HomeMy WebLinkAbout881062.tiff RESOLUTION RE: DENIAL OF RECORDED EXEMPTION NO. 1114 - RONALD GRUEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS , as amended, at a public meeting held November 7 , 1988 , in the Chambers of the Board, did consider the request of Ronald Gruen for Recorded Exemption No. 1114 , regarding property which is located in the Si of Section 22 , Township 6 North, Range 64 West of the 6th Y.M. , Weld County, Colorado, and WHEREAS, the request was to divide the property into parcels estimated to be approximately 109 acres and 19 acres. WHEREAS, after hearing the testimony presented and reviewing the recommendation of the Planning staff, the Board determined that said request for Recorded Exemption No. 1114 should be denied. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request from Ronald Gruen for Recorded Exemption No. 1114 on the hereinabove described parcel of land be, and hereby is, denied. The legal description for this parcel is described as Lot B of RE-256, located in the Si of Section 22, T6N, R64W of the 6th P.M. , Weld County, Colorado. The parcel is located approximately 5 miles north of the Town of Gill, east of Weld County Road 55, and north of Weld County Road 66. This request is to divide a 128.9 acre tract of land, which is the total contiguous land holdings of the applicants, into two (2) lots of 109 acres and 19 acres, more or less. It is the opinion of the Department of Planning Services' staff that this request should be denied. The applicant has failed to explain how this application is consistent with the Weld County Comprehensive Plan and how the configuration of the land split is consistent with efficient and orderly development. Since 1978, the south half of Section 22 has been involved in 5 land splits creating a total of 7 parcels eligible for a residence. This parcel is Lot B of a recorded exemption approved in 1978 and amended in 1986. The approval of this request would create the eighth parcel within this half section. The Department of Planning Services' staff has concerns about the piecemeal type of development occurring and the potential for it to continue in this section. Parcel splits in this area are reaching a level where continued divisions would evade the purpose of the Weld County Subdivision Regulations as defined in Section 1-3. Residential development in rural areas necessitates an increased demand for road maintenance, police and fire protection, school busing, snow removal, utilities, and other urban services. As density increases, so do service demands. The 128.95 acre parcel is in crop production at this time. The 19 acre parcel is in pasture. It appears that at one time the 19 acres was also in crop production. Access to the proposed Lot A is off of Weld County Road 66, a gravel county local. The purpose of the Recorded Exemption is to establish two separate parcels of property; the smaller of which will contain approximately 19 acres; the larger of which will contain approximately 109.959 acres. The dnsi gnatien of the acreage being assigned to the smaller parcel corresponds with presently non-producing agricultural land that is utilized for pasture purposes only. The smaller parcel, though designated irrigated land, has not (for a nuMber of years) been irrigated. It is not essential to agricultural pursuits that it be carried with the larger parcel of land which consists primarily of the growing of alfalfa through irrigated farm land. The smaller parcel is presently unused land. It is applicants intent to obtain a Recorded Exemption so he can sell the smaller parcel of land which could then be used for the purpose of an estate type or rural country lane development. Applicant would state that there are numerous other such developments within the inmediate vicinity of the proposed property. Indeed, the property that applicant owns was once subject to a Recorded Exemption and it was the larger parcel of that Recorded Exemption which was maintained for agricultural purposes and dnprises the entire acreage owned by applicant. The smaller parcel which was originally broken off is presently occupied by an individual who is not in the farming business but lives on rural acreage with pasture for one horse in an estate or country have living arrangement. Two other such arrangements exist i nediately to the South and West of the subject property. Applicant desires to develop just such a similar use. Applicant will only need to generate funds from the sale of this property so that he can build his own private residence (which is not necessarily to be located upon the subject property). Applicant believes that this proposal is consistent with the policies of the Weld County Comprehensive Plan in that he intends to take no presently utilized agricultural land out of production, but rather intends to place the land to a higher and better use which includes only the availability of a smaller parcel of land for the purposes of a rural or country Niue setting. In that regards, applicant stows on the maps contained in the attached filing where proposed easements will need to be created both for access to and fran the subject properties and also for the carrying of water for minor irrigation purposes upon the property. The only uses that are intended to be permitted upon the properties being divided by this Recorded Exemption Application are to continue the agricultural pursuits on the larger parcel as has been the case in the past, and to create the possibility of the use of the smaller parcel for primarily a residential purpose. Nothing proposed by this Recorded Exemption would be incaipat:ible with the future development of surrounding areas or the comprehensive plan of Weld County, or for, that matter, any adopted master plans of affected municipalities. In regard to this later point, applicant would show that the nearest municipality appears to be Kersey, Colorado well over six miles away. It is doubtful whether this land is within any towns projected future 881062 development. In addition, the present utilization of surrounding acreage in this immediate area include the exact same mix that applicant is t=ying to obtain (i.e. continued utilization of highly producing farm land for agricultural purposes and the availability of single family dwelling sites upon the nonproductive or utilized agricultural lands). Therefore, nothing is or could be considered inconsistent with the efficient and orderly development under Weld County Comprehensive Zoning Plan. The only water presently utilized on either of the subject properties is for irrigation purposes and consists primarily of two shares of the Larimer and Weld River Water. There is no domestic water systems upon the property. In audition, there is owned by applicant, water rights for carrying cc..., only in various ditch systems and at least three of said shares will be transferred to any purchaser of the smaller parcel so that they will have available (if they wish to purchase or rent irrigation water) the ability to maintain pastures, grow grass, etc. Applicant has additionally checked with the North Weld Water Conservancy DisLsict and they have provided a letter which is attached to this application stating that water service can be made available to either of the described parcels of land from the frontage of both parcels on WCR 66. Therefore, domestic water is available to either parcel, if needed at any time in the future. There are no sewage facilities servicing these areas. All sewage is presently done through the use of septic systems which are common in this area. It would be proposed that if domestic use of the smaller parcel becomes a reality in the future, a septic system will be used for the handling of sewage wastes created thereby. There is no intent at the present time to have or utilize any sewage treat.itsst or facilities off the larger parcel. Applicant additionally certifies that none of the property as under consideration for this Recorded Exemption is located within a flood plain, geographic hazard, or Weld County Airport overlay districts.
