RESOLUTION RE: APPROVE PRELIMINARY PLAN FOR SUBDIVISION - DONALD J. CARLSON, DBA HERITAGE PARK PARTNERSHIP -WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute -and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 15th day of April, 1987, a Preliminary Plan for a subdivision was submitted to the Board of County Commissioners by Donald J. Carlson, dba Heritage Park Partnership, for approval in accordance with the Subdivision Regulations of Weld County, Colorado, and WHEREAS, the Preliminary Plan concerns the following described real estate to-wit: -Part of the NWa of Section 17 , Township 7 North, Range £7 West of the bth P.M. , Weld County, Colorado WHEREAS, the Board of County Commissioners , having reviewed the record , including the recommendation of the Planning Commission and the Planning staff, heard all of the testimony and statements of those present, is satisfied that the submitted Prelimi-nary Plan conforms in all respects with the requirements of Section 5-4A. of the Weld County Subdivision Regulations , and that approval of said Preliminary Plan would be in the best interest of Weld County. Should this survey identify a Radon Gas problem, all facilities shall be designed and constructed to prevent any possible Radon Gas infiltration. k) The applicant shall submit, with the final plat application , evidence that a provision of perpetual maintenance of the open space areas has been addressed. LOCATION: South of State Highway 14 and east of Weld County _Road 15. APPEARANCE: Thomas Hellerich, Attorney at Law, Dinner, Hellerich, and Lazar, reviewed background information concerning this request. In June of 1985, the zoning of this property was changed to R-5. The site application for a sewage treatment facility has been approved. The Wild County Utilities Coordinating Committee has reviewed this request and recommends approval. They have reviewed the staff's recommendations and have no objections to them. They have met with the Windsor Planning Commission and they did not object to this request. There will be 3.8 mobile home units per acre; however the Zoning Ordinance does allow for 8 per acre. Therefore, the number of units per acre will be much less dense than allowed by the Ordinance. Merle Johnson, the preliminary plat allows for two hundred and twelve mobile home units as allowed for in the change of zone. The land slopes to the southwest. The interior streets will all be paved and maintained by the applicant. There will a maximum of three persons per unit. They have received a Federal permit to move the wetlands and these -will be cared for in perpetuity. They will conform with the recommendations of the soil conservation district. Hal Walston, co-owner, reported they will have regular playground areas maintained by the owners. Donald Carlson, co-owner, reported there will be two playgrounds. In addition, the stormwater retention pond and, which will never have water in it except immediately after a storm will be used as a baseball diamond and recreation area. There will also be a clubhouse and a swimming pool. The density of the mobile homes Is much less than any other park. C. Brown, Executive Director, Manufactured Housing Development, stated they are in need of a park like this in the area. He reviewed a new State -Statute regarding mobile homes in a flood plain. To comply with this statute is prohibitive for many older parks, and therefore no other mobile home will be able to move into the park until the owner complies with this ruling. None of Heritage Village lies within a -flood plain area. The Chairman asked that reading the recommendations and conditions as outlined by the Department of Planning Services staff be dispensed with and that they be filed with the summary as a permanent record of these proceedings. Lee Morrison stated some of the discussion is not applicable at this time. He reviewed Section 3-4 of the Subdivision Regulations directed at Preliminary Plans. This Section states the plat should he approved unless it is detrimental to the health, safety, and welfare of the public. Keith Schue-tt reviewed the design criteria from Section -8 of the Weld County Subdivision Regulations. The required amount would be 6.2 for schools and pulic utilities. Lee -Morrison pointed out the difference between dedicated land and developed recreational land. It is much more expensive to develop land than it is to dedicate it. MOTION: Paulette -Weaver moved Case Number S-275:87:2 for Heritage Park Partnership for a subdivision preliminary plan be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for denial based on the fact that it does not appear to meet the needs of the people of the area in that it does not appear to have anywhere near the open space needed for this number of people. Ann Garrison seconded the motion. The Chairman called for discussion from the members of the Planning Commission. Ann Garrison stated she would like to give her reasons for seconding the motion. As she understands the new comprehensive plan, we in the County have decided that it is desirable for developers of any type of property to help pay for infrastructure and that would include schools. The Carlson have come up with a tentative agreement with the school district, but she -would like to give some estimates of how this could affect the County. In 1972 or 1973, the State of Colorado -changed the revenue base for education. At this time, the authorized base was less than eight hundred dollars. The two Summary of the Weld County Planning Commission Meeting April 7, 1987 Page 5 most important factors in contributing to the linacing of primary and secondary education today is the authorized revenue base set by the State, and the assessed valuation cf the property. In the letter from the Windsor School District, the authorized revenue base currently is in excess of $3,275.47. So, if in the year 1972 or 1973, the authorized revenue base was less than 800 dollars, it is obvious that the authorized revenue base has gone up very very rapidly and she would expect because of the problems in primary and secondary education that the authorized revenue base will continue to go up. If we in the County have should help -Jay for decided that the dallo the infrastructure, including the schools, then allowing any developer to enter an agreement, in this case in terms of helping to finance primary and secondary education with a fixed amount that they would contribute one-third of a _fixed of $3,275.43 leaves the taxpayers and the County open to pay the difference. Three times the assessed valuation of the property will go up normally, but anytime any type of an lgreement is filled in terms of one-third -of a fixed amount then the People of Weld County would have to come up with more through changes in the assessed valuation of property, and that she is against. Therefore, she is basing her seconding of the motion on the mew Comprehensive Plan and the belief that developers in the County should pay for any infrastructure including the schools. Ivan Gosnell - no; Lynn Brown - yes; Lydia Dunbar - yes; LeAnn Reid - yes; Louis Rademacher - No, because he thinks there is plenty of open space there. There is over 80 thousand square feet in the stormwater drainage area where they intend to install the baseball diamond, etc. The children will not be the same age group and same size and half of them will he in yards or houses. Therefore he does not feel a lack of open space has anything to do with this request. Paulette Weaver - Yes, for reasons stated earlier. Ann -Garrison - yes; Jack Holman - Yes, because he does agree with both Paulette and Ann. His concern is mostly with the concentration of the mobile homes in the area, and he feels more open space is needed whether it be park areas, ball parks, etc. Motion carried with six voting for the motion and two voting against the motion. Carlson) For: Preliminary Plan of an R-5 Subdivision To Whom It May Concern: We are unable to attend Public Hearing before Weld County Planning Commission on April 7, 1987, but as -adjacent property owners , we would like to make a few requests. 1 . That no mobile homes be situated within 400' ( feet ) of our property line. This would give us a reasonable level of quiet and privacy , which was our primary reason for purchasing rural property. 2. That all proposed roads within the mobile home park be black-top . This would help keep down the dust cloud some 400-500 motor vehicles would create if roads were only graveled. 3. That an 8' ( foot ) privacy fence be erected around the perimeter of the mobile home park. The enclosed picture will show the condition our fence is in at this time due to the fact the Carlsons refused to put up an electric wire to keep their horses from leaning on it . They appear to have no respect for our property at this time and we can not expect them to do so in the future. The five foot easement next to Highway 14 appears to be in the right-of-way of Highway 14. Public Services' recommendation regarding no trees, shrubs, or bushes in the utility easement was not felt to be a recommendation that needed to be strictly complied with. Utility companies have access to these easements and may remove any landscaping without replacement costs if needed. On the plat of Heritage Park, it appears landscaping of the easements is important to the overall landscaping plan. The Chairman asked the members of the Committee for their decision. The access on the west side of the property is to be identified as a fire easement. Donald Carlson, property owner and applicant, stated the unmarked easements shall be identified on the final plat. This development proposal has been previously reviewed, and comments were made regarding additional right of way for State Highway 14, highway access, noise abatement, drainage, and utilities. We have the following additional comments on these issues. 1 . The additional 35 feet of right of way shown on this plan is necessary to achieve a 75-foot width south of the highway centerline. This addi- tional right of way should be reserved or, preferably, dedicated as per- mitted by County regulations. 2. The new main access to SH 14 and the secondary gate-controlled emergency access at the west end of the site are acceptable. We are in the process of issuing an Access Permit for these accesses. Construction of the main access will include right-turn deceleration and acceleration lanes and a median left-turn lane. 3. We had previously determined that the 75-foot right of way, along with the required building setback along SH 14, would be adequate to achieve the residential design noise level . We do recommend that all units along SH 14 be located as far to the south as possible to minimize the future highway noise impact. 4. Surface runoff from this property flows away from SH 14 and will continue to do so according to the Preliminary Plan. However, there is also storm- water which has historically flowed onto this property from the north side of SH 14 through a culvert under the highway. This plan must allow 870271 MR. KEITH A. There are some ground water problems that have been addressed, but there is some confusion as to a flood possibility. A Sewer and Water Line and Grading and Drainage Plan were obtained from Johnson and Associates to the wet areas and the relief of the high water levels. If this plan is properly carried out, it should be a solution to that problem. There is conflict in data presented on a possible 100-year flood. Two different engineering firms have different opinions. This needs to be resolved before further planning takes place. Radon could be a problem for structures placed directly on the ground, has a basement, or a trailer with a concrete foundation. We recommend that a gamma survey be run on the site. If this survey shows only background (no hot spots) , then precautions should be observed during design and construction to prevent possible soil gas infiltration. Certainly this number of new res- idents would have significant impact on our school district and we have the need to discuss some way of obtaining some financial relief. I have had the opportunity to discuss the problem with Mrs. Pat Carlson who represents Heritage Park. The last time the Carl sons presented their plan to Weld County, an agreement was reached between them and the school district. I would like to reemphasize at this time the arrangements which I propose which would satisfy our concerns. Our district would appreciate the following conditions to be decreed by the county in approaching the Heritage Park Plan: Any student who would enroll in the Re-4 School District after the student count date in October of 1987 and before the end of the 1987- 88 school year would constitute a reimbursable student. Each reim- bursable student would constitute payment by Heritage Park to School District Re-4 in the amount of one-third of the 1988 authorized revenue base. It is understood that the 1988 authorized revenue base could be slightly in excess of $3,275.47. This stipulation is similar to an agreement that was forwarded to you on January 2, 1985, regarding the original Pine Lake plan that was proposed. (26) Discharges of dredged or fill material into the waters listed in paragraphs (a)(26)(i) and (ii) of this section. (i) Non-tidal rivers, streams, and their lakes and impoundments, including adjacent wetlands, that are located above the headwaters. (a) In addition to the conditions specified in 4 330.5(b) of this Part, the following management practices should be followed, to the maximum extent practi- cable, in the discharge of dredged or fill material under nationwide permits in order to minimize the adverse effects of these discharges on the aquatic environment. Failure to comply with these practices may be cause for the district engineer to recommend or the division engineer to take discretionary authority to regulate the activity on an individual or regional basis.
