RE: APPROVE ROAD IMPROVEMENTS AGREEMENT WITH FRONTIER MATERIALS,
INC. AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , a Road Improvements Agreement between Weld County
and Frontier Materials, Inc. , has been submitted to the Board for
its consideration, and
WHEREAS, said Agreement concerns the repair of Weld County
Road 7 in the area of Rinn , Colorado, said road having been
damaged by heavy truck traffic , and
WHEREAS, the terms and conditions are as stated in the
Agreement, a copy of which is attached hereto and incorporated
herein by reference, and
WHEREAS, after study and review, the Board deems it advisable
to approve said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County , Colorado, that the Road Improvements
Agreement between Weld County and Frontier Materials, Inc. be, and
hereby is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.
The above and foregoing Resolution was , on motion duly made
and seconded , adopted by the following vote on the 18th day of
August, A.D. , 1986.

COUNTY OF WELD, STATE OF COLORADO
ROAD IMPROVEMENTS AGREEMENT
THIS AGREEMENT, made and entered into this ]R-h day of August , 1986,
by and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter called "County"
and FRONTIER MATERIALS, INC. , hereinafter called "Frontier" .
WHEREAS, Frontier is operating open-cut gravel pits in the area of Rinn,
Colorado, and
WHEREAS, heavy truck traffic is being generated from the operation of said
gravel pits, and
WHEREAS, Weld County Road 7 has been damaged by said heavy truck traffic,
and
WHEREAS, Frontier and the County plan a joint effort to repair Weld County
Road 7.
NOW, THEREFORE, in consideration of the mutual covenants and conditions
hereinafter set forth, Frontier and the County mutually agree as follows :
1. Weld County forces will repair Weld County Road 7 prior to paving.
2. Frontier Materials will pave Weld County Road 7 with hot bituminous
pavement up to a maximum of 600 tons .
3. Weld County will reimburse Frontier Materials at the rate of $18.50
per ton for hot bituminous pavement provided Frontier's cost for
AC-10 liquid asphalt does not increase.
IN WITNESS WHEREOF, the parties hereto have duly executed the agreement
the day and year first-above written.
