SCHOENLEBER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 866 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 866 was submitted by Donald M. and Norma L. Schoenleber for property which is located in the E' SE4, Section 3 , Township 5 North, Range 64 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 76 acres and 2 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is , exempt from the definition of the terms , "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. Schoenleber. The parcel of land on which this request is being made is described as the E} SE} of Section 3, T5N, R64W of the 6th P.M. , Weld County, Colorado. The property is located 2.5 miles northeast of Kersey on Weld County Road 60-1/2. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 75.5 acres and 2 acres, more or less. The applicants wish to retain the larger parcel and maintain its present use and sell the smaller parcel for residential use. Both proposed lots will have access and adequate frontage from Weld County Road 60-1/2. The majority of the property is irrigated farmland. The Schoenlebers' residence and farm outbuildings are located in the northwest corner of the subject parcel. The 77.5 acres in question are described as two separate parcels (40 acres and 37.5 acres) by deed. Subdivision Exemption #100 was approved and recorded in August, 1979. The exemption permitted 2.5 acres, including existing improvements, to be split from the northeast corner of the original 80 acres. A condition of the subdivision exemption approval was chat the 37.5 acre parcel be tied to the 40 acre parcel for future development purposes, creating one 77.5 acre parcel. The exemption did not create any additional building sites on the property. A third building site is being requested by the applicant at this location. The application materials state that the 2 acres in question will be isolated and difficult to farm, due to the location of a proposed oil and gas access easement. It is also stated that the sale of the proposed 2 acre lot would enable the applicant to upgrade the irrigation systems on the remaining acreage. r.t t 1 UALL' 860464 Board of County Commissioners May 14, 1986 Page 2 The following referral agencies have reviewed the application materials and have no objection to the request: - Town of Kersey - Weld County Health Department The Lone Tree Ditch and Lateral Company did not respond to the staff's inquiry. The Department of Planning Services staff raviewed the Schoenlebers' proposal on May 7, 1986, and has concerns for approving a request to resubdivide this 80 acre parcel. A 2 acre residential site would be created by the exemption in a location not designated within a future town growth area. Further, the applicant has not adequately addressed in the submitted application materials that the proposed land-use will be in compliance with the Weld County Comprehensive Plan, consistent with the intent of the Agricultural Zone district, and consistent with efficient and orderly development. The staff requests that the Board of County Commissioners consider this recorded exemption application and determine if the standards of Section 9-2 T. (1) (a) through (m) have been met. The leveling would entail considerable expense and far exceed the value of the land. In the near future Sunshine Valley Petroleum plans to drill a well on this property. (Weld County Oil , Gas Permit 9-3 on/or about 15 March 86). The location of the gas and oil well and the access road will cause a physical split of the two forty acre parcels for some 660 feet north to south. This new access road would isolate the 2 acres in question , and render the land useless to me in my farming operation . Recently, I was approched by a individual who would like to purchase this 2 acres for a home building site. This proposed home would be of brick construction and of value of over $100,000. Real Estate taxes for 1985 on the entire parcel of land (37Y2 acres ) is $41 .70. I feel that by selling the 2 acres of nonproductive land for a home building site would increase Weld County Real Estate taxes by approximately 10 times the current amount rendered. The money received for this two acre lot would provide me the capital to upgrade the irrigation systems on the total remaining parcel (75 acres more or less ). The proposed 2 acre exemption is located 8 3/4 miles east of Greeley, 4 miles north and 1 mile east of Kersey and 2 miles south of Gill . This parcel of land is confined within the geographical boundries of State Road 37 West, Weld Road 62 North , Weld Road 57 East. Within a radius of 1 square mile there are 2 twenty acre tracts, 3 fifteen acre tracts , 1 seven acre tract, 2 five acre tracts, 1 two and a half tract, 2 two acre and I one acre tract.
