The State Engineer intends to promulgate rules and regulations pursuant to
the Administrative Procedures Act, Section 24-4-103 C.R.S. These rules and
regulations will prescribe reasonable criteria and procedures for the
applications for, the evaluation, the issuance, the extension, and the
administration of, such well permits to withdraw ground water pursuant to Section
37-90-137 (4) C.R.S. The State Engineer anticipates adopting rules and
regulations in accordance with Section 37-90-137(9)(a) to govern the statewide
procedures by which permits are issued. A separate set of rules and regulations
will be promulgated in accordance with Section 37-90-137(9)(b) which will apply
exclusively to the evaluation of permits in the Dawson, Denver, Arapahoe, and
Laramie-Fox Hills acquifers.
Notice of the formal rulemaking hearings will be published in the Colorado
Code of Regulations and the Colorado Register as required by Section 24-4-103(3)
and (11) .
The State Engineer hereby invites interested persons to submit views and to
participate in informal conferences to discusss topics and materials to be
included in the rules . A meeting to discuss the statewide rules and regulations
is scheduled for Monday, August 26, from 1:00-5:00 p.m. in Room 110 of the
Centennial Building at 1313 Sherman Street, Denver, Colorado.
A meeting to discuss the rules and regulations applying exclusively to the
Dawson, Denver, Arapahoe and Laramie-Fox Hills acquifers in the Denver Basin is
scheduled for Tuesday, September 3, from 1 :00 to 5:00 p.m. in the Old Supreme
Court Chambers on the Second Floor of the State Capitol Building.
