RESOLUTION
RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AUCTION SITE - PAUL AND
SHIRLEY SMITH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 9th day of January, 1985 , at the hour of 2 :00
o' clock p.m. in the Chambers of the Board for the purpose of
hearing the application of Paul and Shirley Smith for a Use by
Special Review for an auction site on the following described real
estate, to-wit:
Tract 2 , Aristocrat Ranchettes, a subdivision
located in Section 27 , Township 2 North, Range
66 West of the 6th P.M. , Weld County, Colorado
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . The proposal is consistent with the intent of the area
in which the use is located.
3 . The uses which will be allowed can be considered as
being similar to uses previously granted in agricultural
areas.
4 . No objections were voiced by those residing in the
neighborhood.

5 . The applicants have previously maintained the site in an
adequate manner.
6 . The Operation Standards approved with this application
make adequate provision for the protection of the
health, safety and welfare of the inhabitants of the
neighborhood and the County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for an auction site on the hereinabove
described parcel of land be, and hereby is, granted subject to the
following conditions :
1. The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . No building or electrical permits shall be issued for
the Use by Special Review area until the Standards for
the Use by Special Review have been placed on the Use by
Special Review plat and the plat has been delivered to
the Department of Planning Services Office.
3 . Prior to recording the Use by Special Review plat, the
applicant shall submit a revised mylar plat to the
Department of Planning Services to show the following
information on the plat: access to the site (limited to
one on Dale Avenue) and designated parking areas.
4 . Within thirty days from the date of approval by the
Board of County Commissioners , the applicant shall
submit an approved erosion and sediment control plan for
the non-parking areas in accordance with the Platte
Valley Soil Conservation District recommendation to the
Department of Planning Services .

OPERATION STANDARDS

Paul and Shirley Smith
1 . The uses permitted shall be an auction site as explained in
the submitted application materials on file with the
Department of Planning Services.
2. Access shall be restricted to one existing driveway on Dale
Avenue as recommended by the Engineering Department.
3 . All parking associated with the Use by Special Review area
shall be on site in the designated parking areas as shown
on the Use by Special Review Plat.
4 . Use of the subject site for auctions shall be limited to
Saturdays and conducted during the hours of daylight only.
5 . The designated parking areas shall be asphalted , graveled
or covered with another type of material approved by the
Platte Valley Soil Conservation District (PVSCD) to control
wind erosion as recommended by the PVSCD.
6 . To prevent soil erosion, perennial grass as approved in the
soil and erosion control plan for the non-parking area
shall be planted prior to May 15 , 1985 .
7 . Junk vehicles shall not be stored on the subject site. A
junk vehicle shall be construed to be any inoperative
vehicle.
8 . The Commissioners reserve the right to hold a hearing to
consider imposition of the following standard: A wooden or
woven chain link fence shall be constructed so that the
auction site is not visible from Weld County Road 31 , Dale
Avenue , Morris Avenue or adjacent properties . The fence
shall be constructed within sixty days from the date of
being deemed necessary by the Board of County Commissioners.
The fence shall be properly maintained and kept free of
debris.
9 . The applicant shall comply with the design standards for
the Use by Special Review, Section 24 .5 et seq. , of the
Weld County Zoning Ordinance.
10 . The applicant shall comply with the Operation Standards for
Use by Special Review, Section 24 . 6 et seq. , of the Weld
County Zoning Ordinance.
11 . Representatives or members of the Weld County Health
Department and Weld County Department of Planning Services
shall be granted access onto the site at any reasonable
time in order to insure the operations carried out on the
site comply with the Operation Standards stated hereon and
all applicable Weld County Regulations .
12 . The Use by Special Review area shall be limited to the
plans shown hereon and governed by the Standards as stated
above and all applicable Weld County Regulations. Any
material deviations from the plans and/or Standards as
shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning
Commission and the Board of County Commissioners before
such changes from the plans and/or Standards are permitted.
Any other changes shall be filed in the office of the
Department of Planning Services .
13 . The property owner and/or operator of this operation shall
be responsible for complying with all of the above stated
Standards. Noncompliance with any of the above stated
Standards may be reason for revocation of the Permit by the
Board of County Commissioners.
14 . All auction materials shall be removed from the subject
site within eleven days of receipt of the material .
15 . The Use by Special Review permit shall become null and void
upon sale or transfer of the property by the applicants ,
Paul and Shirley Smith.

A public hearing was conducted on January 9, 1985, at 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 19, 1984, and
duly published December 27, 1984, in the La Salle Leader, a public
hearing was conducted to consider the application of Paul and Shirley
Smith for a Use by Special Review for an auction site. Assistant
County Attorney Lee Morrison read this application into the record.
Rod Allison, representative of the Planning Department, read the
unfavorable recommendation of the Planning Commission into the record.
Mr. Morrison informed the applicants that, since only four
Commissioners were present, if this hearing should result in a tie, the
absent Commissioner would listen to the tape of the hearing and cast
the deciding vote. John Dent, Attorney, was present to represent the
applicants. Mr. Dent presented the background of this application and
presented the contention of the applicants that this does not create a
traffic hazard, does not create a safety problem and is compatible with
the character of the neighborhood. Mr. Dent also presented a petition,
Exhibit "A", said to contain approximately 60 signatures of residents
of the neighborhood in support of this application. Paul Smith, the
applicant, also presented information concerning his operation. Area
residents who spoke in support included William Brothe, Johnnie Jones,
Rose Marie DiPaola, Hal Smith and Herbert Watson. Commissioner Lacy
moved to approve the Use by Special Review application submitted by
Paul and Shirley Smith. Commissioner Kirby seconded the motion. Mr.
Allison stated that the Planning staff recommends four conditions and
15 Operation Standards for consideration and read these into the
record. Mr. Dent stated that the applicant objected to Operation
Standard #8, requiring fencing, and #14, concerning removal of auction
materials from the site. After discussion, Commissioner Lacy amended
his motion to include the conditions and Operation Standards with
Operation Standard #8 being amended to state that the Commissioners
reserve the right to hold a hearing to consider imposing this standard
and Operation Standard #14 being amended to allow eleven days for the
removal of auction materials from the site. Commissioner Kirby, the
seconder, agreed to this amendment. The motion carried by a unanimous
vote.

the Weld County Zoning Ordinance which states in part:

by Special Review Permit unless it finds that the applicant has
not met one or more of the standards or conditions of Section
24.3. 1 ; 24.5; and 24.6. The applicant has the burden of proof to
show that the standards and conditions of Section 24.5; 24.6; and
24.3. 1 are met."
The applicant has not demonstrated in the submitted application materials:
- That the uses which would be permitted will be compatible with the
surrounding land-uses;
- That there is adequate provision for the protection of health,
safety and welfare of the inhabitants of the neighborhood and the
County.

This determination is based upon the following:
The Weld County Zoning Ordinance states that a Use by Special
Review includes those uses which may have a greater impact on
surrounding uses or potentially a more intensive use than allowed
by right in the zone district. Although Aristocrat Ranchettes is
in an unincorporated area, it is a platted rural subdivision
containing residential home sites. If approved, the proposed
auction site would not be compatible with the future development
of the platted subdivision.
The subdivision contains twelve (12) platted lots within five hundred
(500) feet of the subject site. Each of these lots is eligible for one
(1) residence. The auction site with goods possibly stored throughout
the site during the week, would detract from the character of the
neighborhood. In addition, according to the application materials, the
auction site could attract up to one hundred and fifty (150) people on
the auction days. This level of traffic would not be compatible with
the neighborhood.
The subject site has the potential to turn into a commercial sales area.
Auction materials not sold on Saturday could be sold during the week or
stored on the site until sold. The location of such a commercial activity
outside an existing incorporated town would be contrary to the Comprehensive
Plan as set forth in the Plan's Agricultural and Commercial policies.
In summary, the concerns of the Planning Commission are increased traffic
and noise associated with the proposal, safety of neighborhood children, and
maintenance of the residential character of the subdivision.

APPEARANCE:
John Dent, Attorney, represented the applicants. He stated they have
reviewed the recommendations of the Department of Planning Services staff
and do not agree with their recommendation for denial. The merchandise sold
here is general merchandise but primarily agricultural in nature. The
auctions are held only on Saturday. Auctions have been held on this site for
more than a year now and there have been no complaints from anyone in the
surrounding area. The use is not daily, but is only one-half day per week.
The auctions are attended by the residents of Aristocrat Ranchettes and
farmers in the area. Most items to be sold are chickens, geese, farm
equipment, and general merchandise.
Paul Smith, property owner and applicant, stated the traffic for the
auctions is on Weld County Road 31, a gravel road, and there is very little
traffic through the subdivision except for people who live in the
subdivision. It is his feeling the auctions help keep the subdivision
clean. Residents bring what might otherwise be set in the yards to the
auction to dispose of it. Merchandise is generally not brought to the
auction site until Friday evening or Saturday morning. If the merchandise
is not sold the owner has until Monday to reclaim it. If it is not
reclaimed by Monday the merchanise is disposed of, so there is not, nor will
there be, any junk lying around.

request.
Helen Montgomery, resident, Aristocrat Ranchettes, stated she lives across
the street from the auction site and they like to attend the auctions. It
is a meeting places for the people in the area. There is very little
outside traffic into the subdivision from those attending the auctions, and
Mr. and Mrs. Smith do not let unsold items remain on their property.
The Chairman asked James Mayerl to read the recommendation of the Department
of Planning Services staff, which is for denial, into the record.

THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE
DENIED FOR THE FOLLOWING REASONS:
1. It is the opinion of the Department of Planning Services staff that
this request is not in compliance with the provision of Section 24.3. 1
of the Weld County Zoning Ordinance which states in part:
". . .The Planning Commission shall approve the request for the Use
by Special Review Permit unless it finds that the applicant has
not met one or more of the standards or conditions of Section
24.3. 1; 24.5; and 24.6. The applicant has the burden of proof to
show that the standards and conditions of Section 24.5; 24.6; and
24.3. 1 are met."
The applicant has not demonstrated in the submitted application materials:
- That the uses which would be permitted will be compatible with the
surrounding land-uses;
- That there is adequate provision for the protection of health,
safety and welfare of the inhabitants. of the neighborhood and the
County.
This determination is based upon the following:
- The Weld County Zoning Ordinance states that a Use by Special
Review includes those uses which may have a greater impact on
surrounding uses or potentially a more intensive use than allowed
by right in the zone district. Although Aristocrat Ranchettes is
in an unincorporated area, it is a platted rural subdivision
containing residential home sites. If approved, the proposed
auction site would not be compatible with the future development
of the platted subdivision.

The subdivision contains twelve (12) platted lots within five hundred
(500) feet of the subject site. Each of these lots is eligible for one
(1) residence. The auction site with goods possibly stored throughout
the site during the week, would detract from the character of the
neighborhood. In addition, according to the application materials, the
auction site could attract up to one hundred and fifty (150) people on
the auction days. This level of traffic would not be compatible with
the neighborhood.
The subject site has the potential to turn into a commercial sales area.
Auction materials not sold on Saturday could be sold during the week or
stored on the site until sold. The location of such a commercial activity
outside an existing incorporated town would be contrary to the Comprehensive
Plan as set forth in the Plan's Agricultural and Commercial policies.
In summary, the concerns of the Department of Planning Services staff are
increased traffic and noise associated with the proposal, safety of
neighborhood children, and maintenance of the residential character of the
subdivision.

Access to the subject site is from Weld County Road 31, a gravel road, or

also one outhouse on the far eastern part of the site, not in operation.
The site is on the west edge of Aristocrat Ranchettes Subdivision. There
are approximately twelve (12) platted residential lots within five hundred
feet of this proposal. Several antique cars, rabbit boxes, and furniture
were on the site at the time of the field check. A red and white fence
exists approximately 80 feet from Dale Avenue and approximately 70 feet from
the eastern lot line. All but one vehicle was inside this fence at the time
of the inspection. The area outside this fence will presumably serve as the
parking lot.

Part of the area is covered with grass. For erosion and sediment control
some of the bare soil area needs to be seeded to adapted grass. This
would be in low traffic areas. High traffic areas need gravel or asphalt
or some other type of material to control wind erosion.

PROPOSED OPERATION AND USE
•
1. Proposed Use
The proposed use of the property is for a site to hold auctions at
which general merchandise is sold including a large amount of farm
machinery and building material.
2. Need for Use
Applicants are in need of this special use of property as they are
auctioneers and income from auctions is their main source of
income.
3. Existing uses on Surrounding Properties
The surrounding properties are used for agricultural and
residential purposes .
4. Distance of Proposed use to Surrounding Residential
Structures
The proposed use is approximately 500 feet from the nearest
residential structure.
5. Maximum Number of Users
The maximum number of people in atendance at one auction is 150.
6. Employees, Shifts, Hours
Auctions would be held every Saturday from 11: 00 a.m. to 7: 00 p.m.
There are no plans for employees at this time. This is a family
business and no family members are paid as employees.
7. Water Source
Aristocrat Ranchette Water District
8. Access Routes
The proposed use is accessed by a driveway from Weld County Road
#31 and 2 driveways from Dale Avenue immediately adjacent on the
south side.

9. Vehicular Traffic
There would be approximately 25 to 30 vehicles per auction
including automobiles, pick-up trucks and farm trucks (2 ton
maximum) associated wtih this use. This traffic would be mostly
at the sales on Fridays with a small amount of traffic on
Saturdays .
10. Sewage Facilities
Applicants propose to provide Sanilet facilities for use by all
persons attending auctions. Applicants residence immediately
adjacent to proposed use has a septic tank.
11. Fire Protection
No imminent :Eire risk is anticipated by the proposed use. No.
flammable materials are stored on site with the exception of used
lumber. The Fort Lupton Fire District provides fire protection
for the area in which the proposed use is located.
12. Animals
Occassionally chickens and other poultry are sold. However, when
poultry are sold they are brought on immediately prior to sale and
if not sold removed immediately after sale. No other animals are
involved with the proposed use.
13. Waste , Stockpile , Storage
The proposed use will require no waste storage or stockpile areas.
14. Storm Water Retention Facilities
There are no storm water retention facilities in Aristocrat
Ranchettes subdivision of Weld Co'unty. The soil is sandy and
roads are ditched. There are generally no problems with storm
water.
15. Removal and Disposal of Debris and Waste
Debris and waste will be disposed of in proper waste receptacles
and hauled away with applicants residential debris and waste.
16. Landscaping and Erosion Control
There are no special landscaping or erosion control measures
planned. The soil is currently covered with native grasses. The
land is fairly flat and sandy and no erosion is anticipated due to
special use .

17. Reclamation Procedures
There would be no reclamation procedures necessary. There will be
no additions or changes made to the property in order to proced
with the special use. In the event applicants discontinue special
use, property would be used for agricultural purposes.
18. Time Table
There is nothing to be done to commence the special use of this
property. A building is already in existence for use as an
office. Auctions would commence as soon as a special use permit
is granted.
19. Noise Control
There will be no noise caused by the proposed use in excess of the
applicable noise standards.
20 . Consistency with Weld County Comprehensive Plan
The proposed SUP area is consistent with the WCCR as it is
complementary to agricultural uses and occurs on a once a week
basis. One of the major items routinely sold is used farm
equipment. Most of the remaining items sold are used in
connection with agricultural uses such as fencing materials, farm
impliments, etc. most customers reside in the immediate vicinity
and the proposed use is a convenience to them.
21. Consistency with Agricultural District
Proposed SUP area is sandy, marginally productive agricultural
land. Because of the small size of the individual parcels in
Aristocrat Ranchettes, its continued use exclusively for
agricultural uses only is not its highest or best use. No
substantial diminution of agricultural resource land will be
served by approval of the request SUP.
22. Protection of Health, Safety, and Welfare
No iminent health or safety risks will be caused by the proposed
use. All vehicles will be parked in designated parking area.
Directional signs will be posted. All machinery to be sold will
be parked in designated, controlled areas.
23. Compatability With Surrounding Land Uses
The surrounding land uses are residential and agricultural. This
use is compatible with existing uses as the items sold at auction
are for agricultural purposes as frequently used by owners of the
surrounding properties.

24. Compatability With Future Development
It is anticipated that the future development of Aristocrat
Ranchettes will remain the same , that is, the development and sale
of 1 to 2 acre parcels for residential and agricultural use.
There being no anticipated changes , the special use will remain
consistent with future development.

The property is not located in a flood plain, geological hazard or
Weld County Airport overlay district area.
