Dear Mr. Burtis:
The Board is in receipt of your letter and petition of September 19, 198E,
in which you request a rehearing on USR 710:85:55. The Board has reviewed
the law and facts and unfortunately has found no basis to grant your
request.
The applicant has commenced construction of the operation in an area } to
mile distant from the persons in your petition. There is no basis in th,--
County regulations for a rehearing, particularly where the permit holder has;
relied upon the grant of the permit and a significant length of time hs
elapsed since your group acquired knowledge of the permit. To reconside-
the permit under these circumstances subjects the County to claims by the
permit holder regarding interference with their use of their property.
It would appear that the Board had jurisdiction to grant the permit in that
there was technical compliance with the posting requirement of the Zoniic„
Ordinance and other forms of notice were properly given. The Boar::
understands that the Planning Commission directed the staff to consider
rewording of the Ordinance to clarify the issue you have raised and thi '
Board will consider any recommendation of the Planning Commission.
