RE: APPROVE DECLARING CERTAIN PROPERTY AS SURPLUS AND AUTHORIZE
CHAIRMAN TO SIGN WARRANTY DEED
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners acquired through a
warranty deed, property described as SE* of Section 1 , Township 5
North, Range 65 West, of the 6th P.M. , Weld County, Colorado
WHEREAS, Weld County no longer needs said property and wishes
to declare it as surplus, and
WHEREAS, the Board has been advised that the State Department
of Highways , Division of Highways, State of Colorado, desires to
purchase the above described property, and
WHEREAS, after study and review, the Board deems it advisable
to declare said property as surplus and accept the offer made by
the State Department of Highways.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Board does hereby
declare the hereinabove described property as surplus.
BE IT FURTHER RESOLVED that the Board does hereby accept the
offer from the State Department of Highways, Division of Highways,
State of Colorado, to purchase said property.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Warranty Deed.

more or less, in the SE 1/4 of Section 1, Township 5 North, Range 65 West, of
the Sixth Principal Meridian, in Weld County, Colorado, said tract or parcel
being more particularly described as follows:
Commencing at the SE corner of Section 1, T. 5 N., R. 65 W. , 6th P.M. ,
thence N. 0' 07' 59" E. , along the east line of the SE 1/4 of Section 1, a
distance of 1532.20 feet, thence N. 44' 08' 58" W. , a distance of 1249.10 'feat
to the south right of way line of SH 263 (Sept .nhnr 15, 1988),`Aberce'S.'' 78'.
21' 12" W. , along said south right of way line, a distance of 734..39;feet
*4 rebar with cap (stamped L.S. #4392) , said point being the true point of
beginning;
1. Thence- S. 03' 36' 02" E. , a distance of 425.12 feet, to a #4 rebar
with cap (stamped L.S. #4392);
2. Thence S. 79' 34' 32" W. , a distance of 242.99 feet;
3. Thence S. 77' 55' 06" W. , a distance of 188.75 feet;
4. Thence S. 34' 58' 39" W. , a distance of 382.62 feet, to a iron pin in
the ditch;

with cap (stamped L.S. #4392) ;

10. Thence N. 02' 47' 31" W. , a distance of 394.33 feet, to a pin and cap
(stamped L.S. #7242), said point being on the south right of way lime
of SH 263 (September 15, 1988);
11. Thence N. 78' 21' 12" E. , along said south right of way line, a
distance of 1193.00 feet, more or less, to the point of beginning.
The above described parcel contains 14.100 acres, more or less.
Basis of Bearings: All bearings are based upon the survey and plat
performed by Jasper Freese P.L.S. #4392 of the Davis Retch.
