RE: APPROVAL OF RECORDED EXEMPTION NO. 741 - JEAN & JUDY SIRIOS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 741 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 741 was
submitted by Jean and Judy Sirios for property which is located in
Part of the NW', of Section 11 , Township 1 North, Range 63 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant and
known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 1 acre and 153 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions: 1) the applicants shall
submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The
plat shall be drawn in accordance with the requirements of Section
9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty days from the date of approval by
the Board of County Commissioners; and 2) the applicants shall
submit a revised mylar plat showing a seventy-five foot road
reservation east of the centerline of State Highway 79 along the
western boundary of the entire 154 . 884 acre parcel as recommended
by the State Highway Department in its letter dated March 11 ,
1985 .

Dear Commissioners:
This request for a recorded exemption is submitted by Jean & Judy Sirios.
The parcel of land on which this request is being made is described as part
of the NW' of Seciton 11, TIN, R63W of the 6th P.M. , Weld County, Colorado.
The property is located adacent and south''°t'of Prospect Valley on Highway
79. The parcel of land under consideration is the total contiguous land
holdings of the applicant.
The request is to divide the property into parcels of 1 acre and 152.592
acres, more or less. The smaller parcel will be used as a homesite for the
applicants. The larger parcel will continue to be used for agricultural
production.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 E.
(1) (a) through (m) of the Weld County Subdivision
Regulations have been met.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The
plat shall be submitted within sixty (60) days from the date of
approval by the Board of County Commissioners.
2. The applicants shall submit a revised mylar plat showing a
seventy-five (75) foot road reservation east of the centerline of State
Highway 79 along the western boundary of the entire 154.884 acre parcel
as recommended by the State Highway Department in its letter dated
March 11, 1985. The State Highway Department's letter is attached.

COMMENTS:
The subject site is located adjacent to Prospect Valley, an unincorporated
oommunity. Access to the site would be from Highway 79 for the smaller
parcel and Highway 52 for the larger proposed parcel. There is a concrete
lined ditch along the western edge of the parcel ten to fifteen feet from
the edge of Highway 79. There is one single family dwelling and several
farm buildings in the northeast corner of the parcel. The remainder of the
site is in crop production.

Dear Mr. Mayerl :
We have reviewed the Sirios Exemption application and have the
following comments:
1 . Projected traffic on State Highway 79 indicates the need for a 150-foot
total right of way, 75 feet each side of the highway centerline. Additional
width to meet this need should be protected by building setback,
reservation or, preferably, dedication as permitted by local regulations.
The existing right of way for State Highway 52 along this property
should be sufficient to accommodate projected traffic, therefore, no
additional width is needed.
2. The one-acre parcel which would be created by this exemption has no
existing access to S.H. 79. It would require an access if this exemption
is approved. The larger 152.6-acre parcel has accesses to S.H. 52 and
S.H. 79.
In order to avoid a net increase in the number of driveways to these
highways, we ask that one of the existing driveways be relocated to serve
the one-acre parcel .
This driveway relocation or a new access to S.H. 79 would require an
Access Permit. Application for this permit is made to this office at the
above address. If this exemption is approved, we will allow access to S.H.79
for the one-acre parcel .

Dear Weld County Gommisioners:
I would like this exemption so I can build a
house to live in. I have lived in the house were
presently in for twelve (12) years. The landlord
wants it for his Son and would like us to move.
I have lived and farmed in south-east Weld
county all my life. I am, farming about one thous-
and (1000) acres of rentea .land, but none of these
farms have a house thats fit to live in.
I am 42 years old and think I should be buying
a home. I would like to continue to live in the
Prospect Valley area. The proposed exemption is in
the south-east corner of the.: town of Prospect Valley
and would have access to state highway seventy nine
(79).

"Recorded Exemption.
<(5)- The proposal will be consistent with the district where located
in that the application is made, this is a part of a growth of
an exisiting town.
(6) Permitted use will be acceptable , because its on the edgy of
an existing town.
(,&2) It will be compatable because it is an existing town and
• should not grow very fast.
(8) The land division is in compliance with the Weld County
Comprehensive Plan in that it does not encourage growth in a
rural area and the use will be related to agricultural zoning.
(9) The division will not conflict with controlled, orderly devele
opment.
(10) Sewage disposal by approved septic system will be used.
Lot size is adequate.
(11) The property under consideration for a recorded exemption
is not in a flood plain.
(12) The proposed Recorded Exemption does not evade the requirements
of Weld County Subdivision Regulations and the request follows
the requirement of orderly controlled growth as stated in those
regulations.

not correspond with one another. For mapping purposes , wells are located on
40-acre tracts of land regardless of the size of your tract. The 40-acre
tract is known as the 1/4 section of the 1/4 section. Distances to your
