RE: APPROVE CONVEYANCE OF COUNTY'S INTEREST IN CERTAIN AIRPORT
PROPERTY AND AUTHORIZE CHAIRMAN TO SIGN APPROPRIATE DOCUMENTS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Weld County, Colorado, and the City of Greeley each
have an undivided 1/2 interest for property which is described as
follows:
A tract of land located in the W' of the NE4
of the SEa of Section 3, Township 5 North ,
Range 65 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in
the Quit Claim Deed, a copy of which is
attached hereto and incorporated herein by
reference.
WHEREAS, the Greeley-Weld County Airport Authority has
submitted a request to the Board of County Commissioners that it
convey, by Quit Claim Deed, its 1/2 interest in said property in
exchange for a tract of land which is owned by Claus B. Sternberg
and Lee S. Bublitz , and
WHEREAS, the property which is owned in joint tenancy by
Claus B. Sternberg and Lee S. Bublitz , tenancy, is described as
follows :
A tract of land located in the SE' of Section
3, Township 5 North , Range 65 West of the 6th
P.M. , Weld County, Colorado, being more
particularly described in the Quit Claim Deed,
a copy of which is attached hereto and
incorporated herein by reference.
WHEREAS, in order to complete said transaction the
Greeley-Weld County Airport Authority further requests that the
Board execute the Closing Agreement for Trade of Real Estate, a
copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BF IT RESOLVED that the Board of County
Commissioners of Weld County, Colorado, does hereby approve the
conveyance of its 1/2 interest in the property hereinabove
described, by Quit Claim Deed to Claus B. Sternberg and Lee S.
Bublitz.

BE IT FURTHER RESOLVED by the Board that it hereby approves
the purchase of the property, as hereinabove described, being
traded from Claus B. Sternberg and Lee S. Bublitz .
BE IT FURTHER RESOLVED by the Board that it hereby approves
the Closing Agreement for Trade of Real Estate.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign all necessary documents.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 8th day of

CLOSING AGREEMENT FOR TRADE OF REAL ESTATE
This Agreement made this day of
and between the CITY OF GREELEY and the ena1986 by
referred to as "City/County, " and CLAUS B. COUNTY OF WELD, Serinafter
SPERNBERG and LEES. BUBLITZ,
hereinafter referred to as "Sternberg and Bublitz. " The purpose of
this Agreement is to set forth the closing arrangements between the
parties for an exchange of real estate.
The City/County are the owners of the real estate shown on "Exhibit
A" and agree to convey the same to Sternberg and Bublitz with all
easements and rights-of-way appurtenant thereto in its present condition
by good and sufficient Quit Claim Deed, with no encumbrances. The
City/County authorize the Airport or its attorney to close the transaction
on the terms specified herein.
Sternberg and Bublitz are the owners of the real estate shown
on "Exhibit B" and agree to convey the same to City/County with all
easements and rights-of-way appurtenant thereto in its present condition
by good and sufficient Quit Claim Deed, with no encumbrances.
Both properties shall be subject to building and zoning regulations
pertaining thereto and shall be free and clear of all liens and encimr
brances. Neither property shall be subject to any leases or tenancies.
Both parties have examined the properties (which they are taking)
and accept the same in their present condition. Possession is to
be transferred concurrently with the transfer of title.
The parties agree that the properties that are being exchanged
are of equal value and no additional cc npensation is to be paid to
either party.
General taxes for the year of closing shall not be adjusted or
prorated, each party to pay the full year's taxes on the parcel being
sold when due in 1987.
Title Insurance Commitments have been provided for each of the
properties by Transamerica Title Insurance

Dear City Council and Weld County Connissioners:
I am writing this letter on behalf of the Greeley-Weld County Airport
Authority. The Authority has been working on a trade of land with
Claus B. Sternberg and Lee S. Bublitz for over two years. The land
the Authority wants to sell to Messrs. Sternberg and Bublitz is a
1.092-acre tract against which there have been sane adverse possession
claims by Messrs. Sternberg and Bublitz and their predecessors in
title. The land that the Authority wants to receive in exchange for
this contested parcel is a 1.425-acre tract in a location where the
Airport needs a retention pond.
The details of the trade between the Airport and Messrs. Sternberg
and Bublitz were all worked out when it was determined that the land
that the Authority wants to convey is actually owned by the City of
Greeley and Weld County. Accordingly, the Deeds will need to be exchanged
between the same entities.
I believe you will find the enclosed materials self-explanatory.
I have enclosed the proposed Deeds for signature by the City and County
together with a plat to show you what parcels are being conveyed and
Title Insurance Commitments reflecting the status of title.
In order to complete this transaction, the Authority needs the following:
1. Execution and return to me of the enclosed Quit Claim Deeds.
