RE: APPROVE SPECIAL REVIEW PERMIT FOR A SINGLE FAMILY DWELLING
UNIT ON A PARCEL LESS THAN THE MINIMUM LOT SIZE IN THE A
(AGRICULTURAL) ZONE DISTRICT - MICHAEL AND SANDIE PALLOTTO
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 29th day of February, 1988 , at the hour of 9 :30
a.m. in the Chambers of the Board for the purpose of hearing the
application of Michael and Sandie Pallotto, 7261 Weld County Road
54 , Johnstown, Colorado 80534 , for a Special Review permit for a
single family dwelling unit on a parcel less than the minimum lot
size in the A (Agricultural) Zone District on the following
described real estate, to-wit:
Part of the SW* , Section 19 , Township 5 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, said applicant, Michael Pallotto, was present, and
WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review permit, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicants and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 .7 of the Weld
County Zoning Ordinance .
2 . It is the opinion of the Board of County Commissioners
that the applicants have shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a . The proposal is consistent with the Weld County
Comprehensive Plan in that low density residential
development is permitted on non-prime agricultural
land as recognized by the Soil Conservation
Service . The soils capability subclass designation
for the majority of the proposed site is IVe, which

indicates limitations that make the site unsuitable
for prime agricultural production.
b. The proposed use is consistent with the intent of
the Agricultural Zone District and is provided for
as a Use by Special Review.
c. The uses which will be permitted by the Special
Review permit will be compatible with the existing
surrounding land uses and with the future
development of the surrounding areas as permitted
by the A (Agricultural) Zone District.
d. The area of the Special Review permit is not
affected by any Weld County Overlay District.
e. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Special Review permit for a single family dwelling unit on a
parcel less than the minimum lot size in the A (Agricultural) Zone
District on the hereinabove described parcel of land be, and
hereby is , granted subject to the following conditions:
1 . The attached Development Standards for the Special
Review permit be adopted and placed on the Special
Review plat prior to recording the plat.
2 . The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat has been
delivered to the Department of Planning Services Office
and the plat is ready to be recorded in the office of
the Weld County Clerk and Recorder.
3 . Prior to the issuance of building permits, a copy of an
approved agreement with the Hill and Brush Ditch Company
on the proposed bridge crossing shall be submitted to
the Department of Planning Services.
4 . Prior to recording the Special Review plat, the plat
shall be amended to show the Panhandle Eastern Pipe Line
Company's right-of-way.

DEVELOPMENT STANDARDS

1 . The Special _Review permit is for a single family dwelling
unit located on a parcel less than the minimum lot size in
the A (Agricultural) Zone District as submitted in the
application materials on file in the Department of Planning
Services and subject to the Development Standards stated
herein .
2 . All structures located on the Special Review site shall be
made accessible by a road to ensure access for fire
protection.
3 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
4 . -The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 _of the
Weld County Zoning Ordinance.
5 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 o₹ the
Weld County Zoning Ordinance.
6 . Personnel from the Weld County Health Department and Weld
County Department of _Planning Services shall be granted
access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County -Regulations .
7 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated -shall require
the approval of an amendment of the permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services .
8 . In the event this parcel ceases to be farmed, the property
owner mill seed the parcel with native grass or a self-
sustaining grass approved by the Soil Conservation District.

A public hearing was conducted on February 29, 1988, at 9:30 A.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 8, 1988, and
duly published February 11, 1988, in the Johnstown Breeze, a public
hearing was conducted to consider the request of Michael and Sandie
Pallotto for a Special Review permit for a single family dwelling on a
parcel of land less than the minimum lot size in the A (Agricultural)
Zone District. Lee Morrision, Assistant County Attorney, made this
matter of record and stated that this hearing was continued from
February 24, at the request of the applicant, because only three
Commissioners were present on that date. Keith Schuett, representing
the Planning Department, requested that the Planning Commission's
favorable recommendation be entered into the record of this hearing as
written. Mike Pallotto, one of the applicants, came forward to answer
questions of the Board. He stated that they had no problems with the
Conditions and Development Standards as recommended by the Planning
Commission. Mr. Schuett submitted a letter from Panhandle Eastern Pipe
Line Company which negates the need for Development Standard #2, and he
said the Planning staff now recommends the deletion of this Development
Standard. No public comment was received concerning this request.
Commissioner Lacy moved to approve the request of Michael and Sandie
Pallotto for a Special Review permit, subject to the recommendation of
the Planning Commission, and deleting Development Standard #2.
Commissioner Johnson seconded the motion which carried unanimously.
This Certification was approved on the 2nd day of March, 1988.

The Chairman asked the applicant if they had reviewed the recommendation,
conditions, and Development Standards as outlined by the Department of
Planning Services staff. He stated they have no objections to these items.
The Chairman asked that reading the recommendations, conditions, and
Development Standards into the record be dispensed with and that they be
filed with the summary as a permanent record of these proceedings.
The Chairman announced since this is a major facility of a public utility
the Planning Commission has the authority to approve _this request. If the
Planning Commission's recommendation is for denial, the applicant may
request a hearing with the Board of County Commissioners.
MOTION:
Ernie Ross moved Case Number USR-817 for Weld County, (Peters Pit No. 2) for
a major facility of a public utility (open-pit mining and materials
processing) in the Agricultural zone district be approved based upon the
recommendation, conditions, and Development Standards as outlined by _the
Department of Planning Services and the testimony given by the applicant.
Motion seconded by Louis Rademacher.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked she secretary to poll the members of the Planning

Con DeWalt, Manager, Neiman Farms, reported this land is erodable and they
have made an agreement with the Pallottos that it will be restored in
pasture and native grasses.
AMENDMENT:
Paulette Weaver moved a new Development Standard #9 be added to read as
follows:
9. In the event this parcel ceases to be farmed, the property
owner will seed the parcel with native grass or a
:flf-sustaining grass approved by the Soil Conservation
Service.
And that the remaining Development Standards be renumbered according.
Motion seconded by LeAnn Reid.
The Chairman called for discussion.

type of verbage is not enforcable.

Development Standards as set forth by the staff and amended by the Planning
Commission and the testimony heard by the members of the Planning

LOCATION: Approximately 1 .5 miles north of the Town of Gill; east of
Weld County Road 55, and north of Highway 392.
APPEARANCE:
Pat McNear, Scott Realty, represented the applicant. Re stated they have
reviewed the recommendation, conditions, and Development Standards as
presented by the Department of planning Services and are taking exception to
Development Standard #9. They would like the last sentence deleted and "or
a domestic well as permitted by the Division of Water Resources"
substituted. They would like the option of going onto a water tap or using
raw water for washing down the barn, etc. They have also met with Molly
Summerville, Attorney, Union Pacific Land Resources Corporation, regarding
the mineral rights in the NW¢ . They will be installing the fire hydrant on
North Weld County Water District lines per a referral from the fire
district.
Ron Gorzeman, applicant, reported the application is for a 2,500 head
operation. They do not expect to milk more than 600 cows, but it will take
this amount of livestock for dry lot, replacement, etc.

This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Coimnission's recommendation for approval is conditional upon
the following:
1 . The attached Development Standards for the Special Review permit
be adopted and placed on the Special Review -plat prior to
recording the plat.
2. The Spacial Zteview activity shall not occur nor shall any building
or el-ectrical permits be issued an the property until the Special
Review plat has teen delivered to the Department of Planning
Services' office and the plat is ready to be recorded in the
office of the Weld County Clerk and Recorder.
3. Prior to the issuance of building permits, a copy of an approved

This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1 . The attached Development Standards for the Special Review permit
be adopted and placed on the Special Review plat prior to
recording the plat.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
fleview plat has been delivered to the Department of Planning
Services' office and the plat is ready to be recorded in the

The Weld County Planning Commission will conduct a public hearing on

Please find enclosed a copy of our as-built map which shows our pipeline
16-10-075-496-6" , in the hi-lited area, in the Southwest Quarter of Section
19, Township 5 North, Range 67 WEst, Weld County, Colorado.
We maintain a 50-foot wide right-of-way on all pipelines and will not allow
any building within that easement area. The owner or developer shall have the
right to construct and maintain utility lines, streets, sidewalks, and
driveways, which may be installed at approximate right angles to the pipeline
herein authorized, provided, however, that all utilities cross under or over
our pipeline and maintain 18 inches clearance from our pipeline. No paved or
traveled portion of any street, sidewalk, driveway, road, parking area, alley
or curbing will be placed substantially parallel to and within fifteen ( 15' )
of the pipeline.
In the event of a proposed crossing with a road or utility, please contact
Utility Notification Center of Colorado (UNCC) at 534-6700 (Local & Metro
Denver) , or 1-800-922-1987 (Outside the Metro area) , with two (2) business
days notice, and at no cost to you, we will locate and mark our lines to
-eliminate accidents that can occur from foreign forces.
Panhandle Eastern will be more than happy to work with you on this project;
-however, if for any reason our lines must be moved, it will be at the expense
of the developer or the person or persons asking for this movement.

Dear Mr. Pallotto:
This letter is in response to your request that the Little Thompson
Water District commit to provide domestic water service to a proposed
' residence to be located in our District.
The property in question is described as being in Section 19 , Township
5N, Range 67 West of the 6th Principal Meridian in Weld County, CO.
Further, it is bounded on the west by the Larimer—Weld County Line,
(County Road 13) and is north of Weld County Road 54 approximately
2/3 miles .
For your information, the District currently has a 6" water main along
the east side of Weld County Road 54 in the above described location,
with additional capacity available to provide domestic water service to
the proposed residence. Therefore we will commit to serve this residence
with a standard 5/8" x 3/A" residential water tap with the understanding
that if any line extensions or ether improvements are required to our
system to provide this service that they will be done at your expense,
and comply to District Specifications, in accordance with the Rules and
Regulations of the District.
The current tap fee for the above described water tap is $3 , 000 and is
subject to change without notice. Lead time for tap installations is
normally 3 to 4 weeks, and may vary somewhat dependant upon the time of
year and weather conditions .
This commitment will expire one year from the date of this letter if
a tap -has not been purchased and installed by that date.
