RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR LEASE-PURCHASE OF
AMBULANCE BETWEEN WELD COUNTY AND AULT-PIERCE FIRE PROTECTION
DISTRICT AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an
Intergovernmental Agreement between Weld County and the
Ault-Pierce Fire Protection District for the Lease-Purchase of a
1982 Ford Type III Ambulance , currently owned by Weld County, and
WHEREAS, the terms and conditions are as stated in said
Agreement , a copy of which is attached hereto and incorporated
herein by reference, and
WHEREAS, after review, the Board deems it advisable to
approve said Intergovernmental Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Intergovernmental
Agreement between Weld County and the Ault-Pierce Fire Protection
District to Lease-Purchase of a 1982 Ford Type III Ambulance be,
and hereby is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 2nd day of
July, A.D. , 1986 .

INTERGOVERNMENTAL AGREEMENT FOR
LEASE-PURCHASE OF AMBULANCE
THIS LEASE-PURCHASE AGREEMENT, made on the 2nd day of
July , 1986 , by and between AULT-PIERCE FIRE
PROTECTION DISTRICT, P. O. Box 279 , Pierce, Colorado 80650 ,
hereinafter the "District, " and WELD COUNTY, COLORADO, by and
through the Board of County Commissioners of the County of Weld ,
State of Colorado, 915 Tenth Street, Greeley, Colorado 80631 ,
hereinafter the "County. "
WHEREAS, District desires to purchase an ambulance for the
purpose of providing "first response" care to patients prior to
the arrival of paramedics , pursuant to Section 32-1-1002 (1) (c) ,
CRS, and
WHEREAS, County currently owns a 1982 Ford Type III Ambulance
that it wishes to sell , and
WHEREAS , District and County wish to enter into a
Lease-Purchase Agreement, as authorized by Section 29-1-201 , et
seq. , CRS; Article II, Section 2-3 , of the Weld County Home Rule
Charter; and Section 32-1-1001 (1) (d) , CRS , wherein District leases
said ambulance from County over a period of three (3) years , with
all lease payments going towards the purchase of said ambulance at
the end of said three-year period, and
WHEREAS , the purpose of this Intergovernmental Agreement is
to increase the "first response" care for the mutual benefit of
the people of the County of Weld and the persons living within the
Ault-Pierce Fire Protection District.
NOW, THEREFORE, in consideration of the foregoing, the
District and County mutually agree and covenant as follows :
1 . That County shall lease to District a 1982 Ford Type III
Ambulance from Atlantic Ambulance Builders, Vehicle Identification
Number 1FDKE30L8CHA87315 , along with the following essential
equipment for ambulance service:
2 ladder splints 1 package of air splints
1 stair chair 1 scoop stretcher
4 sandbags 6 Cervical collars
1 hanging stretcher 1 5# fire extinguisher
1 safety kit 1 hare-traction splint
1 cot 1 portable suction with
1 wall mounted suction catheters & tubing
1 Motorola fire radio 1 GE Med radio
1 jump kit with supplies 1 adult Mast pants
1 Peds Mast pants

2. That all lease payments shall apply toward purchase of
said vehicle.
3. That the term of this Lease shall be three (3) years.
4. The County and District agree to the following payment
terms:
Lease Payments Due: Lease Payments:
July 1 , 1986 $3,500. 00
July 1 , 1987 $4 , 340 . 00
July 1 , 1988 $4,060. 00
July 1 , 1989 $3 ,780 . 00
5 . District agrees to the following:
A. District shall provide the following insurance in
the amount specified, naming "Weld County, by and
through the Board of County Commissioners of Weld
County" as an additional named insured:
(1) Bodily Injury:
Each Person $100 , 000 . 00
Each Accident $300 , 000. 00
(2) Property Damage:
Each Accident $300 ,000 . 00
(3) Uninsured Motorists:
Each Person $100 ,000 . 00
Each Accident $300 , 000 . 00
B. To indemnify, hold harmless, and defend County, the
agencies thereof, and its officers and employees
from any and all loss and damage for any claims ,
including any consequential damages , which may
arise out of or be connected with the driving of
said ambulance or the performance of medical
services therein .
C. To pay any and all local, state, and federal taxes
and registration fees for said ambulance.

If District should locate said/ ambulance in a

different location, it shall notify County of the
same.
E. To pay for the cost of operating said ambulance
during said three-year term and also to pay for any
and all repairs which said ambulance may need.
6 . County agrees to the following:
A. To transfer title to said ambulance to District
upon the payment of $3 ,780. 00 on July 1 , 1989 , and
upon total payment of $15 ,680 . 00 by that date.
7 . That upon the transfer of said title and ownership,
County shall provide no warranties , express or implied, for said
ambulance. The ambulance shall be purchased by District on July
1 , 1989 , as is and with all faults.
8 . That in the case of the non-payment of any of the
amounts stated in Paragraph 4 above on the date stated therein, or
upon the material breach by District of any of the terms and
covenants contained herein, County shall have the right to the
immediate possession of said ambulance without any payment to
District therefor, and this Agreement shall he deemed to be
terminated.
WHEREFORE, the respective parties set their hands and seals
hereto this 2nd day of July , 1986.
