HomeMy WebLinkAbout880560.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1096 - JACKIE MALCOLM AND DOYLE PARLETT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS , as amended, did determine at a public meeting held in the Chambers of the Board , that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 1096 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 1096 was submitted by Jackie Malcolm and Doyle Parlett for property which is located in part of the NW} NW* , Section 9 , Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded , and WHEREAS, this request is to divide the property into parcels estimated to be approximately 10 acres each. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is , exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The parcel of land on which this request is being made is described as the part of the NW} NWi of Section 9, TIN, R68W of the 6th P.M. , Weld County, Colorado. The property is located approximately 1.5 miles northeast of the Town of Erie at the southeast corner of the intersection of Weld County Roads 12 and 5. This request is to divide a 20 acre tract of land, which is the total contiguous land holdings of the applicants, into two (2) lots of 10 acres each, more or less. It is the opinion of the Department of Planning Services' staff that sufficient reasons have not been given by the applicant to warrant creating an additional lot at this time. The Department of Planning Services' staff has concerns about the level of development and the potential for continued divisions occurring in this section. The staff would like the Board to be aware of the development pattern that has occurred in this area and whether it wishes to allow this type of piecemeal development to continue. There have been five Recorded Exemptions approved in this Section since 1973. In the west half of this section there are 27 parcels. Two additional Recorded Exemption applications are currently being reviewed by the department that are located in the west half of this section. Development in this area is reaching a level where continued divisions may evade the intent and purpose of the Weld County Subdivision Regulations. Residential development in rural areas necessitates an increased demand for road maintenance, police and fire protection, school busing, snow removal, utilities, and other urban services. The property is bounded on the North by Weld County Road 12, and on the West by Weld County Road 5. The property is currently zoned for Agriculture. There are no irrigation water rights with the property. The property lies within an area which is low density residential in nature. The majority of these properties are smaller than 10 acres in size. Purpose This application is made to the Weld County Department of Planning Services in order to allow us to divide the subject property into two (2) 10 acre agricultural lots. One lot would include the existing homesite, and one would be for a single family agricultural lot. A previous request was made for rezoning, which was subsequently withdrawn based upon staff recommendations and opposition from the Town of Erie. The size of the existing property and the fact that there are no irrigation water rights result in the fact that maintenance and use of this property for agriculture production is not economically feasible. It is too small to dry land farm and too large to maintain. The division of this property would create the most economical benefit. Policies This request is consistent with the Policies of the Weld County Comprehensive Plan in that the Plan permits low density development of non-prime agricultural land. The Plan allows a lot in the agricultural district to be divided into two separate lots to allow the property owner to sell off agricultural land that is nonproductive for a single family dwelling homesite. Zoning The property is currently zoned agricultural and would remain so for this proposed division. The property lies within an area which is low density residential in nature. The majority of the properties in the area are smaller than 10 acres. Parkland Estates is adjacent to the West and is zoned R-1. Other properties in the area are zoned agriculture. Adjoining agricultural uses will not be adversely affected by the proposed division. The property is in an area where most properties are small and do not support large scale agricultural production. 580560 Uses The uses anticipated on the properties would include those allowed by the Weld County Zoning Ordinance for Agriculture Zoning. Affected Municipalities The property lies within the influence area of the Town of Erie. The Comprehensive Master Plan for the Town of Erie designates that minimum lot size in this area be 10 acres. Previous discussions regarding this property have been held with the Town of Erie Planning Board. Orderly Development The division of this property will not be inconsistent with efficient and orderly development as no new roads or public utilities will be required. The majority of adjacent properties are already divided to the extent that Weld County and Town of Erie propose. Water and Sewer The property lies within the Boundary of the Northern Colorado Water Conservancy District. Left Hand Water Supply Company currently serves this property, and has indicated that taps are available for additional homesites on this property. A letter so stating is included. The existing homesite has an individual sewage disposal system consisting of a septic tank and leach field. The proposed homesite of 10 acres is adequate in size to accommodate an individual sewage disposal system. Physical Restrictions The site does not lie within a flood plain, Geologic hazard or Weld County Airport overlay district. An inactive fault is depicted across the southeastern extremity of the property through the area already constructed upon.
