RE: ACTION OF THE BOARD REGARDING SUBSTANTIAL CHANGE IN THE
CERTIFICATE OF DESIGNATION TRANSFERRED TO McMILL, INC. , AND
REQUEST FOR EXTENSION OF TIME
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 8th day of
November, 1989 , at the hour of 10 :00 a.m. in the Chambers of the
Board for the purpose of considering whether or not there has been
substantial change in the facts and circumstances regarding the
Certificate of Designation issued to McMill, Inc. ; and the
applicant' s request for a one-year extension for the operation of
the Eaton Landfill, and
WHEREAS, said hearing concerned the Certificate of
Designation granted on the following described real estate,
to-wit:
Part of the SEI of Section 21 , Township 7
North, Range 65 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, the applicant was represented by Thomas E.
Hellerich, Attorney, and
WHEREAS, at the hearing of November 8, 1989, Mr. Hellerich
requested that the Board grant an eighteen-month extension for the
operation of the Eaton Landfill, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request
of the applicant and, having been fully informed, finds that there
has been substantial change in the facts and circumstances
concerning the Certificate of Designation which was transferred to
McMill, Inc. by the Board of County Commissioners on October 14,
1987 , and
WHEREAS, the Board deems it advisable to grant McMill, Inc. ,
an eighteen-month extension for the operation of the south area of
the Eaton Landfill, said extension to come into effect on October
14 , 1989, and

WHEREAS, the Board further directs that all tires stored on
the property shall be removed by June 30, 1990.
NOW, THEREFORE, BE IT RESOLVED that the Board of County
Commissioners of Weld County, Colorado, does Find that there has
been substantial change in the facts and circumstances regarding
the Certificate of Designation which was transferred to McMill,
Inc. , by the Board of County Commissioners on October 14, 1987 .
BE IT FURTHER RESOLVED by the Board that an eighteen-month
extension for the operation of the south area of the Eaton
Landfill be, and hereby is , granted, said extension to come into
effect from October 14 , 1989.
BE IT FURTHER RESOLVED by the Board that all tires stored on
the property shall be removed by June 30, 1990 .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 8th day of
November, A.D. , 1989 .

A public hearing was conducted on November 8, 1989, at 10:00 A.M. , with the
following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 23, 1989, and duly
published November 2, 1989, in The New News, a public hearing was conducted
to determine whether or not there has been substantial change concerning the
Certificate of Designation transferred to McMill, Inc. , on October 14, 1987;
and to consider the applicant's request for a one-year extension for the
operation of the Eaton landfill. Lee Morrison, Assistant County Attorney,
made this matter of record. Mr. Morrison advised that the first portion of
the hearing should consider only the matter of substantial change. Wes
Potter, of the Weld County Health Department, said his staff has reviewed
the situation and determined approximately 12,500 cubic yards are still
available which, at the current rate of usage, would allow for approximately
one more year of fill activity. He attributed this to a combination of less
material having been received than anticipated and the use of better
compaction materials. Thomas E. Hellerich, Attorney, came forward to
represent McMill, Inc. He presented a report from Hunter Environmental
Services and Engineering, marked by Mr. Morrison as Exhibit A, which shows
approximately 14,800 cubic yards of available volume. No public comment was
offered concerning this matter. Commissioner Lacy moved to find that there
has been substantial change in the facts and circumstances for the
Certificate of Designation transferred to McMill, Inc. , on October 14, 1987.
Seconded by Commissioner Kennedy, the motion carried unanimously.
The Board next considered the request of McMill, Inc. , for a one-year
extension for the operation of the Eaton Landfill. Mr. Potter stated that
the Health Department would have no objection to a one-year extension, but
the applicant needs to explain plans for the removal of the tires which have
been stockpiled for some time. Mr. Potter said these tires were to have
been removed prior to this time. Mr. Hellerich stated that, at the current
rate of usage, it may take more than a year to fill the remaining available
space, and he asked the Board to consider an eighteen-month extension. Mr.
Hellerich presented petitions, marked as Exhibit B, signed by adjacent
landowners and users of the landfill. Addressing the issue of the
stockpiled tires, Mr. Hellerich presented Exhibit C, a copy of a letter from
Southwestern Portland Cement Company and a Tire Shredding Agreement with
R.E.C.O.A. , Inc. Mr. Hellerich said McMill, Inc. , anticipates the sale of
the tires by June 30, 1990, and that no tires are currently being accepted,
nor have they been accepted during the last two years of operation. Steve
Sullivan, of R.E.C.O.A. , Inc. , said his firm has received a permit from the

City of Greeley for the shredding of tires, and that the shredded tires will
be delivered to Southwestern Portland Cement Company. He said his firm is
capable of shredding 1,200 tires per day, and the tires will be transported
to his premises just prior to being ground. He estimated that it would take
about 45 days to grind all the tires currently at the Eaton Landfill site.
Chairman Pro-Tem Brantner asked Mr. Potter if he would have a problem with
extending this Certificate of Designation for more than a year. Mr. Potter
stated that he would have no problem with a longer extension, but he feels a
specific date needs to be set for the closure of the landfill as well as a
specific date for the removal of all tires. Mr. Potter also stated that the
operation of the landfill has improved over the last two years. No public
comment was offered concerning this request. Mr. Morrison advised that an
extension of time needs to be clarified as to whether it is an extension
from this date or from the date the transfer of the Certificate of
Designation expired. Commissioner Lacy moved to grant an extension of the
Certificate of Designation for the south fill area of the Eaton Landfill,
for eighteen months, beginning October 14, 1989, and to order that all tires
shall be removed from this site by June 30, 1990. The motion was seconded
by Commissioner Kennedy, and it carried unanimously.
This Certification was approved on the 13th day of November, 1989.

held in the Chambers of the Board of County Commissioners of Weld County,

Subject: Eaton Landfill
Please find attached a letter from Tom Hellerich representing
McMill , Inc. , the holder of the Certificate of Designation for the
Eaton Landfill. They have requested an extension of time for one
additional year for the operation of the Eaton Landfill. This
memo is to ask what procedure you would favor in terms of hearing
this matter. I asked Mr. Hellerich to prepare his request based
on the provisions in our Administrative Code which allow a
rehearing where there is substantial new information which could
not have been available at the time of the original decision. The
question is whether you wish to combine the hearing to determine
whether there is new information not previously available with a
hearing to determine whether to grant the extension or whether you
wish to have the matter considered in two separate hearings.
There would be publication for adjacent landowners prior to the
hearing to determine whether to reconsider your Resolution of
October 14, 1987 , and you could either proceed immediately to the
issue if you decided to grant the rehearing or have additional
time before the hearing to determine whether to grant the
extension.

Gentlemen:
In my letter of October 4 , 1989, I requested on behalf of
McMill, Inc. , that the Eaton Landfill be granted a hearing
regarding the change in circumstances to enable the landfill to
remain open. It has come to my attention that I neglected to
request that during the interim period until a hearing can be
held, that the landfill remain open.
Please accept this letter as our request that no action be
taken at this time to close the landfill until such time as a
hearing can be held on our request. Further, please accept this
as our position that any continuation of the landfill until the
hearing is held will not be deemed or construed by McMill , Inc.
as a waiver of the right of the County to proceed with closure of
the landfill in the event that is the determination at the
hearing. I would appreciate your processing this request at the
earliest possible convenience.

Gentlemen:
Our office represents McMill, Inc. , the holder of the
Certificate of Designation for the Eaton Landfill. On
October 14 , 1987 , the Board of County Commissioners passed a
resolution which contained in part, based upon the information
provided at the hearing, that the landfill would be closed when
the south fill area was filled, or two years from the date of the
resolution, whichever was earlier. The two year period, as I
recall, was inserted into the resolution based upon the
information we believed was provided to the Board, that the
landfill would in fact be filled prior to the two-year time
frame.
At that time, these estimates were made based upon the
information available, and since the resolution was adopted, more
current information has provided that the landfill is, in fact,
not full, and there remains a portion of the south landfill area
to be filled. We anticipate that the additional time to fill
this portion of the landfill would consist of approximately 9 to
12 months at the current rate of intake.
This Petition is a request for an extension of the time to
fill the existing landfill for an additional 12 months. This
request is based upon this new information, and is also based
upon a change in circumstances, being that the anticipated amount
of material received was less than anticipated, and also the
compaction of the material delivered has been at a greater
efficiency, thus resulting in the remaining portion to be filled.
Please accept this Petition as a request for a modification
of paragraph 2 of the resolution, which provides for the closure
of the landfill on the filling of the landfill or

October 14 , 1989. We believe that an extension will benefit the
entire neighborhood surrounding the landfill, including the
metropolitan areas. Your attention to and processing of this
Petition is appreciated. I would appreciate your providing me

Dear Mr. Miller:
Attached is a brief report presenting the results of a field investigation conducted at Eaton landfill on
September 15, 1989. The investigation included the collection and analysis of six groundwater samples,
inspection of four test trenches, two percolation tests, and one infiltration test. The results of the
investigation are summarized below:
1. Groundwater samples collected upgradient and downgradient from the landfill showed no
apparent degradation of groundwater quality. Samples collected in September 1989 also
showed no apparent degradation relative to previous groundwater samples collected from
the site.
2. Adequate cover material of a similar quality to the cover used on the previously filled area
is available onsite to provide for the 3 feet thick final cover layer over the remaining fill
area.
The available volume in the current landfill is approximately 14,800 yd'. At current filling rates and at
currently achieved compaction density, this volume is sufficient for approximately one year to eighteen
months. It is probably that the increased landfill life has resulted from lower fill rates and higher
compaction density than estimated in the Operation Plan.

1.0 INTRODUCTION
Eaton landfill is an existing solid waste facility currently being operated by McMill, Inc. under Certificate
of Designation No. 17 (amended). The landfill operation and environmental monitoring program are
described in the Operations Report. prepared by Warzyn Engineering, Inc. and submitted to the Colorado
Department of Health on August 6, 1987.
The Eaton facility covers approximately 32 acres and is located about three miles northeast of Eaton in
the southeast one-fourth of Section 21, T7N, R65W, Weld County, Colorado. The Eaton landfill handles
nonhazardous municipal refuse from the town of Eaton and the surrounding area. The site is bounded on
the north, west, and east by irrigated farmland and on the south by a county road.
The northern two-thirds of the site has been brought to final grades, covered. and is under cultivation.
The south one-third of the site currently is being filled.
The subsurface geology at the Eaton landfill site consists primarily of Quaternary-age wind and stream
deposits of gravel, sand, silt and clay. Bedrock units were not encountered during the drilling program
conducted in 1987. The Quaternary deposits consist of loose, brown, fine sandy silt to dense, pink, coarse
sand with little fine to coarse gravel. The soil classifications for the Quaternary deposits range from silty
or clayey fine sands, ML, to silty to clean sands, SM to SP. using the Unified Soil Classification System
(USCS).
The landfill is being operated without lining the subsurface, and the Operations Report prepared by
\Varzyn Engineering states, in Section 4.6.2, that "existing site operations do not require placement of a
liner". The current investigation was undertaken to evaluate existing impacts on the groundwater and to
investigate the subsoil conditions in the area. The results of the investigation are presented below.

2.0 SOIL CONDITIONS
Four backhoe trenches were excavated in the proposed expansion area. The trenches were inspected and
logged to determine the extent of low permeability material beneath the proposed landfill expansion. In
addition, two percolation tests and one double ring infiltration test were conducted to estimate the
hydraulic conductivity of the subsurface material. Trench and test locations are shown on Figure 2.1.
Logs of the test trenches are presented on Figures 2-2 through 2-5. Soil conditions beneath the proposed
expansion area were found to be similar to those at the currently operating site.
2.1 SOILS
The soils encountered in the trenches were composed of sand, silt, gravel, and trace amounts of clay. The
test pits indicate that a layer of relatively low permeability silty sand, SM material in the USCS, exists
beneath the proposed bottom of the fill area. This layer appears to be continuous and is composed of a
very silty, fine to medium grained sand with traces of gravel and clay. Beneath this relatively low
permeability layer is a poorly sorted coarse sand with gravel ranging to 3/4 inches in diameter. The
thickness of this relatively permeable sand and gravel layer is unknown.
The soils encountered in the test trenches are consistent with the soils encountered when completing the
monitor wells during the previous investigation by Warzyn.
Approximately 4,200 cubic yards of poorly graded to silty sand, SM/SP, material suitable for final cover is
stockpiled at the site. An additional volume of approximately 19,000 cubic yards are available in the
agricultural area to the east of the landfill. Approximately 4,500 cubic yards of material will be required
for final cover of the unfilled portion of the operating landfill.
2 PERMEABILITY
Standard percolation tests were run adjacent to text trenches 1 and 2. The percolation tests were run in
holes below the proposed landfill bottom. approximatey 3 feet deep by 5 inches in diameter. The
measured percolation rates were 7.5 inches per hour and 9.8 inches per hour in holes 1 and 2, respectively.
A double ring infiltrometer test was conducted at the base of the proposed landfill adjacent to test trench
number 3. The test utilized 8 and 18 inch diameter rings and approximately 2 inches of head. The
measured infiltration rate was 0.48 in/hr (Figure 2-61.

Sites for percolation and infiltration tests were selected to be representative of the material beneath the
proposed fill area. Baildown tests were conducted on the three monitor wells installed in 1987 and are
described in the Operations Report (Warzyn, 1987). It was reported that hydraulic conductivities
estimated from these tests were 5 x 10'° cm/sec (1 in/hr) at I\IW3, 1 x 10'2 cm/sec (14 in/hr) at M\V2, and
7 x 10'' cm/sec (10 in/hr) at MNl. This range of permeability estimates is similar to estimates resulting
from the percolation and infiltration tests conducted at the proposed expansion area.

3.0 GROUNDWATER
Based on groundwater elevations measured on June 20, 1984 and on September 15, 1989 (Table 1),
groundwater flow beneath the Eaton landfill is to the southeast. Background groundwater conditions are
represented by MW1, the upgradient monitor well.
The Eaton landfill is surrounded by irrigation wells. A list of wells located within 1 mile of the site is
presented on Table 2. Three irrigation wells and the three existing monitor wells were sampled during the
current investigation on 09/15/89. Monitor wells were sampled utilizing a bottom discharge stainless steel
bailer. A minimum of two casing volumes were removed prior to sample collection. Irrigation wells were
sampled after allowing the wells to pump a minimum of 15 minutes. Groundwater sampling forms may be
found in Appendix A.
Each of the samples was analyzed by Hunter Analytical Laboratories in Englewood, Colorado for the
following constituents: TDS, Nitrate, Nitrite, Nitrogen. Oil and GR, IR, TPH, Carbonate Ion, Bicarbonate
Ion, Calcium, Manganese, Sodium, Potassium, Copper, Zinc, Lead, Iron, and Mercury. Conductivity and
pH were measured in the field prior to sampling.
The Circle M irrigation well is located upgradient from the site and represents background conditions.
The Clarke and Bass wells are located downgradient. The results of the current sampling as well as
previously reported results from June, 1984 are presented in Table 3.
Samples collected from the monitoring wells do not indicate any degradation in the groundwater quality
_ due to the landfill nor any significant change in the water quality since the last sampling period in 06/84.
The only potential landfill impact on the monitor wells is the oil and grease level detected at EMW-2. The
explanation for this anomaly is unknown. Nitrate is also evaluated in EMW-2. This is probably the result
of agriculture (fertilizer use) rather than the landfill leachate. The upgradient monitor well, EMW-1. is
higher in TDS and most constituents than either of the downgradient monitor wells. Exceptions to this
are bicarbonate ion and potassium for which the upgradient monitor well is slightly lower.
The upgradient irrigation well sampled, the Circle M well. contained concentrations within the range of
those tound in the downgradient wells for all constituents. The irrigation wells sampled did not indicate
any landfill contamination.

Dear Steve:
We are in the final stages of receiving our Certificate of
Designation from Boulder County, and our revised Air Pollution
Emission Notice from the Colorado Department of Health.
We received permission to burn tires in October 1989 and have
burned shredded tires since.
We plan to continue burning tires as long as the shredded tires
are available and economical for us to use.
We plan to burn approximately 5000 shredded tires per day. We
must have a steady supply of material so not to upset our
operations and also be able to budget for our other fuel sources.
If you feel that you can be a part of the suppliers of shredded
tires, please let us know.

TIRE SHREDDING AGREEMENT
This agreement enter into this .:CO�pday of (&2,2x.'1989 by and between
Eaton Gravel Inc. and R.E.C.O.A. , Inc. for pure is of of shredding and
hauling approximately/), SOO tires naa located on the Eaton Gravel Inc.
property.
The following are the specific terms and conditions of the agreement;
1) . R.E.C.O.A. Inc. shall begin shredding operations on the above
referenced tires no later than 07.0_ / _19419 and shall
complete said work no later thafi /pole ,30 1979 with weather
permitting.
2) . R.E.C.O.A. Inc. , shall also haul and dispose of. the shredded
material by sale to Portland Cement Plant in Lyon, Colorado.
Any irncme generated by this sale is the sole property of
R.E.C.O.A. Inc.
3) . All costs which may arise outside of the normal expenses shall
be paid by Eaton Gravel Inc. , such as electric hook-ups and
unforseen costs that may occure beyond the control of R.E.C.O.A.
4) . Eaton Gravel Inc. agrees to pay to R.E.C.O.A. Inc at fee of
$1.00 (one dollar) per tire shredded and is payable no later than
30 days of completion of all work.
All parties agree to the above agreement and have acknowledged this
agreement by signing below.
