RE: APPROVAL OF RECORDED EXEMPTION NO . 1050 - DAVID E. CAMENISCH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 1050 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 1050 was
submitted by David E. Camenisch for property which is located in
part of the NE} of Section 10 , Township 2 North, Range 68 West of
the 6th F.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant and
known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
of 1 . 404 acres and 1 . 152 acres, more or less .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be , and hereby is , exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following: 1) Prior to recording the plat,
the applicant shall submit to the Department of Planning Services
an access plan approved by the Colorado State Highway Department;
and 2) The applicant shall submit a mylar plat to the Department
of Planning Services to be recorded in the office of the Weld
County Clerk and Recorder. The plat shall be drawn in accordance
with the requirements of Section 9-2C. (4) of the Weld County
Subdivision Regulations . The plat shall be submitted within sixty
days from the date of approval by the Board of County
Commissioners .

Planning Services an access plan approved by the Colorado State Highway
Department.
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded into the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirement of
Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat

Dear Commissioners:
This request for a Recorded Exemption is submitted by David E. Camenisch.
The parcel of land on which this request is being made is described as part
of the NE} of Section 10, T2N, R68W of the 6th P.M. , Weld County, Colorado.
The property is located on State Highway 119, approximately one—quarter of a
mile west of I-25. The parcel under consideration is the total contiguous
land holdings of the applicant. The request is to divide the property into
two parcels of 1 .404 acres and 1. 152 acres, more or less. There is an
existing home on the western portion of the parcel. This parcel of land is
zoned C-3 (Commercial) .
Based upon the submitted information and the policies of the County, the
Department of Planning Services' Staff recommends the request be denied.
The applicant has not demonstrated that an adequate water supply exists for
both proposed parcels. Lefthand Water Supply Company currently supplies the
2.556 acre parcel as indicated in their letter dated August 25, 1987,
submitted along with the application. This letter explains that the
applicant has one tap available to be used on the proposed site with a
commercial classification. The application failed to show that an
additional tap is available for the additional lot. The lack of water to
the proposed site is reiterated in a memo submitted October 5, 1987, by
Lefthand Water Supply Company. This memo is attached for your review.
The staff recommends that the Board of County Commissioners consider this
request and determine if the standards of Section 9-2 E. (1) (a) through (m)
of the Weld County Subdivision Regulations have been met.

Dear Mr. Bingle:
On September 11, 1987 we made comments regarding the Camenish Exemption.
We would like to provide additional comments.
We would consider the option of a frontage road along the south side.
The frontage road concept should be similar to the one we are proposing for
the north side of S.H. 119 in the same vicinity. Investigation of property
ownerships would be needed to determine the feasibility of extending the
frontage road westward. Adequate distance would be needed between the frontage
and S.H. 119 where access to S.H. 119 from the frontage road occurs. Without
proper distance, signalization becomes a problem.
We would be happy to work with the applicant and the County in determining
the possibilities for frontage road alignment.

Confirming our recent telephone discussion, there is
currently one residential water tap at Mr. Camenisch's
property at 3818 State Hwy. 119. Additional taps at
this location are not currently available due to the
lines in the area being at full capacity. This situa-
tion could change if a main line extension was
completed, but at this time I do not know when and if
this will be done.

Dear Mr. Bingle:
Thank you for sending the City of Longmont the application from David
Camenisch for a recorded exemption to split a 2.5 acre lot into two lots . The
proposed lots are located in the Del Camino area west of I-25 and south of
SH119. According to the application, Taco Bell is the intended purchaser of
one lot. The other lot also is proposed for development by another national
franchise.
From our telephone conversation, I understand that the Colorado Department
of Highways (CDOH) exercises access control along this section of SH119 and
will require that both lots share an access. The Planning Staff supports this
requirement and compliments both Weld County and CDOH on their efforts to
control the proliferation of access points in the vicinity of I-25 and SH119.
We appreciate the opportunity to comment.

4 . It is requested by the owners that the lot referred to as
13- 10- 1 RE 344 be divided into two separate lots for the purpose

Re: Saint Vrain Sanitation District - Commitment to Serve
Dear Mr. Camenisch:
This letter is in reference to two tracts of land located in Section 10,
T2N, R68W of the 6th P.M. along Colorado Highway 119, comprising two and
one-half acres and 160 acres. This land is partially within the Saint
Vrain Sanitation District, with the balance in the process of being
brought into the District.
The District's collection system is presently under construction and its
treatment plant is under contract for construction. Both are scheduled
for completion and activation by the end of 1987.
Upon completion of construction, the District hereby commits itself to
serve the above-referenced tracts, with a reservation for 163 sin-
gle-family tap equivalents, subject to the following:
a. Installation of on-site collection system and connection to the
District' s system by the applicant;
b. Execution of a Service Agreement;
c. Purchase and payment of the required number of taps; and
d. Compliance with the District's Rules and Regulations.
This commitment to serve shall remain valid for a period of one year
after system completion, or until December 31 , 1988.

The completion date for the treatment plant is December 5, 1987. The
contractor is off to an excellent start. Every indication points toward
his completing the work on schedule.

December 5, 1987. The contractor, Trainer Construction Company, has
completed 46% of the work, including having completed the four bores,
indicating that he will also be complete by this date.

We have reviewed the David Camenisch exemption application, and we have
the following comments:
The proposed division of this property would create two lots for the
purpose of commercial development. It is apparent from the exemption plat
that direct access to State Highway 119 would be requested. Only one access
would be permitted to S.H. 119 for both of these lots since no other access
is available.
Although a single direct access to S.H. 119 would have to be permitted
at present time, we want to bring to your attention our concern with regard
to access control along S.H. 119. The commercial development anticipated
by this exemption would continue the pattern of development along S.H. 119
west of I-25. Due to the designation of S.H. 119 as a "Cateogry Two" highway
with deeded access control, it is important to realize that access to abutting
property is subordinate to serving the needs of through-traffic. With this
in mind, we expect to work closely with Weld County to achieve a road system
in this area so that the need for direct access to the highway can be minimized.
As noted above, the access to this property from S.H. 119 is controlled
by deed. Our records indicate a single 30-foot opening was allowed at a
point which approximately corresponds to the line which divides Lot "A" from
Lot "B". The existing access to the house was actually built on the west
side of proposed Lot "A", according to our field review.
The proper location of an access to the two proposed commercial lots
is directly across from the existing exit-only from the Loves Truck Stop.
This would allow vehicles leaving the Loves site to cross S.H. 119 at a right
angle to enter the access to the two commercial lots. A south-facing sign
would need to be placed at the Loves exit indicating that no entry is permitted
by vehicles leaving the access on the south side of S.H. 119.

Approval of an access at the location described above requires two levels
of review. First, the relocation of the deeded 30-foot opening involves
a written request to this office for the specified opening along with a $300
fee. This information is reviewed and forwarded to the Denver office for
approval. This request should be directed to the District 4 Right of Way
Supervisor, Mr. Rex Touslee (350-2152).
The second level of approval relates to the actual construction of the
access. An Access Permit from this office is required. Application for
this permit is made to Mr. Dean Yost (350-2113) .
