PE: APPROVE AMENDMENT TO THE SERVICE PLAN OF THE ST. VRAI_N
SANITATION DISTRICT
WHEREAS , the Board of County Commissioners of Weld County ,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is; vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , pursuant to the provisions of Title 32 , Article ,
Part 2 , C.R. S. , the Board of County Commissioners of Weld County ,
Colorado, held a public hearing to consider an amendment t the
Service Plan of the St. Vrain Sanitation District. on the 3rd dal
of August, 1988 , and
WHEREAS , notice of the hearing was duly published three time= s
in the Platteville Herald, on July 13 , 20 , and 27 , 7988 , as
required by law, and notice was forwarded to the petitioners , to
the Division of Local Government, and to the governing body of
each municipality and special district which has levied al d
valorem tax within the next preceding tax year and which has
boundaries within a radius of three miles of the proposed se: vice
area , and
WHEREAS, the hearing was open to the public, a record of the
proceedings was made , and all interested parties, as defined in
Section 32-1-204 , C. R.S . , were afforded ar opportunity to be
heard , and
WHEREAS, no interested parties appeared personally cr
presented written objections , and
WHEREAS , the Board has considered the amendment to the
Service Plan and all other testimony and evidence presented at the
hearing , and
WHEREAS, it appears that the amendment to the Service_ Plan
should be approved, subject to the condition. that the amende St .
Vrain Sanitation District Service Area Plan Map and legal
description shall be changed to show that the following has beer.

NOW, THEREFORE, BE IT RESOLVED by the Board of Count:
Commissioners of Weld County, Colorado:
Section 1 . The Board of County Commissioners of Weld Count ,
Colorado (the "Board" ) , does hereby determine that all of the
requirements of Title 32 , Article 1 , Part 2 , C .R.S . , relating
to the filing of the amendment to the Service Plan for the!
St . Vrain Sanitation District have beer fulfilled and that
notice of the hearing was given in the time and manner
required by law.
Section 2 . The Board hereby finds and determines that :
a . There is sufficient existing and projected nee c for
organized service in the amended service area to be
serviced by the District.
b. The existing service in the amended area which ma?
be served by the District is inadequate for present
and projected needs .
c. The District is capable of providing economic and
sufficient service to the amended service argil
within its proposed boundaries .
d . The area to be included in the District has and
will have the financial ability to discharge the
proposed indebtedness on a reasonable basis .
e. Adequate service is not or will not be available tr
the amended service areas through the County, cther
existing municipal or quasi-municipal corporations ,
including existing special districts , within a
reasonable time on a comparable basis.
f. The proposal is in substantial compliance with a
master plan adopted pursuant to Section 30-28- 108 ,
C .R. S .
g. The proposal will comply with the 208 Area- Wide
Wastewater Management Plan .
h. The amendment to the service area will be in the
best interests of the area proposed to be served .
Section 3 . The amendment to the Service Plan of the Sr .
Vrain Sanitation District is hereby approved, subject tc the
abovementioned condition .

The following business was transacted:
I hereby certify that pursuant to a notice dated July 6, 1988, and duly
published July 13, 20, and 27, 1988, in the Platteville Herald, a public
hearing was conducted to consider an amendment to the Service Plan oC the
St. \'rain Sanitation District. Lee Morrison, Assistant County Attorney,
made this matter of record. Rod Allison, Planning Department
representative, entered the favorable recommendation of the Planning Staff
into the record. He also submitted the legal description of property which
is to be excluded from the District, as recommended by the Planning
Commission. Wally Grant , Attorney, came forward to represent the applicant.
He said this request is to enlarge the service area boundaries, as a result
of the final location of the plant and requests received from residents. No
public comment was received concerning this request. Commissioner Lacy
moved to approve this request, based upon the recommendation of the Planning
Commission and subject to the recommended change in the legal description.
The motion was seconded by Commissioner Kirby and carried unanimously.
This Certification was approved on the 8th day of August, 1988.

PUBLIC NOTICE IS HEREBY GIVEN that an amendment to the St. Vrain
Sanitation District Service Plan has been filed with the County Cleric
and Recorder of Weld County, Colorado. The amendment and related
documents are now on file in the office of the Clerk to the Board of
County Commissioners, 915 10th Street, Third Floor, Greeley, Colorado,
and are available for public inspection between 8:00 A.M. and 5:00
P.M. , Monday through Friday.
NOTICE IS FURTHER GIVEN that, by Order of the Board of County
Commissioners of Weld County, Colorado, a public hearing on said
amendment and related documents will be held in the Centennial Center,
915 10th Street, Greeley, Colorado, at 2:00 P.M. , on Wednesday, the 3rd
day of August, 1988.
The purpose of the hearing shall be to consider said amendment of the
Service Plan of the St. Vrain Sanitation District and to form a basis
for adopting a Resolution approving, conditionally approving, or
disapproving the amendment.
The amendment concerns the enlargement of the Service Area to include
portions of Sections 19, 20, 29, 30, and 31 in Township 3 North, Range
67 West; portions of Sections 21, 22, 23, 24, 31, and 32 in Township 3
North, Range 68 West; portions of Sections 3, 4, 5, 6, 7, 8, 9, and 10,
Township 2 North, Range 67 West; and portions of Sections 26, 27, 28,
33, 34, and 35, Township 2 North, Range 68 West of the 6th P.M. Weld
County, Colorado.
Pursuant to Section 32-1-202, C.F.S. , the amendment to the Service Plan
may not be approved if a petition objecting to said amendment and
signed by the owners of taxable real and personal property, which
property equals more than fifty percent of the total valuation for
assessment of all taxable real and personal property to be included in
the District, is filed with the Board of County Commissioners no later
than ten days prior to the hearing, unless such property has been
excluded by the Board of County Commissioners under Section
32-1-203 (3.5) , C.R.S.

RESOLUTION OF THE WELD COUNTY PLANNING COMMISSION
Moved by Ann Garrison that the following resolution be introduced ler
passage by the Weld County Planning Commission. Be it therefore Resolved by
the Weld County Planning Commission that the following be adopted:
REQUEST: An amendment to the St. Vrain Sanitation District Service Plan
NAME: St. Vrain Sanitation District, ch Wally Grant
ADDRESS: 515 Kimbark Street, Longmont, CO 80501
Based upon the review criteria set forth in Section 4. 32-1-203 (1) , C..R.S.. ,
the Weld County Planning Commission recommends, approval of the amendment to
the St. Vrain Sanitation District Service Plan for the following reasons:
1. There is sufficient existing and projected need for organized sirvice
in the amended service area to be serviced by the proposed Dist.ri..r T .
2. The existing service in the area to be served by the proposed Dict:r4tt
is inadequate for present and projected needs.
3. The proposed District is capable of providing economic and suff cient
service to the amended service area within its proposed boundaries.

CASE NUMBER: Amendment to the St. Vrain Sanitation District Service
Area
APPLICANT: St. Vrain Sanitation Service Area, c/o Wally Grant, President
REQUEST: To amend the service area for the St. Vrain Sanitation District.
LOCATION: The proposed service area extends to -approximately1/2-mile north
of Weld County Road 32, to Weld County Road 21 on the east, to the
Weld-Boulder County line on the west, and to State Highway 52 on
the south.
APPEARANCE:
Wally Grant, Attorney, President, St. Vrain Sanitation District Service
Area, explained the new area this request would encompass.
LaVern Nelson, P.E. , explained one of the reasons they are expanding the
service area is so they will not have to come before the Planning Commission
and the 208 Committee every time someone would want to connect to the sewer
system. This service area should be compared to a water service area or an
electrical service area.
The Chairman called for discussion from the members of the audience.
Adam LaPore, Tri-Area Sanitation District suggested this service extend to
Weld County Road 11. In this way, people in this area would be served by
either the Tri-Area of the St. Vrain Sanitation Districts.
Phillip McCoy, area resident, spoke in favor of this request. -
AMENDMENT:
Ann Garrison moved---As a condition of approval, the amended St. Vrain
Sanitation District Service Area Plan Map and legal description shall be
changed to show Weld County Road 11 as the eastern boundary line for the
revised area. Motion seconded by LeAnn Reid.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.

Commission for their decision. LeAnn Reid - yes; Louis Rademacher - yes;
Paulette Weaver - yes; Ann Garrison - yes; Lynn Brown - yes; Motion carried
unanimously.
MOTION:
Ann Garrison moved the request for an amendment to the St. Vrain Sanitation
District Service Area be forwarded to the Board of County Commissioners with
the Planning Commission' s recommendation for approval based upon the
recommendation of the Department of Planning Services' staff and amended by
the Planning Commission, and the testimony heard by the members of the
Planning Commission. Motion seconded by LeAnn Reid.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. LeAnn Reid - yes; Louis Rademacher - yes;
Paulette Weaver - No. She feels that there is a need for public sewer
systems rather than a proliferation of septic systems, but at this point she
does not see a need to enlarge the service area. She feels we are creating
a city in this area without a local governing body. She does not find the
County government sufficient to govern what is developing as a city and
until she sees this area operating as its own incorporated city she is not
in favor of expanding the development area. Ann Garrison - yes; Lynn
Brown - yes; Motion carried four voting for the motion and one vot::ng
against the motion.

Planning Commission Function: To make a recommendation to the Board of
County Commissioners based on the criteria listed in Section 32-1-203 C.R.S.
A copy of Section 32-1-203 is attached.
Project Overview: The existing St. Vrain Sanitation District (SVSD)
service area covers approximately 21 ,600 acres, more or less , in Southwest
Weld County. This includes the I-25 Mixed-Use Development area. The
proposed SVSD service area would cover approximately 34,930 acres, more or
less. The proposed service area would designate an expanded area which
could potentially be served with public sewer facilities. Approval of the
expanded service area should not affect the County's land-use program. All
land-use applications in the service area would be reviewed in accordance
with the applicable sections of the Weld County Comprehensive Plan, boning
Ordinance, and Subdivision Regulations.
A copy of the referral list is attached. The Weld County Tri-Area
Sanitation District, City of Longmont, and the North Front Range Water
Quality Association had specific responses. Copies of these responses are
attached.

Dear Mr. Allison:
We hereby re-emphasize of concerns stated in our letter of Oc-
tober 21, 1987. Our wish is to continue to serve the towns of
Frederick and Firestone in all future annexations. Land use
plans indicate Frederick's intent to develop in a westerly
direction, and between the present town boundary and Interstate.
Highway 25. Annexations in this direction and along Weld County
Road 18 have already occurred. Extension of the St. Vrain serv-
ice area south of their present boundary would eliminate out
ability to provide service to this area.
We have taken it upon ourselves to contact the towns of Frederick
and Firestone to solicit their response to the proposed
amendment. Frederick's town council unanimously voted to con-
tinue service with our district in alL future annexations.
Firestone has requested additional information for which we have
had insufficient time to respond.
In consideration of the Town of Frederick' s request and our in-
tent to honor this request should they petition for inclusion
into our District, we respectfully ask that Weld County disaLlow
the proposed extension south of Weld County Road 20 and their
July, 1985 Service Area Boundary Line.

Dear Mr. Allison:
We would like to thank you for the opportunity to respond to St.
Vrain Sanitation District's request to amend their service area.
The Weld County Tri-Area Sanitation District and Dacono Sanita-
tion District have serviced the Towns of Firestone, Frederick an
Dacono, as well as the community of Evanston, for many years. We
have attended to their wastewater needs in the past and wish to
continue to do so in the future.
Prompted by completion of the Town of Frederick Comprehensive
Plan Update in December of 1986 and in an effort to address cer-
tain issues between our two districts, we recently authorized a
Master Plan study to, in part, investigate service to the Town of
Frederick's urban growth areas shown in Exhibit 5, specifically
AREA A, of the Comprehensive Plan Update. Our existing was-
tewater treatment facility lies at the northeast corner of this
area. Based on the conclusions of our Master Plan study, we have
the ability to service AREA A, and an area south and southwest of
AREA A. A delineation of our intended service area, which in-
cludes AREA A, is attached as Figure IV-1 and titled WCTASD Serv-
ice Basin. An overlap of St. Vrain's amended service area and
our intended service area exists from 1/2 mile north of Weld
County Road 18, to Colorado State Highway 52 on the south, to 1/2
mile west of Weld County Road 13 on the east and to Weld County
Road 7 on the west. While realizing the St. Vrain Sanitation
District only proposes an amendment to their "service area'" and
not their "district boundary", we do want the County Commis-
sioners to recognize that an overlap will exist and request that
they direct their decision so as to not encumber our ability to

service the above mentioned area; should we, as a quasi-municipal
entity, elect to annex this area into our area of service.
Furthermore, historically we have had oral agreements with the
Town of Frederick and Town of Firestone that we would service
them in all future annexations. We wish to maintain the ability
to further honor these agreements in the above mentioned area of
proposed "overlap" . Therefore we again ask the commissioner to
direct their decisions so to not prevent us from honoring these
agreements.
Our existing wastewater treatment facility consists of an aerated
pond system. Upgrades to this facility will allow expansion of
its' capacity to two million gallons per day (2 MGD) . Based on
population projections contained in the Comprehensive Plan Update
and with these upgrades we will have the ability to treat was-
tewater from AREA A. Again we ask that the County Commissioners
not encumber our ability to do so.
We respectfully request your consideration of this letter rela-
tive to CRS 32-1-205.

Thank you for sending the proposed amendment to the St. Vrain Sanitation
District (SVSD) to the City of Longmont for our review. From the application
materials, I understand that the location of the wastewater treatment facilit,
is further downstream than the location proposed in the "St. Vrain Sanitation
District Service Plan.' A result of this relocation is that the SVSD
ultimately can serve a larger area than originally proposed.
This proposed amendment is to expand the service area boundaries to WCR2'
on the east, to WCR34 on the north, to the Weld/Boulder County Line on the
west, and to Sh52 on the south. The actual district' s boundaries are not
proposed to be expanded in this amendment.
The City of Longmont has two concerns. First, as the City has commented
previously, the St. Vrain River exceeds standards for allowable ammonia
content. Future expansions may be a problem for the SVSD, the City, or any
other jurisdiction within the St. Vrain Basin that wishes to expand its
plant.
Second, the proposed western boundary of the service area abuts the
eastern boundary of the Longmont Planning Area (LPA) . In order to maintain
separate identities , the City supports the establishment and maintenance of
physical buffers between itself and neighboring communities . The Longmont_
Area Comprehensive Plan (LACP) speaks to this issue, specifically:
Goal 6: To plan for the physical separation of the City from neighboring
communities through the use of public and private open space.
Goal 22: Encourage the preservation of unique natural features and
resources of the Longmont area, maintain the community' s separate
identity, provide passive recreationa" areas , and enhance the visual
quality of the community.

Policy 22.3: Establish and maintain urban shaping open space buffers in
strategic areas surrounding the City to maintain the community' s separate
identity.
Strategy 22.31 : Designate strategic open space buffer areas .
Strategy 22.33: Contact other jurisdictions and coordinate the purchase
and preservation of urban shaping buffers , as identified in approved
plans , where both Longmont and other communities or jurisdictions will
benefit.
Consequently, the "Parks and Open Space Element" of the LACP designates an
"Eastern Buffer" around Calkins Lake south to SH119.
Since the proposed expansion to the SVSD service area overlays this
"Eastern Buffer," the City would not like to see, as a result, that the I-25
Mixed Use Development Corridor also is proposed for western expansion .
Consistent with Strategy 22 .33 , above, the City invites Weld County to discuss
further the preservation of an "Eastern Buffer" with us soon.

Dear Lee:
Enclosed is a copy of the Notice of Hearing pertaining to the amendment of
the Saint Vrain Sanitation District' s service plan, Docket No. 88-41. I
have highlighted in yellow the last paragraph which is an incorrect
statement of the law. The District is not adjusting its boundaries, it is
only adjusting its service area. I call your attention to the wording of
Section 32-1-202, C.R.S.
That Section uses two different terminologies. First, it refers to a Rap
of the "proposed special district boundaries" in Subsection 2(d) .
Secondly, Subsection 2.1 states that landowners may object to inclusior o*
their property which is proposed for inclusion into the District.
Section 32-1-203 also speaks of "boundaries" but also speaks of "area to be
served. " Thus, it is possible for a special district to have a service
area which is larger than its established boundaries. That in fact is the
case with the Saint Vrain Sanitation District.
As we have discussed in the past, service areas for most special districts
such as fire districts, are identical to the boundaries of a district.
That is because fire districts usually service only areas within their
boundaries and service extra territorial areas through intergovernmental
agreements with the county or with neighboring districts or fire
departments. However, because of the unique situation of a sanitation
district which requires discharge into waters of the state, Section 32-1-
203 (2.5) (d) requires that any service plan be in compliance with county,
regional , or state long range water quality management plans for the
"area. " In other words, the Saint Vrain Sanitation District simply wishes
to be the designated service provider for the entire area. It is not
adjusting its boundaries to include this entire area at this particular
time. Boundary adjustment must be accomplished through the provisions of
Section 32-1-401, C.R.S.

Dear Mr. Allison:
By its letter of September 4, 1987, the Board of Directors, St. Vrain
Sanitation District, requested that its Service Plan be amended by
substituting a proposed new service area. This request was predicated on
the District having located its treatment plant farther East, and
landowners outside the original service area (hut within the drainage
basin) seeking annexation and future service. This area was then scuared
off with due regard for the natural drainage and other jurisdiction
service areas. A companion thought was to go through this amerdment
process only once , including all area within the Drainage Basin which
could best be served by this District, should service ever 'oe required,
thereby saving both the District and County future processing expense.
Planning Services thereupon referred this matter to nearby entities or
comments. District representatives then met with Planning Services
staff, and the following requirements were placed on the District. They
are:
a. Reconsider the proposed service area boundaries in the light of
annexation interest. The District was urged to defer inclusion of areas
where there was no manifest interest in annexing at this time.
h. Readdress two requirements in Section 32-1-203, C.R.S. , to-wit:
1) Demonstrate that there is sufficient existing and
projected need,
2) Demonstrate that the proposal is in substantial compliance
with the master plan adopted pursuant to Section 30-28-106, C.R. S.
c. Address the issues raised by the respondents to the initial
referral process; particularly meet with Weld County and Tri -Area
Sanitation District.

Planning Services requested that St. Vrain Sanitation District cover this
material in a letter which would be recirculated through the referral
process. Upon receipt of comments, if any, the matter would he referred
to the Planning and Zoning Commission and then the Board of County
Commissioners. This letter is in response to this request.
Proposed Service Area. This District has reduced its -proposed service
area request by 6800 acres. A revised map accompanying this letter
reflects this revision. Some 1,500 acres were deleted to the northeast
adjacent to County Line Road and, for the most part, north of Colorado
Highway 66. Another 5,300 acres were deleted in the southeast bounded by
the present service area to the north and northeast, Weld County Road
5-1/2 if it were to exist, Colorado 52 and County Line Road. There have
been no specific requests for inclusion from these areas. They do remain
in the District' s natural drainage, and the District is the logical
entity to serve these areas should service be required.
Section 32-1-203 C.R.S. Requirements.
a. Landowners in the remaining areas have either petitioned the
District for inclusion or have contacted the District, only to learn that
they could not be considered for inclusion because they were not within
the District' s service area. Their conviction of the importance of
future sanitary service is sufficient to merit increased property tax and
processing fees.
b. The proposed service area expansion is in substantial compli-
ance with the master plan (Weld County Comprehensive Plan) . Provision of
a service area is the initial step in providing and developing sewer
service in a "timely, orderly and efficient manner." It provides for the
procedures and guidelines for disposal of, and disposal sites for.,
wastewater. It is also the initial step in minimizing potential
groundwater pollution from septic tanks. And while not specifically
addressed in the Comprehensive Plan, it also provides the only good
alternative to package wastewater treatment plants.
A service area does not deal with land use; that is the exclusive domain
of zoning. A service area simply designates the area to be potentially
served by a district, be it a fire, library, recreation, mosquito, water
or sewer district. It assigns responsibility to a single entity, and it
avoids inefficient and uneconomical overlap of functions. In the case of
sewer districts, the service area is largely defined by the drainage
basin upland of the treatment plant. The County Comprehensive Plan may
designate the entire range of land uses within a service area, as is the
case with the present St. `train Sanitation District service area ,
Collection lines are not extended unless zoning allows for sufficient
development to bear the cost. On occasion line extensions cross areas

zoned for agriculture, thereby providing sewer service to farms. This is
both beneficial and in conformance with the Comprehensive Plan. It does,
in fact, occur within St. Vrain Sanitation District.
Issues Raised in Initial Referral Process.
1. Weld County Tri-Area Sanitation District. Represertatives of
St. Vrain Sanitation District met with Tri-Area Sanitation District. They
had completed a master plan study on how they might serve Town of
Frederick urban growth areas. The principal element was a lift station
located in the center of Section 23, at Godding Hollow drainage, and a
force main extending due east to their treatment plant. This plan would
serve 1100 acres that are presently in the St. Vrain Sanitation District
service area, for which an existing sewer main 1-1/2 miles to the north,
on Godding Hollow, had already been sized. In addition to the problems
of Tri-Area' s plan extending into the existing St. Vrain service area ,
the economics of serving the area were analyzed. This revealed that St .
Vrain could serve the area at little over one-half the capital cost of
Tri-Area. What-is-more, St. Vrain would have to extend its line in any
event to serve the area below (north of) the Tri-Area lift station/force
main. The tentative conclusion was that this area should be served in
the most economical manner for the benefit of the people, although
Tri-Area reserved the right to comment further upon the second referral
process. Tri-Area Sanitation, with board members also serving on the
Frederick Town Council , prefer a single district serving the Town of
Frederick.
2. Town of Erie. They stated that they found no conflicts with
their interests, but added: "Any development proposal outside of the
present service area' s comprehensive plan, should cause an amendment to
the land use plan and the County' s Comprehensive Plan to occur. " St .
Vrain Sanitation District has no comprehensive ( land use) plan; it relies
solely on the Weld County Comprehensive Plan. Therefore, all development
proposals, both within the present St. Vrain service area and its
proposed service area expansion, will be based upon the County' s
Comprehensive Plan and zoning process.
3. Boulder County. They stated: "The Land Use Department
believes this proposal should be carefully scrutinized by Weld County for
conformance to the Weld County Comprehensive Plan." This is being done,
hence this submittal . They go on to say: "The approval of a service
plan is a major step toward provision of future sanitary services
. . . . " This District concurs that it is a necessary step, but the
major step rests not with the Sanitation District, but with Weld County
in its comprehensive plan revision and zoning processes. Development
will not occur without Weld County approval , and sewer lines cannot he
funded without approved development to bear the cost.

Conclusion. St. Vrain Sanitation District trusts that the above material
meets the County' s need. Additional information and explanation will be
provided upon request. The District hereby reasserts its request that
this proposed service area expansion be scheduled before the Weld
Planning Commission and Board of County Commissioners as early as
practicable.

Dear Commissioners:
Pursuant to Section 32-1-207, C.R.S. , the Board of Directors of the St.
Urain Sanitation District requests that the District's Service Plan be
amended by substituting the proposed new service area as shown on the
enclosed map for the previously approved service area.
In the 1985 Service Plan, the District anticipated that its treatment
facility would be located west of Weld County Road 13, in Section 35.
Township 3 North, Range 68 West. However, due to various factors ( soil ,
flood plain, availability and cost of land, access etc. ) the treatment
facility is now being constructed at a location east of Weld County Road 13
in Section 31, Township 3 North, Range 68 West. Changing the location
downstream has resulted in an increase in the area the District can
ultimately serve.
We now wish to amend the service area as set forth in Exhibit 2 of the
Service Plan, to conform with the actual location of the treatment
facility.
As can be seen on the enclosed map, the proposed new service a-ea extends
to Weld County Road 21 on the east, to Road 34 on the north, to the Weld-
Boulder County line on the west and to the State Highway 52 on the south.
This area is drained by the St. Urain Creek and Boulder Creek and the
District could provide sewer service by gravity to a very large portion, if
not all , of this drainage area.
It is important to clarify that an extension of the service area is not an
extension of the District' s boundaries. The service area simply designates
areas which could potentially be serviced by this District as opposed to
other providers of similar services. It is our understanding that
amendment of the service area will not require amendment of the Weld County
comprehensive plan or zoning resolution.
