RE: RURAL SUBDIVISION ROADS IN WELD COUNTY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Weld County has several rural subdivisions in the
unincorporated areas of the County, and
WHEREAS, many of the rural subdivisions are in the
Comprehensive Planning areas of municipalities, and
WHEREAS , Article 30 , Section 20 , Part 6 , CRS 1973 , provides
that the Board of County Commissioners can create local
improvement districts similar to municipalities for the grading,
paving, curbing, guttering, drainage, or otherwise improving the
whole or any part of any street in the unincorporated area of a
county, and
WHEREAS, many citizens living in rural subdivisions require
or desire a level of road construction above normal county road
service levels for the benefit of the property owners of the
subdivision, and
WHEREAS, it is the practice of most municipalities to
create improvement districts for subdivision road upgrades and
once improved for the governmental entity to maintain the road
improvements until major upgrades or improvements are required.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County that rural subdivisions requiring
road upgrades or improvements to accommodate traffic or when
citizens of the subdivision request upgrades to existing roads,
that local improvement districts will be created and an
assessment made against the property owners benefiting from the
improvements.

BE IT FURTHER RESOLVED by the Board of County Commissioners
that Weld County shall only provide normal maintenance to
existing roads in rural subdivisions with Road and Bridge funds.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the County Engineer shall assess all existing rural
subdivisions and recommend to the Board of County Commissioners
the necessary improvements required of existing subdivision
roads to bring them up to an acceptable standard to accommodate
traffic and citizen requests in the subdivisions.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that , based upon the recommendations of the County Engineer,
where the Board of County Commissioners determines improvements
are required in subdivisions, local improvement districts will
be created to complete and pay for the necessary improvements of
subdivisions in the unincorporated areas of the County.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 12th day of
February, A.D. , 1986 .
