RE: APPROVAL OF RECORDED EXEMPTION NO. 751 - BENJAMIN AND JOANNE
KNAUB
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 751 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 751 was
submitted by Benjamin and Joanne Knaub for property which is
located in N1 N1, Section 6 , Township 3 North, Range 65 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant and
known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 2 acres and 160 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder in accordance with a letter
from the Farmer' s Reservoir and Irrigation Ditch Company dated May
3 , 1985 . The plat shall reflect a total seventy-five foot (75 ' )
right-of-way for the Speer Canal.

Dear Commissioners:
This request for a recorded exemption is submitted by Benjamin & Joanne
Knaub . The parcel of land on which this request is being made is described
as N1 N1 of Section 6, T3N, R65W of the 6th P.M. , Weld County, Colorado.
The property is located approximately 4 miles southeast of Gilcrest on Weld
County Road 39. The parcel of land under consideration is the total
contiguous land holdings of the applicant.
The request is to divide the property into parcels of 1.5 acres and 160.4
acres, more or less. Mr. & Mrs. Knaub propose to retain Parcel B in its
present agricultural use. The smaller Lot A would be sold with the intent
of maintaining the land in crop production.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 E.
(1) (a) through (m) of the Weld County Subdivision
Regulations have been met.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a corrected mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County Clerk
and Recorder in accordance with a letter from the Farmer's Reservoir
and Irrigation Ditch Company dated May 3, 1985. The plat shall reflect
a total seventy-five foot (75') right-of-way for the Speer Canal.

COMMENTS:

houses an oil/gas facility. A recreational vehicle and temporary building
are also located in this area. The Speer Canal divides the proposed lots.
Lot A is used for crop production.
There is one residence within 1/4 mile of the subject property.

Please find attached a copy of the plat that shows
the location of the Speer Canal _ The R-O-W for the
canal is 35' to the left and 40' to the right of the
centerline of the canal as constructed.
We do not know if the survey of the Speer shown on
the application is the actual location_
The Farmers Company asks that the present location
of the canal be recognized as the correct location
with the R-O-W width of 35' to the left and 40' to the
right of the centerline

FINDINGS OF THE STATE ENGINEER
IN THE MATTER OF AN APPLICATION TO REPLACE AN OLD WELL IN WATER DIVISION 1,
WELD COUNTY, COLORADO
APPLICANT: BEN KNAUB
PERMIT NO. /9,g/ -1 _?
In compliance with the provisions of C.R.S. 1973, 37-92-602(3)(c), Ben
Knaub, 19600 Weld County Road 38, Platteville, Colorado, 80651, (hereinafter
"applicant") submitted an application to replace an old well. On the basis of
the information submitted by the applicant and the records in the Division of
Water Resources, the State Engineer makes the following findings:
1. The application was recieved complete on September 8, 1983.
2. The well is located in the NE 1/4 of the NE 1/4 of Section 6,
Township 3 North, Range 65 West of the 6th Principal Meridian, Weld
County, Colorado.
3. The well is located outside the boundaries of a designated ground
water basin.
4. The application for a permit to construct a replacement well was
submitted along with an application to record the old well.
5. A field inspection by the water commissioner found no evidence of an
old well, thus the application to record the old well was denied
(see attached copy of File No. AD-10208.
6. The subject application was submitted for a permit to relocate an _y
old well. Recording of the old well was denied by the State
Engineer, File No. AD-10208, because the old well no longer
existed. The applicant consequently requested a permit to construct
a new well under the provisions of C.K.S. 1973, 37-92-602(3)(b)(II) .
The additional fee required for this type of well permit was
received on November 8, 1983.
7. The proposed well would withdraw ground water from the Laramie shale
which is tributary to the South Platte River.
8. The South Platte River is overappropriated. At some or all times of
the year, the water supply from said river is XrISUfficient to
satisfy all the decreed water rights.
9. The proposed well would be used for domestic and stock watering
purposes including the irrigation of not more than one acre of lawns
and gardens on a 40-acre parcel.

10. The pumping rate for the proposed well is 15 gallons per minute with
an annual appropriation of one acre-foot.
11. As the only well on a 40-acre parcel, a permit could be issued
pursuant to section (3)(b)(II) as defined in C.R.S. 1973, 37-92-602.
In view of the above, the State Engineer finds that the issuance of a
permit to construct a new well under the provisions of C.R.S. 1973, 37-92-602,
will not materially injure vested water rights. The permit can therefore be
issued under the following conditions:
1) Approved pursuant to C.R.S. 1973, 37-92-602(3)(b)(II) as the
only well on a tract of land of 4? acres described as

2) The use of groundwater from this well is limited to fire
protection, ordinary household purposes inside a single family
dwelling, the irrigation of not more than one acre of home gardens
and lawns, and the watering of domestic animals.
3) The return flow from the use of the well must be through an
