HomeMy WebLinkAbout851320.tiff n RESOLUTION RE: APPROVAL OF SECOND AMENDMENT TO RECORDED EXEMPTION NO. 77 - STANLEY AND LINDA RECH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners , on the 15th day of August, 1973 , approved Recorded Exemption No. 77 for Stanley and Linda Rech concerning property described as Part of the W1 SW1, Section 22 , Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, Stanley and Linda Rech are now requesting that Recorded Exemption No. 77 be amended a second time in order to add twenty-four acres to the existing oil field disposal operation, and WHEREAS , the Board of County Commissioners has studied said request to amend Recorded Exemption No. 77 and deems it advisable to approve same. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the second amendment to Recorded Exemption No. 77 , requested by Stanley and Linda Rech, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2 E. of the Weld County Subdivision Regulations. The parcel of land on which this request is being made is described as part of the W#6 SW1 of Section 22, T2N, R66W of the 6th P.M. , Weld County, Colorado. This request is being done in conjunction with Amended Recorded Exemption #616. The applicants are amending RE-77 in order to add twenty-four (24) acres to the existing oil field disposal operation. Approval of the amended recorded exemption will not create any additional residential building sites. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1 . The impact on surrounding agricultural land-uses does not appear to be significantly different than the original request approved on August 15, 1973 or the first amendement as approved on March 24, 1976. 2. The request complies with Section 9-2 E. of the Subdivision Regulations. This request to amend the Recorded Exemptions is being sought for the purpose of transferring 24 acres of property in the Southwest corner of Section 22, Township 2 North, Range 66 West from Adolph and Bettye Anderson to Linda and Stanley Rech. The transfer of property is being completed as a result of a lawsuit filed by Andersons against Rechs regarding a dispute in the operation of an oilfield waste disposal pit located on Rechs' property. Rechs currently own a 20 acre parcel 330 feet wide and 2,638 feet long immediately to the east of Andersons' property. The 24 acre parcel which is proposed to be transferred from Anderson to Rech is located adjacent to the disposal site and is roughly a square 24 acre parcel. No building permit or change in use in the property to be transferred is being sought at the present time. The property is currently zoned agricultural and its use will continue as agricultural, however, it is only marginally useful as agricultural land. Your consideration will be appreciated. Statement of Purpose To allow Stanley Rech and Linda Rech to purchase an additional 24.675 acres and add the same to a parcel owned by them, RE 13O9-22-3-RE 77. 5. Consistency with Weld County Comprehensive Plan The present use of the parcel to be acquired is consistent with the use of the existing property by Stanley Rech and Linda Rech. 6. Consistency with Intent of Agricultural District The present and intended use is consistent with the present zoning. 7. Compatibility with Existing and Surrounding Uses The present and future intended use is consistent with present zoning. 8. Compatibility with Future Development The property is adjacent to a variety of existing uses, i.e. , racing dog kennel, oil field disposal operations and agricultural operations. 9. Consistency with Orderly Development Any future development would not be totally inconsistent with neighboring uses. 10. Water and Sewage Disposal There is currently on Lot 2 a well and a septic system which serves the residents on that lot. No change in the use of Lot 2 is anticipated at the present time and the water and sewage facilities will not be changed as a result of this application.
