WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the ND affairs of Weld County, Colorado, and o U 0 o WHEREAS , a public hearing was held on the 16th day of October, 1985 , at 2 : 00 p.m. for the purpose of hearing the application of H. Gordon Johnson, et al. , 3502 Rangeview Road, a Greeley, Colorado 80634 , requesting a Change of Zone from PUD (Planned Unit Development) to A (Agricultural) o a land located on the following descri described real estate, to-wit: cel of in- 43 oPart of the 5', Section 12 , Township 4 North, Range 65 West of the 6th P.M. , Weld County, Colorado v. a o- 0 WHEREAS, Section 21 .6 . 2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request N H of the applicant and the recommendations of the Weld County Planning Commission and, having been fully informed , finds that this request shall be approved for the following reasons: 1 . REQUEST: A Change of Zone from PUD (Planned Unit Development) to A (Agricultural) LEGAL DESCRIPTION: Part of the sz, Section 12, T4N, R65W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 5 miles southeast of La Salle APPEARANCE: Steve Wernsman, P.E. , Western Technical Services, reported the applicants want to change the zoning on this parcel from Planned Unit Development back to Agricultural for the development of oil and gas. Since this use is not a use by right in the planned unit development zone district, but it is allowed in the agricultural zone district they wish to have the zoning changed back to agriculture. If, at some later date, after the extraction of oil and gas is completed, they see a need for a planned unit development they will ask to have the zoning returned to planned unit development. H. Gordon Johnson, property owner and applicant, reported he and Fred Arens own lots A and B and not all of the property on which the change of zone from agricultural to planned unit development occured. They are asking that these two lots be returned to agricultural zoning. At the time they asked for a change of zone it seemed their was a need for an airpark. Since the zoning was approved economic conditions, etc. , seem to have changed and the land will be more productive with agricultural zoning. If the property is again zoned planned unit development it will be much easier to plan the lots and housing around existing oil activity than it would be to drill -and locate tank batteries, etc. , in a residential area. It was his feeling, proposed residents would readily accept what is already there easier than they would _accept oil and gas activity coming into a developed area. The Chairman called for discussion from the members of the audience. There was none. The Chairman asked Mr. Johnson if he had read the recommendation and conditions as outlined by the Department of Planning Services staff.
