RE: APPROVAL OF RESUBDIVISION, UNION COLONY SUBDIVISION - ALLAN
W. SMITH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 22nd day of January, 1986 , in a public
meeting, the Board considered the request of Allan W. Smith for
the resubdivision of part of Lots 1 , 2 and 3 , Union Colony
Subdivision in the SEQ SEq of Section 10 , Township 5 North, Range
65 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS , the Board reviewed the submitted evidence and heard
the testimony of those present, and
WHEREAS , the Board, having considered the recommendation of
the Weld County Planning Commission, finds that the resubdivision
request concerning the aforementioned lots of the Union Colony
Subdivision, shall be approved for the following reasons:
1 . The resubdivision conforms with the application
requirements of Section 6-4 D. of the Weld County
Subdivision Regulations.
2 . The resubdivision conforms with the application
requirements of Section 6-4 E. of the Weld County
Subdivision Regulations.
3 . The following referral entities have reviewed this
request and set forth no objections:
a. The Greeley Planning Commission.
b. The Weld County Engineering Department.
c. The Greeley Soil Conservation District.
d. The Western Hills Fire Protection District.

- WHEREAS, the Board' s approval is subject to the following
conditions:
1 . -No building or electrical permits shall be issued on the
property until the resubdivision plat has been delivered
-to the Department of Planning Services Office and the
plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
2 . 'The Resubdivision plat shall be amended to include a
note on the plat stating, "In the event Lots 1 and 2 are
conveyed separately , an agreement regarding the use and
-maintenance of the septic system shall be formulated
between the two parties. "
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request for the
resubdivision of part of Lots 1 , 2 and 3 , Union Colony Subdivision
in the SE, SEa of Section 10 , Township 5 North, Range 65 West of
the 6th P.M. , Weld County, Colorado, be, and hereby is, approved
subject to the above listed conditions.
'The above and foregoing Resolution was, on motion duly made
-and seconded, adopted by the following vote on the 22nd day of
January, A.D. , 1986 .

Moved by Paulette Weaver that the following resolution be introduced for
passage by the Weld County Planning Commissi-on. Be it Resolved by the Weld

Lot 1 contains a single family residence. A pond and fish raceway are
located to the north of the buildings. An abandoned county road bisects
proposed Lot 4 of the parcel.
