RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION NO. 1177 - MARTIN PRODUCE
COMPANY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 1177, does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1177 was
submitted by Martin Produce Company for property which is located
in part of the NW} , Section 23, Township 4 North, Range 66 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall he provided by the applicant and
known as Exhibit "A" , said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately six acres and less than one acre.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions: 1) The applicant shall
submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The
plat shall be drawn in accordance with the requirements of Section
9-2C. (4) of the Weld County Subdivision Regulations . The plat
shall be submitted within sixty days from the date of approval by
the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees; and 2) All sewage
disposal facilities shall be installed and maintained in
compliance with the Weld County Individual Sewage Disposal
Regulations.

Dear Commissioners:
This request for a Recorded Exemption is submitted by Martin Produce
Company. The parcel of land on which this request is being made is
described as part of the NWi of Section 23, T4N, R66W of the 6th P.M. , Weld
County, Colorado. The property is located approximately .25 miles east of
U.S. Highway 85, south of and adjacent to Weld County Road #44. The parcel
under consideration is the total contiguous land holdings of the applicant.
The request is to divide the property into two (2) parcels of 6.366 acres,
more or less, and .878 acres, more or less. An onion storage and processing
facility is located on the proposed larger parcel. A Weld County grader
shed and residence is proposed on the smaller parcel. No residences are
located on the property at this time.
The Weld County Health Department has reviewed the application materials and
have no objections to the request. An engineer designed septic system is
proposed for the smaller lot.
Section 9-2 E. (1) (e) of the Weld County Subdivision regulations require
that parcels less than one (1) acre in size be specifically exempt by the
Board. The applicant is requesting the creation of a lot measuring .878
acres.
The staff recommends that the Board of County Commissioners consider this
request and determine if the standards of Section 9-2 E. (1) (a) through (m)
of thee Weld County Subdivision Regulations have been met.

MARTIN PRODUCE RECORDED EXEMPTION
1 . A complete application form, certificate of conveyance, and a deed are
included with this application material.
2. The purpose and reason for dividing the lot into two separate parcels
is to sell off the portion of the lot that is not part of the onion
storage and processing operation for a Weld County grader shed. This
portion of the lot is odd in shape and too small to be used for a
productive farming operation or the onion storage. This land split
will eliminate property maintenance problems with this portion of the
lot.
3. This proposal is consistent with the policies of the Weld County
Comprehensive Plan Urban Growth Boundary -area. Art Pendergraft, Mayor
of Gilcrest, indicated in a phone conversation on June 16, 1989, that a
recorded exemption within a mile would be consistent with the Towns'
Comprehensive Plan, but would be reviewed by the Town's Board of
Directors. Mr. Pendergraft also indicated that at -this time the town
does not anticipate expansion of the incorporated boundaries to the
north. The proposal is consistent with the Weld County Comprehensive
Plan's Transportation and Public Facilities and Services Goals and
Policies. The proposal, when approved, will not cause adverse impacts
on Weld County Road 44 or on public facilities and services within this
area.
4. The proposal is consistent with the intent of the A (Agricultural) zone
district. The use of the parcel will remain agricultural in nature and
will not impair agricultural production. The size of the parcels, the
geographic location between the Western Mutual Ditch and Weld County
Road 44 and the onion storage and processing facility does not leave
sufficient land for productive farm production.
5. The proposed uses are compatible with the existing surrounding land
uses. These uses include railroad tracks, agricultural storage
facility, rural residence, farm production, and the Western Mutual
Ditch.
6. The proposed use as a Weld County grader shed is compatible with the
future development of the surrounding area as permitted by the existing
A (Agricultural) zone and with the Comprehensive Plan of Gilcrest.
7. The location adjacent to an existing irrigation ditch, existing onion
processing and storage facility, Weld County Road 44, and existing
rural -residences makes the proposed land split consistent with
efficient and orderly development.

8. The existing and future water supply is provided by Central Weld County
Water. A new water tap will be installed for the County grader shed
and -mobile home. The sewage disposal system will be an engineered
designed septic system installed in accordance with Weld County Health
Department regulations.

the Weld County Airport Overlay District.
