RESOLUTION
RE: APPROVAL OF USE BY SPECIAL REVIEW FOR EXPANSION OF A
LIVESTOCK CONFINEMENT OPERATION - MILE-HI SHEEP COMPANY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 10th day of July, 1985, at the hour of 2 :00 p.m. in
the Chambers of the Board for the purpose of hearing the
application of Mile-Hi Sheep Company, P.O. Box 1066 , Ault,
Colorado 80610 , for a Use by Special Review for expansion of a
livestock confinement operation on the following described real
estate, to-wit:
Part of the W1 SW' , Section 8 , Township 6
North, Range 64 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 .7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4.2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the intent of the
Weld County Comprehensive Plan. The Comprehensive
Plan encourages the development of agribusiness and
agriculturally oriented industry provided these
enterprises do not adversely affect the local
economy or environment.

b. The proposed use is an agricultural activity and
is, therefore , consistent with the intent of the
agricultural district.
c. The uses permitted will be compatible with the
existing surrounding land-uses and with future
development of the surrounding area as permitted by
the Agricultural Zone District.
d. No overlay districts affect the site.
e. Use by Special Review Operation and Design
Standards provide adequate protection of the
health, safety and welfare of the neighborhood and
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for expansion of a livestock confinement
operation on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . The prescribed Use by Special Review activity shall not
occur nor shall any additional building or electrical
permits be issued on the subject property until the Use
by Special Review plat has been delivered to the
Department of Planning Services Office and the plat has
been recorded in the office of the Weld County Clerk and
Recorder.
3 . Within thirty days from the date of approval by the
Board of County Commissioners, the applicant shall
submit evidence to the Department of Planning Services
staff that the livestock confinement operation plans
have been submitted to the State Health Department and,
after approval, the plan shall be started within thirty
days. The Use by Special Review shall be limited to one
lagoon as shown on the Use by Special Review plat map.
4. Within thirty days after final approval by the Board of
County Commissioners , the applicant shall submit to the
Department of Planning Services staff, and have
approved, a dust abatement program.

OPERATION STANDARDS

1 . The uses permitted shall be a sheep confinement operation as
described in the application materials on file with the
Department of Planning Services subject to the Operation
Standards listed herein.
2 . Retention of feedlot run-off shall be accomplished in
accordance with the Colorado Department of Health
regulations. The applicant shall be responsible for any
additional requirements issued by the Colorado Department of
Health, Water Quality Control Division.
3 . All phases of the operation shall comply with all County and
State Health Standards and Regulations pertaining to air
quality, water quality, noise emission, and sanitary disposal
systems.
4 . The Use by Special Review plat shall be amended to include
the retention pond area. Additional structures for waste
retention shall meet Weld County setback requirements.
5. There shall be no discharge of wastes into any streams, other
bodies of water, or adjacent drainage systems without
obtaining a National Pollution Discharge Elimination System
Permit from the Department of Health.
6 . The applicant shall comply with the design standards for the
Use by Special Review, Section 24 .5 et seq. , of the Weld
County Zoning Ordinance.
7 . The applicant shall comply with the Operation Standards for
Uses by Special Review, Section 24 . 6 et seq. , of the Weld
County Zoning Ordinance.
8 . Representatives or members of the Weld County Health
Department and Weld County Department of Planning Services
shall be granted access onto the site at any reasonable time
in order to insure the operations carried out on the site
comply with the Operation Standards stated herein and all
applicable Weld County Regulations.

9. The Use by Special Review area shall be limited to the plans
shown herein and governed by the Standards as stated above
and all applicable Weld County Regulations . Any material
deviations from the plans and/or Standards as shown or stated
above shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board
of County Commissioners before such changes from the plans
and/or Standards are permitted. Any other changes shall be
filed in the office of the Department of Planning Services.
10 . The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated
Standards. Noncompliance with any of the above stated
Standards may be reason for revocation of the Permit by the
Board of County Commissioners.
11 . The applicant shall implement the approved dust abatement
program.

A public hearing was conducted on July 10, 1985, at 2:00 P.M. , with the following

The following business was transacted:
I hereby certify that pursuant to a notice dated June 26, 1985, and duly
published June 27, 1985, in the Johnstown Breeze, a public hearing was conducted
to consider the request of Mile-Hi Sheep Company for a Use by Special Review for
expansion of a livestock confinement operation. Lee Morrison, Assistant County
Attorney, made this matter of record. Gloria Dunn, Planning Department
representative, read the favorable recommendation of the Planning Commission into
the record, and stated that ten Operation Standards are recommended for this
proposal. Melvin Dinner, Attorney, came forward to represent the applicant.
Ivan Collins, president of Mile-Hi Sheep Company, was also present to answer
questions of the Board. Mr. Dinner explained that Mile-Hi Sheep Company has been
in existence since 1973 and is requesting permission to expand from 12,000 head
of sheep on seven acres to 21,000 head on fourteen acres. Mr. Dinner also
presented Exhibit E, a letter from Western Technical Services, Inc. , regarding
waste retention facilities for this feedlot. Mr. Dinner and Mr. Collins answered
questions of the Board concerning the proposed expansion and the neighborhood,
with considerable discussion about the proposed sewage lagoons. Elmer Francen, a
neighbor, came forward to express his opposition to this expansion, especially to
the potential second lagoon. Ms. Dunn proposed Condition #3, regarding approval
by the State Department of Health. Considerable discussion was held concerning
potential problems associated with the expansion. Rod Allison, of the Planning
Department, recommended that an additional. Condition #4 and Operation Standard
#11 be considered to address the problem of dust abatement. Commissioner Lacy
suggested that proposed Condition #3 contain a statement that there would be only
one sewage lagoon. Commissioner Brantner moved to approve this Use by Special
Review for expansion of a livestock confinement operation requested by Mile-Hi
Sheep Company, subject to four Conditions and eleven Operation Standards. (Tape
Change #85-60) Commissioner Kirby seconded the motion. Mr. Allison read the
wording of Conditions #3 and #4 and Operation Standard #11, which were added
during this hearing, into the record. The motion to approve this Use by Special
Review carried unanimously.

June 18, 1985
A regular meeting of the Weld County Planning Commission was held on June 3,
1985, in the County Commissioners' Hearing Room, Weld County Centennial
Building, 915 Tenth Street, Greeley, Colorado. The meeting was called to
order by the chairman, Bob Ehrlich, at 1:30 p.m.

REQUEST: A Use by Special Review Permit for a Livestock Confinement
Operation
LEGAL DESCRIPTION: Part of the W1 SW1, Section 8, T6N, R64W of the
6th P.M. , Weld County, Colorado
LOCATION: Approximately two (2) miles south of Galeton; north of Weld
County Road 70 and east of Weld County Road 51
APPEARANCE:
Melvin Dinner, Attorney-at-Law, represented the applicant, Ivan Collins,
President, who was also present. Mr. Dinner stated this is not a new
operation, it is just an expansion and has been in operation about twelve
years. This is primarily a sheep feeding operation; they are custom feeding
lambs for Monfort of Colorado. Pens one through nine, and twelve through
fourteen are existing. The other pens, fifteen through twenty-two are new.
There is seventy-six acres, more or less, on this parcel of land. The
previous feed yard used about seven acres and the expansion will use
approximately fourteen acres. This will allow about twenty-one thousand
head of sheep to be on feed. There will not be an appreciable increase in
traffic. Once a week Monfort's delivers feed and this will not change.
They take delivery about twice a day, five days a week. The pens are in
place and all construction is completed with the exception of the lagoon.
Mr. Collins did not realize that he needed a Use by Special Review Permit to
expand his operation. The lagoons will be installed according to all state
and Weld////County Health Department standards.

The Chairman asked Mr. Dinner and Mr. Collins if they had reviewed the
recommendations, conditions, and Operation Standards as outlined by the
Department of Planning Services staff. Mr. Dinner reported they have and
are in agreement with them.
The Chairman called for discussion from the audience.
Elmer Frantzen, adjacent property owners, stated he is not especially
against this request, but as the feedlot has gotten larger the odor has
become worse and he does object to that. He is afraid a holding pond could
make this problem worse.
Roy Carlson, surrounding property owners, reported he does not object to
this request if it is not going any farther north than the existing feedlot
operation because they would get the run-off from the pens.
Bob Carlson, surrounding property owner, reported there has currently been a
problem with the manure getting into the irrigation ditch.
Bob Ehrlich, Chairman, stated he owns property in this vicinity. Therefore,
he will continue to chair the meeting but abstain from voting.
Bruce Barker reported that according to a conversation he had with the
Health Department this morning, the holding pond will allow for a
twenty-five year flood. Also, this sheep feeding operation is an old
Nonconforming Use which the applicant is now expanding. The application for
the Use by Special Review permit resulted from violation case #619:85:66.
The Chairman asked Gloria Dunn the read the recommendation, conditions, and
Operation Standards as outlined by the Department of Planning Services staff
into the record.
MOTION:
Doug Graff moved Case Number USR-682:85:26 for Mile-Hi Sheep Company for a
Use by Special Review Permit for a Livestock Confinement Operation be
forwarded to the Board of County Commissioners with the Planning
Commission's recommendation for approval based upon the recommendations,
conditions, and Operation Standards as outlined by the Department of
Planning Services staff and the testimony heard by the Planning Commission.

Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Louis Rademacher - yes; Bill McMurray - yes;
Paulette Weaver - yes; Doug Graff - yes; Lydia Dunbar - yes; Sharon
Linhart - yes; Bob Ehrlich - Abstain. Motion carried with six voting for
the motion and one abstaining.

Keith Abbott, President, RA Resources, Inc. , reported they plan to drill two
oil and gas wells in this area. They have met with the city of Greeley and
will be drilling and casing according to their recommendations. They have
reviewed the recommendations, conditions, and Operation Standards as
outlined by the Department of Planning Services staff and are in agreement
with them.

The well sites will be about eight hundred feet from the nearest residence.
The Chairman called for discussion from the audience.
Robert Francis, surrounding property owner, asked if they had already leased
the mineral rights for these wells. He is not opposing this proposal, but
he concerned about groundwater.
Jim Taylor, surrounding property owner, stated he is concerned with the
noise and traffic that would be going along with the drilling activity.
Keith Abbott reported there will be a lot of traffic until the well has been
drilled and fracted, but after that there should not be a lot of additional
traffic. Also, they have leased the mineral rights and there will be no
pool resources.

Services subject to the Operation Standards listed hereon.
2. Retention of feedlot run-off shall be accomplished in accordance with
the Colorado Department of Health regulations. The applicant shall be
responsible for any additional requirements issued by the Colorado
Department of Health, Water Quality Control Division.
3. All phases of the operation shall comply with all County and State
Health Standards and Regulations pertaining to air quality, water
quality, noise emission, and sanitary disposal systems.
4. The Use by Special Review plat shall be amended to include the
retention pond area. Additional structures for waste retention shall
meet Weld County setback requirements.
5. There shall be no discharge of wastes into any streams, other bodies of
water, or adjacent drainage systems without obtaining a National
Pollution Discharge Elimination System Permit from the Department of
Health.
6. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.

Dear Milt:
The Greeley Field Office staff reviewed the Weld Co. Planning Services referral for
Mile-Hi Sheep Co. for a Use by Special Review for a livestock confinement operation
to be located in WI SW4 of Section 8, T6N, R64W, 7 miles southeast of Eaton ; north
of Weld Co. Rd . 70 and east of Weld Co. Rd. 51 . The results of that review are as
follows :
1 ) At this time, there isn' t a waste retention facility for the current
operation which would be in violation of current Colorado Health
Department policy.
2) Not all residences within ₹ mile of location are shown on vicinity map.
3) Land slope of adjacent land is such that all surface runoff can pos-
sibly pass through pen area defined. Provisions must be made to divert,
intercept or otherwise handle foreign surface water around the site or
it will contribute significantly to the storage size needed for waste
retention pond.
4) There was no waste management plan submitted with the application for
review that indicated location of manure stockpile, storm runoff rout-
ing, or size and location of the waste retention pond. Without a plan ,
it is difficult to determine adequacy of facilities being planned.
From our past experience in the planning area, we know there are
seasonally high water tables which could probably limit the construction
depth of a retention pond to at least 2 feet . If foreign storm water
is routed around the site, there are still approximately +20 acres of
drainage area to be contained in a retention structure. This will require
approximately a 54 acre foot storage for a 25 year/24 hour storm runoff
as required by the Colorado State Health Department. With the depth
restriction , it is doubtful a pond of proper size can be constructed in
the area indicated.
I recommend that this request be denied until Mile-Hi Sheep Co. can hire a registered
engineering firm to assess and design a waste holding facility for this operation
that will meet Colorado Health Department standards .

NOTICE OF PUBLIC HEARING
The Weld County Planning Commission will conduct a public hearing on June
18, 1985 at 1:30 p.m. to review a request for approval of a Use by Special
Review Permit for a livestock confinement operation from Mile-Hi Sheep
Company on a parcel of land described as Pt. W1 SW1 of Section 8, T6N, R64W
of the 6th P.M. , Weld County, Colorado, containing 76.57 acres, more or
less.
The public hearing to be held by the Weld County Planning Commission for the
consideration of the above referenced request will be conducted in the Weld
County Commissioners' Hearing Room, First Floor, Weld County Centennial
Center, 915 Tenth Street, Greeley, Colorado. Comments or objections related
to the above request should be submitted in writing to the Weld County
Department of Planning Services, 915 Tenth Street, Room 342, Greeley,
Colorado 80631, before the above date or presented at the public hearing
on June 18, 1985.

Detailed Description of the Proposed Operation and Use
(a) Explain proposed use. The property involved is described as
Lot A of Recorded Exemption No. 0801-8-3-RE 124 as recorded April 16,
1974 in Book 712 under Reception No. 1634369 of the Weld County records,
being a part of the Wi of the SW/ of Section 8, Township 6 North, Range
64 West of the 6th P.M. , Weld County, Colorado, containing total acreage
of approximately 76.57 acres. The property is currently used for
agricultural purposes, including irrigated farming and feeding of
approximately 12,000 head of sheep. The existing feedlot facilities
located on the property provide a capacity for feeding approximately
12,000 head of sheep. The proposed use of the property under the Use by
Special Review Application consists of an expansion of the feedlot
facilities from approximately 7.05 acres to approximately 14 acres, with
the feedlot capacity being increased from approximately 12,000 head of
sheep to approximately 21,000 head of sheep. The proposed use will
provide for commercial lamb or sheep feedlot operation. At the present
time, sheep are being commercially fed exclusively for Monfort of
Colorado, Inc. Monfort of Colorado, Inc. provides the feed supplies to
the feedlot and the feedlot custom feeds and cares for the sheep located
in the existing feedlot facilities. It is intended that the feedlot
facilities be expanded to provide greater capacity for the commercial
sheep feeding operations.
(b) Explain the need for the use. The expansion of the existing
facilities are needed in order to provide additional space and capacity
for the custom feedlot operations in order to supply a constant, stable
flow of slaughter lambs for the slaughter needs of Monfort of Colorado,
Inc.
(c) Explain the types of existing uses on surrounding properties.
The surrounding properties are similarly engaged in agricultural
operations, including irrigated farming operations and existing
livestock dairy operations. Three of the surrounding farms are engaged
in livestock dairy operations, these three farms are adjacent to the
Applicant' s property.
(d) The distance of the proposed use to residential structures in
each direction.
(e) The maximum number of users, patrons, members and buyers. N/A
(f) The number of employees, number of shifts and hours of
operation. Three employees, one shift, 10 hours.
(g) The type of water source for the proposed use. North Weld
County Water District.
(h) Explain the access routes to be utilized for the proposed use.
Weld County Road 51.
(i) Explain the type, size, weight and frequency of vehicular
traffic associated with the proposed use. Tractor with grain trailer
attached, delivering feed supplies for the livestock feeding of the
sheep, approximately once per week. Tractor with livestock trailer
attached, approximately two daily five days per week. The trailer units
will approximate 75,000 lbs. to 80,000 lbs. of weight. There will be
little, if any, change, in the vehicular traffic from the existing
pattern of use.
(j) The type of sewage facilities for the proposed use. N/A
(k) A description of the proposed fire protection measures
associated with the proposed use. Caleton Fire Department is located
1-3/4 miles north of the existing feedlot facilities. Fire
extinguishers are located in each of the two feed trucks, and water
hydrants are now located in each of the pens.
(1) The types and maximum number of animals to be concentrated on
the Use by Special Review area at any one time. The present capacity of
the feedlot facilities is approximately 12,000 head of sheep. The
expansion requested would provide capacity for approximately 21 ,000 head
of sheep.
(m) The type and size of any waste, stockpile or storage areas
associated with the proposed use. Feed supplies consisting of shelled
corn and ground hay are currently stockpiled on the premises and would
continue to be stockpiled in a similar fashion if the expansion of the
feedlot capacity facilities are granted. Manure is cleaned from the
feedlot facilities, that is, from the pens, approximately two to three
times per year and is stockpiled until spread upon the farm area.
Nearby farmers are constantly requesting the use of the stockpiled
manure and much of the stockpiled manure is taken by neighboring or
local farmers immediately upon being stockpiled who utilize the manure
in their farming operations. The stockpile of manure occurs for only a
short period of time because of the active demand for its use by the
neighboring farmers, as well as the use of the manure on Applicant's
premises. It is typically only during the winter season that the
stockpile of manure accumulates to any degree. The manure is stockpiled
for use by the Applicant herein on his own farm property as well as for
use by neighboring farmers. The stockpile of manure would not continue
for a period of probably more than two months' duration at any time.
(n) Type of storm water retention facilities associated with the
proposed use. It is anticipated that a lagoon will be constructed in
the southwest corner of the farm to provide adequate storm water
retention facilities in connection with the increased feedlot operation.

(o) The time schedule and method of removal and disposal of
debris, junk and other wastes associated with the proposed use. Manure
which is stockpiled on the premises is moved directly to the fields of
the Applicant herein when possible, and also by neighboring farmers to
their fields when possible. The stockpile accumulation is probably no
more than one to two months in duration at any particular time.
(p) Explain proposed landscaping plans and erosion control
measures associated with the proposed use. N/A
(q) A time table showing the periods of time required for
construction and start up of the proposed use. The expansion facilities
have already been constructed.
Statement Explaining How the Proposal is Consistent with the Weld County
Comprehensive Plan. The area in question is zoned A-Agirulcure and is
utilized in connection with irrigated farming operations and numerous
livestock feeding operations and dairy operations. The expansion
facilities are consistent with the protection and preservation of
agricultural zoning and would simply continue that form of use.
Statement Explaining How the Proposal is Consistent with the Intent of
the District in which the Use is Located. The Applicant's farm and
adjacent areas are utilized in connection with livestock feeding
operations and dairy operations. The Special Use Permit request herein
requests expansion of existing facilities and not construction of new
facilities and is consistent with activity now occurring in the general.
area and neighborhood involved.
Statement Explaining What Efforts have been made in the Location
Decision for the Proposed Use to Conserve Productive Agricultural Land
in the Agricultural Zoned District. The expansion consists of continued
use of agricultural activities.
Statement Explaining There is Adequate Provision for the Protection of
the Health, Safety and Welfare of the Inhabitants of the Neighborhood
and the County. The expansion plan includes the construction of a
lagoon in the southwest corner of the farm to intercept drainage from
the livestock feeding facilities.
Statement Explaining the Uses Permitted will be Compatable to the
Existing Surrounding Land Uses. The Applicant's land, as well as
adjacent existing land, are all zoned A-Agricultural and are utilized in
similar fashion, that is, irrigated farming practices and livestock
feeding operations.
Statement Explaining the Proposed Use will be Compatable with the Future
Development of the Surrounding Area as Permitted by the Existing Zone
and with Future Development as Projected by the Comprehensive Plan of
the County or the Adopted Master Plans of Affected Municipalities. It
is presently anticipated that the area involved, including the land of
the Applicant herein as well as land of surrounding landowners, will
continue to be used for agricultural pursuits, including farming and

livestock feeding operations. The proposed used will therefore be
compatable with future development of the surrounding area.
Statement Explaining the Use by Special Review Area is Not Located in a
Floodplain, Geologic Hazard and Weld County Airport Overlay District
Area; or that the Application Complies with Section Fifty (50) , Overlay
District Regulations as Outlined in the Weld County Zoning Ordinance.
The area in question where the Special Use Permit is requested is not
located in a floodplain, geological hazard or the Weld County Airport
Overlay District area.
Proof that a Water Supply will be Available Which is Adequate in Terms
of Quantity, Quality and Dependability (e.g. , a Well Permit or Letter
from a Water District) . Letter dated May 2, 1985 from North Weld County
Water District confirming and verifying that adequate water supply in
terms of quantity, quality and dependability is available for the
livestock feeding operations contemplated is attached hereto.
Copy of the Deed. Copy of deed dated October 26, 1973, recorded
October 31, 1973 in Book 702 under Reception No. 1623904 is attached
hereto.
Noise Report. N/A This is a request for an expansion of existing
feedlot facilities. The feedlot facilities are already in place and
being operated.
Soil Report. Soil report prepared by the Soil Conservation Service is
attached hereto.

Dear Members of the Board:
We wish to inform you that Western Technical Services, Inc. has been
retained by Mile—Hi Sheep Company to design waste retention facilities
for their feedlot. The feedlot is located in the West half of the
Southwest quarter of Section 8, T6N, R64W; North of WCR 70 and East
of WCR 51.
We met with Mr. Ivan Collins and inspected the feedlot site. Irrigation
wastewater and stormwater runoff are diverted around the feedlot by
irrigation ditches. Feedlot runoff will be carried to the retention
site through separate drainage swales. The proposed retention site
is located in the southwest corner of the feedlot site. A second
smaller retention pond may be proposed for the two pens in the northeast
corner of the feedlot. The retention facilities will be designed
and constructed according to the Colorado Department of Health guidelines
and specifications.
Material will be excavated and used to build dikes along the west
and south sides of the retention pond. We do not anticipate any problems
in providing adequate retention facilities. We estimate that the
design of the retention facilities can be completed by the end of
this month.
