Lacy, Chairman Commissioner C.W. Kirby, Pro-Tem - Excused Commissioner Gene Brantner Commissioner Jacqueline Johnson Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Bruce T. Barker Health Department representative, Wes Potter The following business was transacted: I hereby certify that a public hearing was conducted on October 26, 1987, at 9:00 A.M. to consider the appeal of Ronald and Mary Ann Schmunk concerning a decision by the Health Board. Wes Potter, representing the Health Department, said Mr. and Mrs. Schmunk requested a variance to connect a second mobile home to an existing septic system which is located at 38418 Weld County Road 33, Eaton. Mr. Potter said both of the mobile homes are three-bedroom, and the Health Protection staff feels that the current system is not sufficient to handle both of the mobile homes, because a 1 ,750 gallon septic tank is required for six bedrooms. Mr. and Mrs. Schmunk stated they have a receipt showing they paid for a 1 ,250 gallon septic tank, but the installer told them he did not have a tank of that size, so he installed a 1 ,500 gallon tank. Mr. Potter said the variance request was granted by the Board of Health on September 22, 1987, subject to the following three conditions: 1) The septic tank size be determined to be 1,500 gallons; 2) The absorption field be increased an additional 702 square feet; and 3) The repairs to the system be completed within 30 days. Bruce Barker, Assistant County Attorney, said this appeal was different from previous appeals because this variance request was approved by the Board of Health, and Mr. and Mrs. Schmunk are appealing the conditions.. Ronald Schmunk, one of the applicants, came foward to answer questions of the Board. Mr. Schmunk requested that, if the Board denies his appeal, he be given more time to complete the work for the absorption field. Pat Shepherd, of the Health Department, made comments concerning the absorption field. He said the 30-day requirement of Condition No. 3 is so that the work can be completed before winter sets in. Commissioner Johnson moved to deny this appeal us to Conditions No. 1 and 2; and grant the appeal as to Condition No. 3, allowing the Schmunks until May 20, 1988, to accomplish the repairs to the system.
