RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN OIL AND GAS STORAGE FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - SNYDER OIL COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 6th day of July, 1988 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Snyder Oil Company, 1801 California Street, Suite 3500 , Denver, Colorado 80202 , for a Site Specific Development Plan and Special Review Permit for an oil and gas storage facility in the A (Agricultural) Zone District on the followin-g described real estate, to-wit: Part of the NWi NW-j , Section 15 , Township 4 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Robert Annear, and WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements -of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan ' s Urban Growth Boundary Goals and Policies . The Mayor of La Salle in his referral dated May 25 , 1988 , indicated the request does comply with the La Salle Comprehensive Plan. He also indicated several areas of concern that PX� 4-3 880510 Page 2 RE: USR - SNYDER OIL COMPANY should be addressed. Special Review Permit Development Standards address these concerns. b. The proposed use is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The proposed use is compatible with the existing surrounding land uses which include row crop farming, oil and gas production, and rural residences. The use will be compatible with the -future development of the surrounding area as permitted by the Agricultural Zone District. Special Review Permit Development Standards will ensure continued compatibility with the surrounding land uses . d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review permit for an oil and gas storage facility in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subiect to the following conditions: 1 . The attached Development Standards for the Special Review permit be adopted and placed on the Special Review plat prior to recording the plat . 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . The Site Specific Development Plan and Special Review Permit is for an oil and gas storage facility in the A (Agricultural) Zone District, as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C. R.S. , as amended. 3 . All construction on the property shall comply with the requirements of the La Salle Fire Department as set forth in the February 1 , 1988 , letter from Gary Sandau, La Salle Fire Marshall . 4 . The applicant shall report all leakages to the Environmental Protection Agency and the Weld County Office of Emergency Management and shall comply with the requirements of SARA Title III, Section 313 . 5 . Waste oil and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and ground water contamination. 6. No permanent disposal of wastes shall be permitted on the site. 7 . A spillage retention berm shall be required around the tank battery. -The -volume retained by the spillage berm shall be greater than the volume of the tank inside the berm. 8 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 880510 Page 2 DEVELOPMENT STANDARDS - SNYDER OIL COMPANY 10-. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 11 . Personnel from the Weld County Health Department, La Salle Fire Protection District, State Oil Inspector 's Office , and Weld County Department of Planning Services shall be granted access -onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 12 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans er standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13 . The property owner or operator shall be responsible for complying with all of the foregoing standards. Lanell Swanson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record of this hearing. Robert Annear, representing the applicant, said this facility is currently in use. He also stated that Snyder Oil Company -has no objection to the 13 proposed Development Standards. (Tape Change #88-31 during Mr. Annear's comments) No public comment was offered concerning this matter. Commissioner Lacy moved to approve the request of Snyder Oil Company for a Site Specific Development Plan and a Special Review Permit, subject to the Conditions and Development -Standards in the Planning Commission's recommendation. LEGAL DESCRIPTION: Part of the NW} NW} of Section 15, T4N, R65W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 2.5 miles southeast of the Town of La Salle. APPEARANCE: Robert Annear, Snyder Oil Company, represented the applicant. This request is for a methanol storage tank which they use in their oil and gas productions facilities. The addition of methanol keeps the tanks from freezing in the winter time. The Chairman called for discussion from the members of the audience. There was none. The Chairman asked the applicant if he had reviewed the recommendation, conditions , and Development Standards as outlined by the Department of Planning Services' staff. He stated he has, and has no objections to these items. A. ) Standards. 1 ) Snyder Dil shall supply proo-f that the State Oil Inspector has approved the tank construction including testing. 2) Tanks with pressure not in excessof 2. 5 psig (Methanol ) must be a minimum of 50 feet from the nearest side of any public way. Tanks with pressure over 2. 5 psig (Propane) must be a minimum of 100 feet from the nearest side of any public way. 3) All tanks atthis location must be marked according to U. F. C. Standard 79-3, I have enclosed a copy of this standard 4) The minimum horizontal separation between the Propane container and the Methanol tank shall be 20 feet. 5) The design of the supporting structure for tanks shall be in accordance with well -established engineering pri-nciples of mechanics and shall comply with Building Code. Tanks shall be so supported as to prevent the excessive concentration of loads on the supporting portion of the shell . 6) Control of spillage from aboveground tanks. -Facilities shall be provided so that any accidental discharge of any Class I , II or IIIA liquids will be prevented from endangering important facilities, adjoining property or reaching waterways. Suitable means shall be taken to prevent the accumulation of Class I , Class 11 or Class IIIA liquids under adjacent Propane containers such as by dikes, diversion curbs or grading. NEED FOR USE: This tank will be used as central storage for the methanol we use on a daily basis to prevent freeze-ups of down-hole and surface equipment on approximately 300 producing oil and gas wells and 400 miles of pipeline which we operate in Weld County. EXISTING USES: Adjacent to the proposed Methanol Tank Site within our 200' x 150' surface lease is our existing 12,000 gallon propane tank and a pipeline facility. Outside of our surface lease the land is used for agriculture. DISTANCE TO RESIDENTIAL STRUCTURES: There are no residential structures within 500 feet. The nearest house is approximately 1 4 mile away. NUMBER OF USERS EMPLOYEES, AND VEHICULAR OPERATIONS: Methanol will be unloaded from the storage tank in 50 to 75 gallon increments by our field employees as needed. This will represent an activity level of possibly 6 pick-up trucks per day during the winter months, and the resupply of methanol to the tank by a transport approximately ten times per year. Approximately four pick-up trucks per day will load propane and the pipeline facility will he serviced by vehicles twice daily. HOURS OF OPERATION: Operations will be conducted 365 days a year, day or night, as needed. WATER SOURCE: No water needs are anticipated. ACCESS ROUTE: Trucks will enter the facility from WCR 43 and exit onto WCR 43 farther along the facility via a crescent shaped gravel driveway. See map. SEWAGE FACILITY: No sewage needs are anticipated. FIRE PROTECTION AND SAFETY: See letter attached from Gary Sandau, Fire Marshall, Town of LaSalle Fire Department. An earthen berm with dimensions of 50' x 15' x 3' with a capacity of 16,8313 gallons will surround the tank. A 6' high chain link security fence with 3 strand barbed wire on top will enclose the structure providing for the safety of people and livestock. No weeds will be allowed to grow - prevented by spraying and cutting. ANIMALS: There will be no animals concentrated on the Special Review Area. WASTE & STORAGE: There will be no waste or storage areas located on the SRA other than the tank itself. STORMWATER: There will be no storm water retention facilities associated with the proposed use. Culverts are placed in the ditch under our proposed route of ingress and egress from WCR 43. EROSION CONTROL: The SRA is primarily flat, lying within a 10 foot contour interval per the USGS topographic map, but will be graded to insure that there is no elevation change. The site has a gravel surface. Erosion, therefore, should not be a factor. RECLAMATION: Upon cessation of use for our operations, the site will be restored and reclaimed to a condition, as nearly as is possible, as existed prior to our impact. TIMETABLE FOR CONSTRUCTION AND USE: Tank has already been enplaced: see attached letter from Chuck Cunliffe, Department of Planning Services dated 2/9/88. FLOOD PLAN, Etc.: The use by Special Review Area is not _located in a flood plane, geologic hazard or Weld County Airport overlay district area. NOISE: The use by Special Re-view Area will in no way exceed the State requirements regarding noise. The only noise generated would be from the vehicles. • 880510 Page 2 WELD COUNTY COMPREHENSIVE PLAN The proposed emplacement of the Methanol tank would greatly enhance our existing oil and gas production operations and our ability to pursue future development of the petroleum reserves in Weld County. This is consistent with item 7 of the Agricultural Goals of the Weld County Comprehensive Plan: "(Develop policies and regulations to) permit development of oil, gas... on agricultural lands". The Special Review Area is located in an agricultural zone district but falls within, but at the very edge of, the boundaries of the LaSalle urban growth area. The SRA would not contradict the standing Agricultural Goals of the Plan given the tiny size of the site in question: 50' x 15', being less than 0.1 acre. Because the SRA is so small, the impact of the proposed use on agricultural development would be extremely insignificant. Furthermore, the SRA is a compatible use of the land in the immediate vicinity as there is located adjacent to the proposed methanol tank a propane tank and small pipeline facility. The location of these two pre-existing structures proximate to our SRA has meant that the area of our SRA has not been farmed. In fact, our SRA would take no land out of agricultural production. The SRA also falls within the LaSalle urban growth area. However, as neither county or municipal services and/or maintenance are required, there shall be minimal, if any impact, upon town or county intrastructure by-the emplacement of the tank. In the short term, the approved SRA will add taxable property to the tax roles. More importantly, it will contribute to the present and future development of Weld County's mineral resources by making it easier for Snyder Oil to prosecute drilling and production operations in the County which in turn will greatly increase the tax revenue to the County.
