RE: APPROVE CONTINUANCE OF HEARING TO CONSIDER USE BY SPECIAL
REVIEW FOR A RECREATIONAL TRAIN FACILITY - CHARLES HOBDAY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 25th day of March, 1987 , at the hour of 2 : 00 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Charles Hobday, 1443 South Harlem, Forest Park ,
Illinois 60130 , for a Use by Special Review for a recreational
train facility on the following described real estate, to-wit:
Part of the SEa of Section 30 and the Eh E2 of
Section 31 , Township 2 North , and the E? Eh
NEa of Section 6 , Township 1 North , all in
Range 65 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, said applicant was represented by Don Drawer, and
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners , after reviewing
the materials submitted by Mr. Drawer, deemed it advisable that
said hearing be continued to April 15 , 1987 , to allow the Planning
staff additional time to work with Mr. Drawer to identify those
items to be removed from the property and those items which will
remain .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to
consider the request of Charles Hobday for a Use by Special Review
for a recreational train facility be , and hereby is , continued to
April 15 , 1987, at 2 : 00 p.m.

RE: USE BY SPECIAL REVIEW FOR A RECREATIONAL TRAIN FACILITY - CHARLES
HOBDAY
A public hearing was conducted on March 25, 1987, at 2:00 P.M. , with
the following present:
Commissioner Gordon E. Lacy, Chairman
Commissioner C.W. Kirby, Pro-Tem
Commissioner Gene Brantner
Commissioner Jacqueline Johnson
Commissioner Frank Yamaguchi
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Planning Department representative, Keith Schuett
The following business was transacted:
I hereby certify that pursuant to a notice dated February 11, 1987, and
duly published February 19, 1987, in the Johnstown Breeze, a public
hearing was conducted to consider the request of Charles Hobday for a
Use by Special Review for a recreational train facility. Lee Morrison,
Assistant County Attorney, made this matter of record and stated that
this hearing was continued from March 4 to allow time for both the
applicant and the Planning staff to submit additional materials. Keith
Schuett, Planning Department representative, said the Planning staff
received a list of materials on the property after 1 :00 today and,
after review, feels that this list still does not comply with Condition
#3. Commissioner Johnson pointed out that this list has not been
verified by the Planning Department, and she had understood the list
was to be submitted in time for the Planning staff to verify the items
to be discarded and the items to remain on the property. Don Drawer,
representing the applicant, stated that the list submitted today
indicates the items to remain on the property, and the list of items
submitted at the earlier hearing includes the items to be discarded.
Mr. Schuett said the staff needs a complete list of all items currently
on the property for an on-site review, and that pictures could be taken
as a part of this review. Mr. Schuett said the Planning Department has
received a copy of a well permit application which has been submitted
to the Colorado Division of Water Resources, and he presented the Board
with suggested additional Development Standards addressing the issue of
water on the site. Wes Potter, representing the Health Department,
explained to the Board how these standards were developed. Mr. Drawer
stated that the additional standards are acceptable to him. Mr. Drawer
also advised the Board that he has checked into the cost of liability
insurance, as required by Development Standard #13, and requested that
this insurance not be required until the facility is open. After
discussion, Commissioner Johnson moved to amend Development Standard
#13 by adding the words, "At such time as the facility is open to the
public" to the beginning of this standard. Seconded by Commissioner
Kirby, the motion carried unanimously. Commissioner Johnson moved to
amend Development Standard #6 to include the new standards a, b, and c,
as presented by the Planning staff at this hearing. The motion was
seconded by Commissioner Brantner and carried unanimously. No public
comment was offered concerning this request. Commissioner Johnson
moved to amend Condition #1 to require that the right-of-way for Weld
County Road 39 shall be shown on the Use by Special Review plat. The
motion was seconded by Commissioner Kirby and carried unanimously.
Commissioner Kirby moved to continue this hearing to April 15 at 2:00
p.m. to allow time for the Planning staff to review the items located

on the site. The motion was seconded by Commissioner Johnson and
carried unanimously. Chairman Lacy directed the Planning staff to work
with Mr. Drawer to create a list of all items on the property and take
photographs as deemed necessary to document the items which are to
remain.
This Certification was approved on the 30th day of March, 1987.
