The state board further ordered you to develop a plan for the reappraisal effort and to meet with the state board on November 8, 1984, for their approval of the plan. The plan was presented to the state board on November 8, and the state board accepted the plan. Copies of the Order for Reappraisal and the Order Adopting the Plan are enclosed for your review. The Division of Property Taxation supervised the reappraisal for the State Board of Equalization. The 1985 Findings and Conclusions of the annual study auditor indicate that Weld County has complied with the state board order of reappraisal . The reappraisal is now complete, and the reimbursement provisions for any excess state aid to schools and the state costs of the 1985 reappraisal will be reviewed and payback ordered by the state board on November 13, 1985. A. Reimburse State Costs of the Reappraisal , 39-1-105.5(1) (a)(II), C.R.S. , provides: " If the study conducted pursuant to section 39-1-104(16) during the property tax year which commences January 1, 1984, shows that the assessor failed to reappraise such class or classes or failed in the reappraisal to meet the objections of the state board of equalization, the state board of equalization shall cause a reappraisal of such class or classes to be performed. Such reappraisal shall be performed during the property tax year which commences January 1, 1985. The general assembly shall make an appropriation to meet the cost of such reappraisal ; however, the board of county commissioners of the county shall , upon certification by the state board of equalization of such cost, reimburse the state usot,09 1313 Sherman Street, 623 Centennial Building, Denver, Colorado 80203 (303) 866-2371 �T , a - Weld County Assessor November 6, 1985 Page 2 for such cost if the reappraisal caused to be performed shows that the assessor did not value or assess such class or classes consistent with the provisions of the Colorado constitution or the statutes." (emphasis added) Max P. Arnold and Associates' 1984 Findings and Conclusions recommended reappraisal . The reappraisal conducted during 1985 reflected that the following deficiencies were also corrected: 1. Inventories were not accurate and current. 2. Cost approach had not been recalculated since implementation of the 1973 level of value. 3. Market approach had not been properly used to calculate land values. 4. Income approach was only used occasionally for testing purposes, not used consistently or uniformly. The state cost attributable to Weld County is $29,535.15. B. Reimburse Excess State Equalization Payments to School Districts , 39-1-105.5(1)(a)(III), C.R.S. , provides: "The reappraisal caused to be performed pursuant to subparagraph (II) of this paragraph (a) during the property tax year which commences January 1, 1985, shall be the county's abstract for assessment with regard to such reappraised class or classes for the property tax year which commences January 1, 1985. The state board of equalization shall order the board of county commissioners to levy, and the board of county commissioners shall levy, in 1985 for collection in 1986 an additional property tax on all taxable property in the county. Such additional levy shall be in an amount which is sufficient to reimburse the state for the excess state equalization payments made to school districts within the county during 1985. The board of county commissioners shall reimburse the state for such excess state equalization payments. Such excess shall be that amount of the state equalization payments actually paid by the state to the county during 1985 based on the incorrect 1984 valuation for assessment which amount exceeds the state equalization payments the state would have paid during 1985 had the 1984 valuation for assessment been determined by the assessor consistent with the provisions of the Colorado constitution and the statutes." (emphasis added) Weld County Assessor November 6, 1985 Page 3 The basis for determining the payback for excess state aid to schools is the abstract. We have supplanted the 1984 appropriate class values with the 1985 reappraisal values, less new construction if applicable. The school distribution was then run with the adjusted valuations to reflect what would have been distributed had the reappraisal values been in place in 1984. MAM:nkm SBOE #2 Enclosures BEFORE THE STATE BOARD OF EQUALIZATION , • STATE OF COLORADO • ORDER of REAPPRAISAL WELD COUNTY On October 23 , 1984 , the State Board of Equalization ( state board ) convened in the Old Supreme Court Chambers , State Capitol , Denver , Colorado , to review the findings and recommendations set forth in the valuation for assessment study conducted by Max P . Arnold and Associates , Inc . pursuant to 39-1 =1O4 ( 16 ) (a ) , C .R . S . , affecting Weld County . The following members of the state board were present : Kenneth D . Smith , Chairman ; Ted L . Strickland , President of the Senate ; and Carl B . "Bev" Bledsoe , Speaker of the House . The members set forth above by unanimous vote made the within findings and order . Due notice had previously been given to the public , the board of county commissioners and the county assessor . The study of Max P . Arnold and Associates , Inc . disclosed that Weld County had failed to reappraise commercial properties to the extent of meeting the objections of the state board . In 1983 , the state board had directed Weld County to reappraise residential property , commercial property , agricultural land , and mobile homes . Mr . Herb Hansen , Weld County Assessor , appeared and testified that he did not have sufficient staff to complete the reappraisal effort . After considering all of the evidence , the state board found and concluded that Weld County was duly issued an order to reappraise residential property , commercial property , agricultural property , and mobile homes in 1983 . The state board further found that Weld County ' s efforts in reappraising commercial property did not meet the objections of the state board . The state board then concluded that the findings and recommendations of Max P . Arnold and Associates , Inc . , which provided that an order of reappraisal of commercial property in Weld County should be issued , was supported by evidence , was appropriate , and should be adopted . • The state board proceeded to adopt the recommendation and specifically found that the study conducted pursuant to 39-1 -104 ( 16 ) , C . R . S . , during the property tax year which commenced January 1 , 1984 , established that the assessor failed to reappraise commercial property to the extent of meeting the state board ' s objections'. Accordingly , the state board ordered , pursuant to 39-1 -105 . 5 ( 1 ) (a ) ( II ) , C . R . S . , .that the commercial property in Weld County be reappraised during the property tax year commencing January 1 , 1985 . The state board further ordered that the reappraisal be under the supervision of the state board and directed that the county present a plan of reappraisal to the state board for consideration on November 8, 1984 . The board invited the board of county commissioners to participate in the formulation of the plan for reappraisal and to meet with the state board on Novmeber 8 , r984 , at which time the proposed plan would be discussed . Brewer Division of Property Taxation BEFORE THE STATE BOARD OF EQUALIZATION, STATE OF COLORADO ORDER ADOPTING A REAPPRAISAL PLAN FOR WELD COUNTY On November 8, 1984, the State Board of Equalization (state board) convened in Senate Hearing Room E, State Capitol , Denver, Colorado, to review the Weld County plan to conduct a reappraisal of commercial property, which reappraisal and plan were ordered by the state board on October 23, 1984, pursuant to 39-1-105.5(1) (a)(II) , C.R.S. The following members of the state board were present: Kenneth D. Smith, Chairman; Ted L. Strickland, President of the Senate; Carl B. "Bev" Bledsoe, Speaker of the House; and David Miller, Designee Governor Richard D. Lamm. The members set forth above, by unanimous vote, made the within findings and order. Due notice had previously been given to the public, the board of county commissioners, and the county assessor. H. H. Hansen, Weld County Assessor, provided the state board with a copy of his plan to reappraise commercial property during property tax year 1985, and testified that the reappraisal would be complete by May 24, 1985. Mr. Hansen requested that the state board accept a modification to the plan to the extent that the county would require five temporary appraisers instead of the four listed in the plan. This modification to the plan was necessary because of the number of large industrial facilities in the county that will require more time to reappraise. Mary Anne Maurer, Property Tax Administrator, testified that she had reviewed the modified Weld County plan to reappraise commercial property. Ms . Maurer stated that the Weld County plan was appropriate, qualified by the fact that the five appraisers hired by Weld County must be professional appraisers in order to accomplish the reappraisal of approximately 5,625 commercial and industrial properties, by May 24, 1985, to accomplish the ordered reappraisal of commercial property under the supervision of the state board, and she recommended that the state board accept the modified and qualified plan of Weld County. After considering all of the testimony, the state board found and concluded that the recommendation of the Property Tax Administrator, which provided that the Weld County modified plan was appropriate, as qualified by the hiring of professional appraisers , to accomplish the ordered reappraisal of commercial property, was appropriate and should be adopted by the state board. Accordingly, the state board voted, and by unanimous vote, accepted the modified Weld County plan, as qualified by the hiring of professional appraisers, to reappraise commercial property during 1985, pursuant to the state board's order of October 23, 1984, to reappraise commercial property under the supervision of the state board. The state board ordered that beginning on January 15, 1985, the Weld County Assessor submit a monthly progress report to the state board and the Property Tax Administrator. The state board further ordered that the Property Tax Administrator review these progress reports and submit a monthly response to the state board, with copies being submitted also to the county assessor and board of county commissioners.
