Dear Mr. Crews:
Thank you for your letters of August 26 and 28.
The application materials on USR-&61:84:57 were submitted and reviewed at
two public hearings showing only one well proposed to be drilled on this 80
acre Special Review site. It is the determination of the Department of
Planning Services' staff that the drilling of an additional well would be
considered an expansion of the use and a material deviation from the use
allowed and would require an amendment to USR-661:84:57.
The drilling of infill wells on Special Review site 533:82:48 would also be
considered an expansion of the use and a material deviation from the use
permitted and would require an amendment. The conflict between Development
Standard #3 and the Oil and Gas Commission's spacing order should be
addressed at the time an amendment is submitted.

Dear Ms. Swanson:
This letter corrects my letter dated August 26, 1987, and is submitted to
request that the planning staff review the file in connection with USR-
533:82:48 to ascertain if the drilling of certain infill wells in the SE; of
Section 34 and the NW; of Section 3 might be allowed under the U.S.R. in light
of Colorado Oil and Gas Conservation Commission orders subsequent to the
filing of the U.S.R.
The area within the U.S.R. included all of both quarter sections upon which
drilling would take place. To bring you up to date, the following wells have
been drilled to date within the entire U.S.R. area: (1) Colton UPRR Camenisch-
Kanmmerzell in the NE;NW; of Section 3, (2) Sunshine Valley Dos Rios #14-34 in
the SE;SW; of Section 34, (3) Sunshine Valley Rumsey #16-34 in the SE qSE 4 of
Section 34. H & C Colton Company now desires to drill the allowed well in the
SW;SE; of Section 34, an infill well to it in the NW;SE; of Section 34, the
permitted well in the SW;NW; of Section 3, an infill well to it in the SE;NW;
of Section 3, an infill to the Camenisch-Kammerzell in the NW;NW; of Section
3, and an infill to the Sunshine Valley Dos Rios in the SW;SW; of Section 34.
Sunshine Valley Petroleum Corporation desires to drill an infill well to the
Rumsey in the NE;SE; of Section 34.
Colorado Oil and Gas Conservation Commission Order 407-1 et seq. provides that
the only legal locations for Codell/Niobrara wells are in the center (plus a
tolerance of 200 feet in any direction) of a governmental quarter-quarter
section within an 80-acre spacing unit comprised of the EZ and Wz, or NZ and
Sz, of a quarter section. This order has caused problems, because it was
entered in December of 1983. . .after the U.S.R. . .and drilling 300 feet from the
river is in some instances not possible without being in violation of Order
407-1. Permission is therefore requested to waive this standard if in
conflict with the OGCC rules and order.
It would seem that the requests of Colton and Sunshine Valley would not be a
material alteration to the terms of the U.S.R., since all parties were noticed
and the hearings were held on the basis of multiple oil and gas wells. Please
note that my request intentionally omits the NZSW; of Section 34. ..adjacent to
Dos Rios. This is a sensitive area, and we are of the belief that an
amendment would be appropriate for drilling in that 80-acre tract.

Request is hereby made on behalf of Sunshine Valley Petroleum
Corporation for your approval to trade the approved drill site in the
NE4SW4 of Section 34 for a site just south of the approximate center of
the SE*SW4 of the same section.
This change is necessary due to the fact that any location which is 300
feet from (and south of) the river, as required under the U.S.R. , is
not a legal location under Order 407-1 of the Colorado Oil and Gas
Conservation Commission, which order was entered in December of 1983.
The location of the substitute well would be in a wooded area much
farther from the Dos Rios Subdivision, and this change in location
would make some owners of nearby Dos Rios lots very happy!
Sunshine Valley will, if drilling is later desired in the NE4SW4, seek
a formal amendment to the U.S.R. with the necessary notices and
hearings.
I have penciled in, on the enclosed U.S.R. plat, the areas in which
each well. . .approved and substitute. . .can be legally located under
Order 407-1.
Your approval of the requested substitution will be sincerely
appreciated. If you have any questions, please let me know.

This is to confirm in writing my verbal request of yesterday that Sunshine
Valley Petroleum Corporation be allowed to drill the well currently approved
under USR:533-82-48 in the NE4SE4 of Section 34 instead in the approximate
center of the SE4SE4 of Section 34, Township 5 North, Range 66 West.
Sunshine Valley Petroleum Corporation has an agreement with H & C Colton Company
to drill a well in the ESE and is experiencing difficulty gaining access to
the approved location due to its location very near the South Platte river.
Approving the well in the SE4SE4 will further remove it from the river and the
problems associated therewith, will result in the well being located even
farther from residential areas, and will help to elevate it a bit more to avoid
flooding problems.
This is an emergency request, since a lease expiration is involved and there is
not time to negotiate and purchase a right of way from a landowner outside of
the area covered by the USR to get to the approved location.
The requested location is in compliance with Order 407-1, as amended, of the
Colorado Oil and Gas Conservation Commission.
