HomeMy WebLinkAbout880309.tiff RESOLUTION RE: APPROVE ACTION OF THE BOARD CONCERNING SERVICE PLAN FOR THE PROPOSED BRIGGSDALE FIRE PROTECTION DISTRICT WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 27th day of April, 1988 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of considering the Service Plan for the proposed Briggsdale Fire Protection District, and WHEREAS, pursuant to a letter from Robert C. Burroughs, Attorney, the proposed District is requesting that said Service Plan be withdrawn, and WHEREAS , the Board deems it advisable to grant the request to withdraw said Service Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Service Plan of the proposed Briggsdale Fire Protection District be, and hereby is, withdrawn. The matter was made of record by Lee Morrison, Assistant County Attorney, who said a letter was received from Robert Burroughs, attorney representing the district, requesting that this matter be withdrawn. Commissioner Lacy moved to accept the withdrawal of said Service Plan. Commissioner Kirby seconded the motion and it carried unanimously. This Certification was approved on the 2nd day of May, 1988. The Service Plan is now on file in the office of the Clerk to the Board of County Commissioners, 915 10th Street, Third Floor, Greeley, Colorado, and is available for public inspection between 8:00 A.M. and 5:00 P.M. , Monday through Friday. NOTICE IS FURTHER GIVEN that, by Order of the Board of County Commissioners of Weld County, a public hearing on said Service Plan will be held at the Centennial Building, 915 10th Street, Greeley, Colorado, at 2:00 P.M. , on Wednesday, the 27th day of April, 1988. The purpose of the hearing shall be to consider the adequacy of the Service Plan of the proposed Briggsdale Fire Protection District and to form a basis for adopting a Resolution approving, conditionally approving, or disapproving the Service Plan. The proposed Briggsdale Fire Protection District comprises the Weld County RE-10J Briggsdale School District, excluding Sections 29, 30, 31, 32, and 33, Township 8 North, Range 63 West of the 6th P.M. , together with 43} additional sections as outlined on the boundary map. Pursuant to Section 32-1-202, C.R.S. , the Service Plan may not be approved if a petition objecting to the Service Plan and signed by the owners of taxable real and personal property, which property equals more than fifty percent of the total valuation for assessment of all taxable real and personal property to be included in the District, is filed with the Board of County Commissioners no later than ten days prior to the hearing, unless such property has been excluded by the Board of County Commissioners under Section 32-1-203 (3.5) , C.R.S. Pursuant to Section 32-1-305(3) , C.R.S. , the owner of real property within the proposed District may file a petition with the District Court in and for Weld County, stating reasons why said propErty should not be included with the proposed District and requesting that such real property be excluded therefrom. Such petition shall be duly verified and shall describe the property sought to be excluded. The District Court will hear said petition and all objections thereto at the time of the hearing on the petition for organization and shall determine whether, in the best public interest, said property should be excluded or included in the proposed. Thcfindings report establishes a firm basis from which to project needed facilities and costa thereof. DiZCRIPTION OF AREA The proposed area comprises the total Weld County tE10J Briggsdale Zcnool District, excluding Sections 29,30,31,32, & 33 i':cige 63W Township 8N. ` he afore mentioned art:_,,; are comprised in the Galeton Fire District. Our proposed area is approximately 450 square miles (288,000 acres) ' and includes the unincorporated town cY lirigg:,c.lnle. Smith - Director Division of Fire Safety JUnTlr ICA'TION The present fire protection in the proposed district consists of (!.) 1;68 2 ton '.;..ev. fire truck. This current truck is operable, but is in need of repairs to the rusty leaking tank, and overall equipment improval. This truck is usually operated at a speed of approximately 30 to 45 M.P.H. loaded with water to the fire locations. Our current building facility is presently furnished by Weld County in conjunction with their equipment storage of a motor grader and etc. This buildings accessibility is subject to loss to our fire organization, or we may have a possible acquisition by a rental or purchase agreement with the County of Weld. i'rer;esit. /, the responsibility of fi.rrhti.n, gro:;.; fires lies under the jurisdiction of the Weld County Sheriffs Department. The present Sheriff; Li Jordan has en- couraged and requested our :formulation committee to organize cur Fire District. We have had to rely on assistance from Grover, New Raymer, and Galeton'r Fire Services because our present available equipment is not sufficiently adequate. Approximately 25 to 35 fire calls are responded to per year. Sometimes more or less depending on the types of seasons we have. 5-20 volunteers respond to any fire calls in our area. These person:., t:sve no official training, no structured organization, and are not insured. We also have ;an inadequate and limited supply of equipment for the volunteers to fight any fires eroperly. The Briggsdale Fire Truck and Ambulance Service is currently funded only by donations and support of the iiriggsdale Lions Club. These funds ere insufficient to continue oJ0..ratin`r as we presently are. The funds generated by these means will not cover nossesary repairs, maintenance, insurance and equipment purchasing. We are assurred that an adequate protection is highly necessary to protect the stability of reeidental areas, farming and rancing areas (grasslands), town business end school properties in our proposed fir© district. It is evident our liability responsibilities at any fire responses are highly in jeopard;;r. Through studies preformed by our formulation committee we have determined that once a fire district has been established and approved by the State Insurance Commission, we can then adequately carry proper insurances for our operating fire district and it's equipment, which in turn could and pooaibly would reduce moat patrons insurance premiums. FACILITIES Trucks - Our committee proposes to make available for our district: (1) late model 1 ton 4wd pickup equipped with a water tank capacity of 3 to 4 hundred gallons with sufficient pumping capacity, and all Fire District regulated fire fighting equipment. This truck would be smaller, but faster to respond first to fire calls. (2) this committee's recommendations are to acquire a larger fire truck: 1500 to 3000 gallon capacity equipped with primp and proper fire fighting equipment in accordance with State Fire District requirements and regulations. This truck could possibily be obtained through bidding to other fire districts or by asssisetance by the United States Forest Service. The Colorado State Forest Service will buy a new model truck and will build necessary fire equipment on it at a very reasonable cost{,j8031b9 Our existing 1958 2 ton truck would still be used as a .ire fighting truck or water supply truck along with the intended newer and better condition trucks. Also intended: The present 1969 ambulance assumed by the Fire District will be equipped by Fire District Regulations to be considered a fire rescue unit Station: The facility to be provided for adequate fire protection for the proposed district is to lease with the option to purchase the now existing Weld County Shop. 1e have been allowed to use this facility up to date for our existing equip- ment. This building is located in an ideal location in Briggsdale for a fire equipment storage building and proposed fire station. Call and Alarm System: A telephone system set up by Wiggins Tele. Assoc. will include a specified phone number made available to the public that will ring into at least 20 homes and the fire station. A manually triggered siren to use to set- off for volunteers in the town of Briggsdale will be utlized. Staff: The fire fighting volunteers will be required to be adequately trained to operate equipment, and provide immediate response to fire alarms, and properly protect life, and property. The initial staff will consist of approximately 15 to 20 volunteer fire fighters and fire chief meeting, the training required, in the town of Briggsdale and proposed district area. A five member fire board will be elected. It will be assumed that more volunteers will help in the area when there is a fire fighting unit on fire call in clone proximity. CLASS RATING SYSTEM The present rating for Briggsdale is a 10 according to the Insurance Services Office. Completion of. the proposed fire district will give the Briggsdale area an approximated 8 rating. The rest of the district will remain a possible 10 rating because of the area involved. WATER SUPPLY The water supply for the proposed district will consist of the brigeedale water system. Also the Crow Valley Grazing Assoc. will be consulted to allow water availability at their numerous stock etorage tanks within their association properities. During all times of the year the lriggsdale water supply is always accessible and available at no charge as confirmed by the Briggsdale Water Boerd. There will be a map provided in each fire unit, showing the water sources. ORGANIZATION There will be aO to 15 volunteers i.ucluui'ie e fire chief who will be in charge of the Fire District's responses. Volunteer fire fighters will be required to certify within required time after the fire district is formulated. They will also meet all training requirements to meet the State Fire District Fire fighting laws. RECORDS Coloredo state field incident reports must be completed upon each fire reeponse, meeting or trairing. A copy must be kept and filed for district. reference. MUWAL AID A RJ.E IENTS The facilities and service to be applied are comp:atable with adjoining districts and will compliment overall fire protection in the county.
