RE: APPROVE PERMANENT EASEMENTS GRANTING RIGHT-OF-WAY TO CITY OF
GREELEY AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with three documents
concerning the granting of permanent easements for right-of-way to
the City of Greeley for the installation of certain improvements
to property located in the NE} of Section 31 , Township 6 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, after review, the Board deems it advisable to
approve said Right-of-Way Grants , with the terms and conditions
being as stated in said Grants, copies of which are attached
hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Right-of-Way
Grants hereinabove mentioned be, and hereby are , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Grants.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 8th day of
August, A.D. , 1988 .

RIGHT-OF-WAY GRANT
Know all men by these presents that Weld County, of the
County of Weld, State of Colorado, hereinafter referred to as
"Grantor" ; hereby grants and conveys to the City of Greeley,
hereinafter referred to as "Grantee" , a twenty foot ( 20 ' ) permanent
easement for a right-of-way for the purposes hereinafter set forth.
The centerline of the right of way shall be described as follows:
Commencing at the Northwest Corner of the Southeast Quarter (SE1/4)
of Section 31, Township 6 North, Range 65 West, of the 6th
Principal Meridian, Weld County, Colorado; thence North 89° 54 ' 32"
East, 10 . 00 feet to the True Point of Beginning; thence South
00° 05 ' 47" West, 31. 00 feet; thence South 17° 46 ' 10" East,
1124. 31 feet; thence South 04° 53 ' 50" East, 50 . 99 feet to a point
of termination on the North bank of the Cache La Poudre River.
The Grantor also hereby grants and conveys to the Grantee, a
temporary easement for construction purposes, being 15. 00 feet on each
side of the above-described permanent easement.
Also, right-of-way for a permanent easement as described as follows:
The West 35. 00 feet of the East 65. 00 feet of the North 881. 33
feet of the Southeast Quarter ( SE1/4) of Section 31, Township
6 North, Range 65 West, of the 6th Principal Meridian, situated
South of the Weld County Business Park P.U.D. , Greeley, Weld
County, Colorado.
The permanent right-of-way shall entitle the Grantee, it' s
successors and assigns, to install, construct, relocate, alter, repair,
inspect, maintain, remove, and operate, an underground water pipeline,
and all appurtenances thereto.
The Grantee shall bury said pipeline to a minimum depth of
approximately four and one-half ( 4-1/2) feet, fill all trenches to the
original ground surface, compact backfill as necessary to avoid

settlement, remove and restore all improvements to pre-existing
condition.
The Grantee herewith conveys to the Grantor, the sum of
$10 . 00 in consideration for such easement, the receipt of which
is hereby acknowledged.
IN WITNESS WHEREOF, the Grantors have hereunto set their
hands and seals on this 8th day of August, 1988 .

SIGHT-OF-WAY GRANT
Know all men by these presents that Weld County, of the
County of Weld, State of Colorado, hereinafter referred to as "Grantor" ;
hereby grants and conveys to the City of Greeley, hereinafter referred
to as "Grantee" ; a permanent easement for a right-of-way for the
purposes hereinafter set forth. The right-of-way shall be described as
follows:
The West 30 . 00 feet of the South 1962. 33 feet of the Northeast
Quarter (NE1/4) of Section 31, Township 6 North, Range 65 West,
of the 6th Principal Meridian, Weld County, Colorado.
The Grantor also hereby grants and conveys to the Grantee, a
temporary easement for construction purposes, being 20 .00 feet adjacent
to the East side of the permanent easement.
The permanent right-of-way shall entitle the Grantee, it' s
successors and assigns, to install, construct, relocate, alter, repair,
inspect, maintain, remove, and operate, underground domestic water
and storm drain pipelines, and all appurtenances thereto. The easement
shall also be used for above-ground drainage.
The Grantee shall bury said pipeline to a minimum depth of
approximately four and one-half ( 4-1/2) feet, fill all trenches to the
original ground surface, compact backfill as necessary to avoid
settlement, remove and restore all improvements to pre-existing
condition.
The Grantee herewith conveys to the Grantor, the sum of
$10.00 in consideration for such easement, the receipt of which is
hereby acknowledged.

'distance of 531 .86 feet to the True Point of Beginning; thence along a
curve to the right having a radius of 724.75 feet, a central angle of
22° 05' 24" and an arc distance of 279. 42 feet; the long chord of which
bears South 09° 57 ' 17" West, a distance of 277. 69 feet to a point of
tangency; thence South 21° 00 ' 00" West a distance of 250.00 feet;
thence along a curve to the left having a radius of 445. 51 feet, a
central angle of 46° 24 ' 56" and an arc distance of 360.91 feet; the
long chord of which bears South 02° 12 ' 28" East, a distance of 351.12
feet; thence South 89° 54 ' 31" West, a distance of 1976. 98 feet; thence
North 00° 00' 00" East, a distance of 320. 00 feet; thence North 90° 00 '
00" East, a distance of 500.00 feet; thence South 00° 00 ' 00" East,

The permanent right-of-way shall -entitle the
Grantee, it 's successors and assigns , to install, construct,
relocate, alter, repair, inspect, maintain, -remove, and operate,
a drainage system.
-The Grantee herewith conveys to the Grantor, the sum of
$10 . 00 in consideration for such easement, the receipt o₹ which
is hereby acknowledged.
