a Model *1933 , Precision
Sound Level Meter and Analyzer manufactured by General Radio
Corporation. The instrument was rented from Engineering
Dynamics Corporation of 3525 South Kalamath Street, Englewood,
Colorado. Telephone Number (303) 761-4367 .
A series of measurements were taken utilizing the weighted "A"
band of the instrument, which is standard for such tests. The
weighted "A" band combines both high and low frequency sound
bands.
The test was conducted at the following locations:
1 . At the Windsor Gas Processing Plant site at Windsor ,
Colorado.
2 . At WCR 381 and Colorado State Highway 60 .
3 . On Highway 85 on the frontage road across from the
Conoco Filling Station/Convenience Store in Gilcrest,
Colorado.
4 . At Fifth and Elm Street in Gilcrest, Colorado.
5 . At the parking lot of the Gilcrest Town Hall in
Gilcrest, Colorado-

The Windsor Gas Processing Plant now operates with onlyone
engine and compressor. The proposed plant wouldhave a total
of three engines and compressors of equivalent size to the one
tested.
To calculate the total noise level from the two additional
machines, the standard equation for sound energy was used as
follows:
20 Log X = DBA
At each appropriate radius in feet from the sound
source.
X = Sound Energy Parameter
A worst case scenario was assumed at the gas plant site by
leaving the door on the en-d of the building wide open during
the test - to represent summer operating conditions.
Sound measurements were taken directly in front of the door at
various distances.
The current Windsor Gas Processing Plant has been in
operation for almost 4 years. The plant is located 2 miles
south of Severence, and 11 miles west of Windsor, Colorado.
Also, there is a subdivision located about 1/3rd mile SE of the
plant. No complaints from noise have been brought to our
attention since the plant was built in 1984 .

AGREEMENT
This AGREEMENT, entered into this eP day of September,
1988 , by and between Windsor Gas Processing of 1600 West First
Street, Loveland, Colorado 80537 (hereinafter referred to as
"WGP") , and Sam and Viola Frank, H/W, of 13411 Weld County Road
381 , Platteville, Colorado 80651 (hereinafter referred to as
"Mr. and Mrs. Frank" ) .
W I T N E S S E T H :
WHEREAS, Mr. and Mrs. Frank desire to sell to WGP for
non-refundable $500 .00 , plus other considerations, the
following described parcel :
Being a part of :
SW%NWT , Section 32 , T4N, R66W, Weld County, Colorado
Containing a minimum of five (5) + acres, more or less, and
WHEREAS, the parties desire to set forth the other
considerations for the above mentioned sale,
NOW, THEREFORE, in consideration of the mutual covenants
and agreements set forth herein and in consideration of
completing the above mentioned sale, it is agreed:
1 . Purchase of the aforementioned land is subject to the
following contingencies:
a) Approval of the site for use as a gas processing
plant facility by Weld County Planning Services,
Weld County Board of County Commissioners, and
the town of Gilcrest, Colorado.
b) Successful approval of re-zoning from
Agricultural to Special Use Zoning by Weld
County.

c Successful approval of any City, County, State,
or Federal permits, as needed prior to
installation of the plant.
d) Acquisition by Windsor Gas Processing of an
approved Point of Delivery to the plant by
Western Slope Gas Company.
e) Selection of this site by WGP, at the sole
discretion of WGP.
2 . WGP shall fill in the drainage tail pond on the west
boundary and re-dig and re-install a new drainage
pipe and tail pond on the east border of the plant.
Said pipe and tail pond to be installed and built as
per Mr. Sam Frank' s specifications. WGP to pay all
costs associated with reinstalling tail pond.
3 . WGP shall control weeds and otherwise maintain the
lands so as to prevent any interference with the
farming operations on adjacent lands. WGP shall also
completely surround the site with a 6 foot chain link
fence to keep out any livestock or unauthorized
persons.
4 . Mr . and Mrs. Frank shall convey to WGP by general
Warranty Deed the above described parcel , subject to
all limitations, conditions, agreements, easements
and rights of way of record including 1988 taxes
payable in 1989 . No water rights nor any oil, gas or
mineral interests shall be conveyed by said deed.
5 . WGP shall pay Mr . and Mrs. Frank $ - per acre
upon delivery of the deed. Taxes shall be prorated to
date of closing.

6 . Mr . and Mrs. Frank are under no obligation to
repurchase the 5 acre si :e after reclamation and
abandonment of the plant at some future date.
WGP agrees that Mr. and Mrs. Frank shall have the
option to repurchase the above described parcel under
the following terms and conditions:
a) In the event that WGP develops the parcel for a
gas processing plant and later WGP determines
that WGP no longer desires to operate said
plant, WGP shall notify Mr. and Mrs. Frank in
writing of that determination.
b) Within one hundred twenty (120) days from the
receipt of the written notification, Mr. and
Mrs. Frank may purchase the parcel for a price
to be calculated as provided in subparagraph C
below, less any liens or encumbrances. Closing
shall be had within thirty (30) days of Mr. and
Mrs. Frank' s election to purchase, at a time and
place to be mutually agreed upon. Closing costs
and prorates shall be assessed the parties,
respectively, as in a usual real estate sale.
c) The purchase price shall be calculated as
follows: MAI appraised price at time of
repurchase, minus one-half the difference
between the original purchase price and the MAI
appraised value. (Assuming the MAI appraised
value is higher than original purchase price.
If lower , the MAI appraised value will be the
selling price. )
The MAI appraiser will be chosen by both
parties. If both parties do not agree upon a

MAI appraiser, then each party will select an
appraiser and the two appraisers will select a
third. The average of the three appraisals will
be the appraised value. Each party shall pay
one-half of the total cost of the MAI appraisal ,
whether the sale is consummated or not. The
decision of the appraisers shall be binding on
the parties, their successors and assigns.
d) In the event that WGP does not develop the
parcel for a gas p'ocessing plant, and
determines they will not need the parcel for
that purpose in the future, WGP shall notify
Mr . and Mrs. Frank in writing of that
determination.
7 . WGP shall have the sole responsibility, and shall
bear the entire cost, for obtaining any and all
governmental approvals and permits for their use of
the above described parcel .
8 . Nothing herein shall be deemed to grant WGP any
easements or rights of way over or across any lands
other than the parcel described above.
9 . Unless otherwise advised in writing, either party may
send or deliver any notices anticipated by this
Agreement to the addresses as listed in the
introductory paragraph above.
10 . Both parties agree and understand that this Agreement
is strictly contingent upon those conditions as
outlined in paragraph 1 of this agreement. If any of
the conditions outlined in said paragraph are not
met, then this Agreement shall be null and void.

11 . WGP agrees to provide Mr. and Mrs. Frank with a
maximum of gallons of NGL (propane) per year .
The propane will be delivered to the Farmhouse of Mr .
and Mrs. Frank when and as needed throughout the
year .
WGP shall purchase, at no cost to Mr . and Mrs. Frank ,
a trailer ( including payment of its upkeep and
registration) , a 250 gallon propane tank, and all
hoses and valves necessary to provide said propane to
Mr. and Mrs. Frank.
The 250 gallon tank and trailer are provided for the
sole use by Mr. and Mrs. Frank, their family, and
employees, and may be used for any purpose they
desire, including but not limited to, heating their
home, barn or any other building on their farm,
operating a pickup, tractor, water pump, weed burner ,
etc.
The right to gallons of NGL (propane) per year
shall remain in effect as long as the gas plant is in
operation. The right to said propane shall remain
with the farm house and buildings as long as it is
owned by Mr . and Mrs. Frank, their family, or their
heirs. The right to said propane will remain with
the farm house and buildings if it is rented out, but
still owned by Mr . and Mrs. Frank, their family, or
their heirs. The right to said propane will
terminate only upon cessation of plant operation or
upon sale by Mr. and Mrs. Frank of said farm house
and buildings to a third party who is not a family
member or heir.
12 . The above described five (5) acres shall be surveyed,
and said survey shall be attached to, and recorded
with, the Warranty Deed at the time of sale.

WGP shall pay all costs to survey the site, and all
costs associated with the transfer of said land by
deed.
13 . This Agreement shall be binding upon all heirs,
successors, and assigns of the parties hereto. In
the event a court of competent jurisdiction shall
rule that any part of this Agreement is invalid, all
other provisions hereof shall remain in full force
and effect. This Agreement, when executed, shall be
recorded in the records of the Weld County Clerk and
Recorder, and shall be deemed to run with the land
above described.
